RESOLUTION NO.– 2023
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
RATIFYING PAYMENT TO SUPERIOR MECHANICAL SERVICES, INC. FOR $17,520; AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST CONTRACT AMENDMENT WITH SUPERIOR MECHANICAL SERVICES, INC. TO INCREASE THE CURRENT YEAR NOTTO-EXCEED BY $17,520 TO A TOTAL NOT-TO-EXCEED OF $57,520 AND WAVING THE FORMAL BID PROCEDURES UNDER SECTION 2.84.070(D) OF THE MUNICIPAL CODE.
WHEREAS, on April 16, 2019 the City Council Approved Resolution 5015 authorizing a threeyear contract with Superior Mechanical, Inc with an annual not to exceed of $40,000; and WHEREAS, the City has through services and equipment incurred $44,797.73 in expenses with Superior Mechanical, Inc; and
WHEREAS, most likely due to the electricity surges which occurred during the wind storms in March of this year, a heat pump at the City’s police department was damaged and required immediate replacement; and
WHEREAS, Superior Mechanical, Inc. was able to provide the replacement and install for $17,520; and
WHEREAS, the City requires continued maintenance and inspection of City HVAC; and WHEREAS, the City of East Palo Alto has been very satisfied with quality, accountability, flexibility, and stability of the services; and
WHEREAS, the most efficient manner to continue these ongoing critical services for the City of East Palo Alto is to continue these services through this Fiscal Year under the current agreement; and
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY:
1. Finds the foregoing recitals true and correct and incorporated by reference into this action;
2. Ratifies the previous purchase and installation of a heat pump from Superior Mechanical Services, Inc. for $17,520;
3. Authorizes the City Manager to execute the first contract amendment with Superior Mechanical Services, Inc. to increase the current year not-to-exceed by $17,520 to a total not-to-exceed of $57,520; and
4. Waives the formal bid procedures under section 2.84.070(D) of the Municipal Code.
