RESOLUTION NO. – 2023
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
ADOPTING THE COMPREHENSIVE FEE SCHEDULE EFFECTIVE JULY 1, 2023 WHEREAS, the City of East Palo Alto (“City”) periodically modifies its Comprehensive Fee Schedule to account for program changes and other costs, ensure existing fees and charges do not exceed the costs of service, and re-align fees with desired cost recovery policies; and
WHEREAS, the user and regulatory fee changes incorporated herein do not exceed the estimated reasonable costs of providing the services in accordance with Government Code section 66014; and
WHEREAS, the user and regulatory fee changes may be increased annually in order to maintain parity with increasing City costs; and WHEREAS, the Parks and Trails, Public Facilities, Storm Drainage, and Transportation Infrastructure Impact fees authorized by East Palo Alto Municipal Code (”EPAMC”) Section 13.28.040, the Affordable Housing Commercial Linkage fees authorized by Section 18.40.010, and the Water Capacity fees authorized by Section
13.24.100 are stated to be increased annually “by a percentage equal to the change in the Construction Cost Index as more recently published by the Engineering News Record” and such fees are incorporated as a separate chapter of the Comprehensive Fee Schedule; and
WHEREAS, the Construction Cost Index increase provided by the March 2023 Engineering News Record equals 3.0% and is applied to the impact fees referenced in EPAMC Sections 13.28.040 and 13.24.100; and
WHEREAS, the February 2023 San Francisco-Oakland-Hayward CA, CPI-U equals 5.3% and is applied to the user and regulatory fees due to inflationary increases in costs to provide services; and
WHEREAS, the City Council held a properly noticed public hearing on April 18, 2023; and
WHEREAS, the City Council finds and determines that the referenced changes are in the interest of the City and are necessary to recover the costs of providing various municipal services, regulatory functions, and development impacts. 2 of 2
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY:
1. Finds the foregoing recitals true and correct and incorporated by reference into this action; and
2. Adopting the Comprehensive Fee Schedule, as set forth as Exhibit A and incorporated by this reference, to be become effective July 1, 2023.
