Resolution No. XX-2023 1 of 2
RESOLUTION NO.___ 2023

A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF EAST PALO ALTO
APPROVING THE QUARTERLY EMERGENCY REPORT FOR MARCH 31, 2023 AND ENDING THE STATE OF LOCAL EMERGENCY FOR THE COVID-19 PANDEMIC.

WHEREAS, on January 31, 2020, the United States Department of Public Health and Human Services Secretary declared a public health emergency for the novel disease named “coronavirus disease 2019” or “COVID-19" by the World Health Organization; and WHEREAS, on March 4, 2020, the Governor of California declared a State of Emergency due to the outbreak and spread of COVID-19; and
WHEREAS, on March 17, 2020, in Resolution 44-2020, pursuant to Government Code Section 8630 and Chapter 2.76 of the East Palo Alto Municipal Code, the City Council proclaimed a local emergency due to COVID-19 and further authorized the City Manager to make repairs, alterations or improvements to the City’s public facilities pursuant to Section 22050 of the California Public Contract Code, take any directly related and immediate actions required by said emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts; and
WHEREAS, City staff services in public safety, administrative services and other divisions have been substantially diverted, and other direct expenditures have been incurred since March 1, 2020 for COVID-19 public health and safety response and mitigation purposes; and WHEREAS, on January 30, 2023, the President of the United States declared his intention to end the National and Public Health Emergencies for COVID-19 on May 11, 2023; and WHEREAS, on February 28, 2023, the Governor of California terminated the State of Emergency due to the outbreak and spread of COVID-19; and WHEREAS, on March 10, 2023, the San Mateo County Board of Supervisors terminated the State of Emergency due to the outbreak and spread of COVID-19; and WHEREAS, the City of East Palo Alto acknowledges the ongoing chronic nature of this disease, but finds that the challenges must be met through normal City processes that no longer require the extraordinary emergency authority granted the City Manager; and WHEREAS, as noted in these declarations of termination, the combination of public health efforts, including vaccination (and boosters) and other mitigation measures (e.g., masking and testing) have provided effective tools to address the continuing threat from COVID-19, thereby neutralizing its threat to the local community.
