RESOLUTION NO.– 2023
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EAST PALO ALTO
RATIFYING PAYMENT TO MUCHMORE THAN CONSULTING, LLC FOR $6,110.62; AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST CONTRACT AMENDMENT
WITH MUCHMORE THAN CONSULTING, LLC TO INCREASE THE NOT TO EXCEED BY $45,000 TO A TOTAL NOT TO EXCEED OF $78,110.62; AND WAVING THE FORMAL BID PROCEDURES UNDER SECTION 2.84.070(D) OF THE MUNICIPAL CODE.
WHEREAS, on January 9, 2023 the City Manager signed an agreement with Muchmore than Consulting, LLC (MTC) for a not to exceed amount of $27,000 to provide on call Human Resource Services; however, the City has already exceeded the current contract by $6,110.62 and MTC continues to provide support for certain ongoing tasks; and WHEREAS, MTC has provided excellent support, allowing the City to complete the important projects improving the Human Resources staff efficiency and reducing potential risk to the City; and WHEREAS, MTC continues to provide support for the vital ongoing tasks; and WHEREAS, regulatory requirements for training, compliance, and policies, and practices in the field of human resources have grown exponentially, and it is no longer possible for a single HR Manager or practitioner to do all that is required for compliance and organizational support; and WHEREAS, due to the current capacity issues described above and the need for a sufficient funding cushion to start formal bidding, staff recommends formal bidding procedures for this appropriation be waived so that the MTC budget be increased to address the anticipated cost increase and to provide services for additional services in East Palo Alto, as determined by staff and consistent with the City’s Personnel Policies and Procedures; and WHEREAS, the most efficient manner to continue these ongoing critical services for the City of East Palo Alto is to continue these services under the current agreement, until such time that the City can issue a Request for Proposals.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF EAST PALO ALTO HEREBY:
1. Finds the foregoing recitals true and correct and incorporated by reference into this action; and
2. Ratifies the previous services from Muchmore than Consulting, LLC for $6,110.62; and
3. Authorizes the City Manager to negotiate and execute the First contract amendment with Muchmore than Consulting, LLC to increase the not to exceed by $45,000 to a total not to exceed of $78,110.62.
4. Waives the formal bid procedures under section 2.84.070(D) of the Municipal Code.
