Bid Results and Transition of Eastvale Frontages Maintenance from JCSD to City of Eastvale
Staff Recommendation:
JCSD staff recommends the JCSD Board of Directors / Eastvale City Council:
1. D iscuss the bid results for landscaping maintenance of the Eastvale frontages; and
2. R ecommend a contractor and option to award; and
3. Confirm July 1, 2022, date for transition of Eastvale Frontages Maintenance from JCSD to City of Eastvale.
Discussion
:
As developers were building homes within the Eastvale area before city incorporation, they were required to establish Community Facilities Districts ( CFDs), which provide funding to develop and maintai n parks and public frontages . In response to their requests JCSD formed voter-approved CFDs and has levied taxes within those CFDs to pay debt service on bonds issued to fund capital improvements and to fund ongoing maintenance of the parks and public frontages. JCSD purchased and improved the parks, which are owned by JCSD, and has maintained the public frontages originally owned by the C ounty of Riverside and now owned by the City of Eastvale.
Through an agreement originally executed with the County of Riverside in July 2000, JCSD is responsible for maintaining over 4 million square feet of frontages owned by the City of Eastvale (City) using funds produced by annual tax levies within the CFDs. JCSD currently contracts with Stay Green, Inc., to maintain the landscaping within the frontages on a six- week rotation. In addition, through a contract with Tree Pros, Inc., all trees within the frontages are trimmed on an annual basis. Both contracts have initial three-year terms with two, one-year renewal options. Both are currently in the first option year, which expire on 6/30/22.
JCSD’s fiscal year (FY) 2021-2022 operating budget to maintain the frontages anticipates receiving approximately $3 million in CFD assessment reven ue to do so.
The budget
breakdown is as follows:
Action / Discussion Item No. 1
March 21, 2022
• $1,200,000 for the Stay Green Landscaping Contract
• $285,000 for the Tree Pros Tree Trimming Contract
• $340,000 for irrigation repairs
• $630,000 for water and electricity
• $46,000 for General Repairs
• $124,000 for personnel
• $405,000 for support services
In addition, JCSD also allocated $350,000 in the FY 2021- 2022 budget for the following projects within the frontages:
Frontage Plant Replacement Project (Phase II of V)
$200,000 for the purchase and installation of approximately 9,000 plants, 35 flats of ground cover, and 750 cubic yards of mulch within the frontages.
Frontage Tree Replacement Project (Phase II of II)
$150,000 for purchase and installation of over 330 trees within the frontages.
On August 19, 2021, the Eastvale Parks Commission agreed that the City and JCSD should develop a process needed for the City to take over maintenance of the frontages.
Consequently, staff from both the City and JCSD collaborated to draft a Memorandum of Mutual Intent (MOMI) , which outlines both parties’ intent to work together to evaluate the feasibility of transferring responsibility for the maintenance of the frontage landscaping to the City . The MOMI (Attachment 2) was reviewed and approved by the Eastvale Parks Commission on October 21, 2021; Eastvale City Council on December 8, 2021; and the JCSD Board of Directors on December 13, 2021.
Intention of the MOMI is to transition
funding and maintenance of the frontages to the City by July 1, 2022.
Given the plan for transferring responsibility of maintenance of the frontages, staff from both agencies worked together to create a Request for Proposal s (RFP) to retain a landscape contractor to maintain the frontages and revise the existing scope of work to reflect different service levels, frequency, etc.
On December 8, 2021, the RFP (Attachment 3) was released and posted on the JCSD website. The scope of work included four options to obtain pricing for 1 -week, 2-week, 4- week, and 6-week maintenance rotations, as well as costs for other services (i.e., irrigation repairs), over a 5-year period (initial 3-year term and two, 1-year year renewal options). The following three proposals were received by the January 7, 2022, deadline (Attachments 4- 6):

Other Services
Given the $340,000 currently budgeted for irrigation repairs in FY 2021-2022, the following scenario utilizes the hourly wages of two full-time irrigation techs (as submitted by each contractor under Other Services) and multiplies said hourly wages by 4,000 hours, which is the average number of hours the current contractor spends on irrigation repairs throughout the frontages:
The JCSD of Board of Directors and Eastvale City Council are requested to discuss the bid results and recommend a contractor and option to award.
The goal for the transition of the maintenance of the frontages from JCSD to the City is July 1, 2022.
Budget Impact:
Depending on the option selected, budget impacts may exist, which will need to be discussed and resolved accordingly.

AN URGENC
Y ORDINANCE OF THE JURUPA
COMMUNITY SERVICES DISTRICT REPEALING
ORDINANCE NO. 317 AND REPLACING THE
DISTRICT’S WATER CONSERVATION PROGRAM
WHEREA S, Jurupa Community Services District (“District”) serves more than 3,000 custom ers, is an “urban water supplier” as defined in Water Code section 10617, and is subject to the Urban Water Management Planning Act; and
WHEREA
S, pursuant to the Urban Water Management Planning
Act, the District has prepared an Urban Water Management Plan (“UWMP”), which includes the District’s Water Shortage Contingency Plan (“WSCP”); and WHEREA
S, the Distric t, benefitting from the foresight of its founders and the planning of its Board through the years , has secured an adequate and stable supply of groundwater for its citizens; and WHEREA
S, as a result, the District is not directly vulnerable to imported and surface water shortages and is less vulnerable to drought than many other areas; and
WHEREA
S, the District’s current WSCP contains four stages, the first being v oluntary and the remaining three being mandatory, and the first mandatory conservation measure drastically restricts outdoor irrigation to a maximum of three days per week and additionally restricts irrigation by odd and even addresses for no more than 10 minutes per station; and W
HEREAS, under the current WSCP, the District can only impose mandatory irrigation restrictions if the Board declares, by resolution, that there is a shortage in the District’s water supply of 10-20 percent; and WHERE
AS, California is currently in the third year of a significant drought resulting in severe impacts to California’s water supplies and its ability to meet all of the demands for water in the State; and
WHERE
AS, on January 17, 2014, Governor Edmund G. Brown, Jr.
declared a drought state of emergency; and
WHERE
AS, Water Code section 1058.5 grants the State Water
Resources Control Board (“SWR CB”) the authority to adopt emergency regulations in years when the Governor has issued a proclamation of emergency based upon drought conditions; and
66 03586.00006\9143771. 4
W
HEREAS, on April 25, 2014, the Governor signed an Executive Order directing the SWRCB to adopt emergency regulations as it deems necessary, pursuant to Water Code section 1058.5, to ensure that urban water suppliers implement drought response plans to limit outdoor irrigation and other wasteful water practices; and
WHERE
AS, on July 15, 2014, the SWRCB formally adopted
emergency rulemaking to enact emergency regulations for urban water suppliers; and
WHEREA
S, the SWRCB emergency regulations prohibit certain
types of potable water use, order all urban water suppliers to implement mandatory conservation measures, and order water suppliers with 3,000 or more service connections to provide monthly data on water production; and WHEREA
S, the SWRCB emergency regulations further mandate
that each urban water supplier shall implement all requirements and actions of the stage of its water shortage contingency plan that imposes mandatory restrictions on outdoor irrigation; and
W
HEREAS, the District is currently able to meet all of its water demands, and therefore the District is unable to adopt a resolution implementing the mandatory restrictions on outdoor irrigation set forth in the WSCP; and WHEREA
S, the District now wishes to replace its WSCP under the authority of California Water Code Section 375, et seq . to establish a new drought response level to comply with the SWRCB’s emergency regulations; and WHEREA
S, the District must adopt ordinances in the same manner as counties; and
WHEREA
S, the District may, therefore, adopt an urgency
ordinance where it is specifically required by any law to take immediate effect; and
