CITY OF EASTVALE
2023 UPDATE
100
On February 9, 2023 the City Council, staff, and residents participated in a Strategic Plan Workshop.
During the workshop, the City Council engaged in a participatory process, in which they established expectations for the workshop and intended outcomes; identified the organizations strengths, weaknesses, opportunities, and threats; reaffirmed and reorganized the seven major targets; and, reaffirmed and reorganized the priority goals.
The City of Eastvale operates under a City Council/City Manager form of government. The City Council consists of five Council Members. The members of the City Council set policy and enact City laws. The City Manager is appointed by the members of the Eastvale City Council. One of the primary responsibilities of the City Manager is to implement the plan set forth by the City Council, utilizing the City Departments and Executive Team. The purpose of the workshop was to assist the City of Eastvale’s Mayor, City Council, and City Manager in developing Eastvale’s Strategic Plan including clearly defined targets and goals in order to provide staff with clear direction. A strong strategic plan is like a good roadmap—it identifies a destination and lays out a clear path to get there.
At the conclusion of the workshop, the Mayor and City Council had effectively established clear direction and focus for the Executive Team related to targets and goals. The City Council clearly communicated its desire and intent to blend this exercise with the results of the community survey in the future allocation of resources related to programs and services. It was further intended that this plan remain a fluid and evolving document to be re-visited at regular intervals for progress and re-shifting of priorities, as needed.

Strategic Plan Action - Priority Level: 1
| Target #: 5
| Goal #: 1
The proposed contract contribute to the development of Downtown Eastvale, which can significantly aAract businesses and retailers to establish their presence in the City and create a “Destination Eastvale” with high-quality and unique businesses.
Fiscal Impact
The total General Fund fiscal impact for the contract amendment could total $11,665,296 over the life of the contract and Civic Center project, should all alterna.ves be implemented. However, it is likely that some amendments and/or consultant time will not be necessary.
Approximately $2,862,711 in budget in the current fiscal year is available as of the publica.on date of this report under Capital Improvement Plan Project No. 95011 for the Civic Center in the General Capital Projects Fund under account 600-500-6650 for the Gensler contract revision. This will be adequate budget to complete the fiscal year. A request for addi.onal project budget to cover the remainder of contract costs will be included in the 2023-24 budget proposal and will impact the city's General Fund.
Prior City Council/Commission Action
Council authorized staff to start the RFP process for an Owner Representa.ve/Program Manager and Bridging Architect on July 28, 2021.
In November 2021, the City Council approved a contract with Griffin Structures and sub-consultants, LPA (architects), Urban Arena (architects), and Circle Pointe (communica.ons) in the amount of $4,580,000 for outreach, design up to Design Development, and Construction Administration
City Council approved the Downtown Eastvale Master Plan Amendment (Leal Master Plan Amendment) project and the associated Development Agreement on May 11, 2022.
On October 12, 2022 the City Council authorized the City Manager to execute a contract amendment with Gensler architectural services for $230,000, for a combined amount not-to-exceed $250,000, to perform planning and pre-design services for Downtown Eastvale.
On October 12, 2022, the City Council authorized the City Manager to execute the First Amendment to the Agreement with
Griffin Structures to reduce the Scope of Services, retaining Griffin as the Owner Representa.ve/Program Manager for the Civic Center project and elimina.ng sub-consultants, and reducing the total compensation amount to $1,845,353 and modifying the delivery method.
On November 30, 2022, the City Council held a workshop on the Civic Center Public Infrastructure Project and set the building sizes for the Civic Center Campus.

Subject: Letter of Agreement for Architectural & Interior Design Services For City of Eastvale
Civic Center Phase 1
Gensler Project Number 005.4369.000
Dear Jimmy:
We are very excited about the prospect of continuing our work with the City of Eastvale! We are pleased to submit this full-service architectural draft Letter of Agreement for your new Civic Center, Police Station, Library and associated site work.
This Agreement is between the City of Eastvale (“Client”) and M. Arthur Gensler, Jr. & Associates
(“Gensler”), located at 500 S. Figueroa Street, Los Angeles, CA 90017 for architectural services.
A. PROJECT
A.1 Project Description. This proposal builds on our recently completed pre-design phase for the new Civic Center masterplan, which comprises just over 17 acres of former orchard and dairy farms at the corner of Hamner and Limonite Avenues in the City of Eastvale, CA. Our phase 1 basic services include schematic design through permit/bid ready documents for 3 new buildings, a central Civic Plaza, and a City Park located in the northwest portion of the masterplan site (the “Project”). We have also provided options to include Building 7 or a temporary surface parking lot on this site. Furthermore, we have proposed allowances and allocations for construction administration, reimbursables and potential specialty consultants for the entire project. The masterplan’s (6) additional future retail-office- commercial-hotel buildings are not part of this proposal, however we have provided an add alternate for Phase II civil design, as needed for rough grading, SWPPP and to specify utility services for those future buildings.
A.2 Project Budget. Client will provide and Gensler will review Client’s overall project and construction budget goals for the Project (the “Project Budget”) prior to the commencement of services. The Project Budget will include appropriate amounts for design and construction contingencies, consistent with the nature of the Project. During design, Client (or Client’s designated representative, including, e.g., a pre- construction contractor or cost estimator) will provide Gensler estimates of the Construction Cost at appropriate stages of the design, including contingency amounts commensurate with the stage of design evolution and the nature of the Project. Client and Gensler will review such cost estimates and Client will adjust it to reflect changes in the program requirements, design, and level of design detail, or adjust the program, to the extent required for consistency with the Project Budget. Unless it would 184
City of Eastvale Civic Center Phase 1_Agreement for Architectural Services April 12, 2023
otherwise be an Optional/Additional Service (as defined in Section B.3 below). Gensler will incorporate any agreed upon changes in the subsequent design phase as part of its Basic Services (as defined in Section B.1 below).
This proposal is based on the preliminary project cost estimate provided by Griffin Structures on 2/22/23:
A.3 Project Schedule. The project schedule of important milestones (“Schedule”) is set forth below. The Project will proceed in accordance with the Schedule. The parties will monitor the Project for conformance with the Schedule. If Client directs Gensler to provide Additional Services requiring additional time or the Project is not proceeding in accordance with the Schedule due to factors beyond Gensler’s reasonable control, Gensler and Client will adjust the Schedule as appropriate, consistent with Section B.3, Optional/Additional Services. The Schedule will consist of the following presently projected milestones:
a) Commencement of Basic Services May 01, 2023
b) Schematic Design Completion (includes 1 month owner review) August 31, 2023 c) Design Development Completion (includes 1 month owner review) January 31, 2024 d) Construction Document Completion June 30, 20 24
e) Permitting; Bidding and Negotiation Support app rox. 5 months f) Commencement of Construction Administration Services December 1, 2024 g) Substantial Completion or Occupancy October 31, 2026 i) Completion of Construction Administration Services November 30, 2026
B. SCOPE OF SERVICES PROVIDED BY GENSLER
Client and Gensler will each provide the names of their key Project team members, including the primary contact person and the person authorized to make decisions. =Meetings and Site Visits may be conducted
by telephonic, videoconference, or other remote means.

The duration of Gensler’s Construction Administration services will not exceed the duration of time between the Commencement of Construction and thirty (30) days after Substantial Completion or Occupancy, as such duration is indicated in the Schedule. If Gensler’s Construction Administration services extend for a length of time beyond such duration, Gensler will receive compensation for these efforts as Additional Services. Gensler will provide Construction Administration services as set forth below and in AIA Document A201™–2017, General Conditions of the Contract for Construction, and mutually agreed upon Supplementary Conditions which Gensler will incorporate in the Project Manual, and all defined terms in this section shall have the same meaning as those in the General and Supplementary Conditions. If Client and Contractor modify the General and Supplementary 189

Conditions, those modifications will not affect Gensler’s services under this Agreement unless Client and Gensler agree mutually to amend this Agreement.
B.1.3.3.1 Pre-Construction Conference. Gensler will attend one (1) pre-construction conference with the Project team (Client, Contractor, Gensler, and each of their key subconsultants and subcontractors) to discuss the operational aspects of the Project, including the Construction Administration procedures.
B.1.3.3.2 Progress Meetings and Site Visits. Gensler will visit the Project site during construction to attend combined progress meetings and site walkthroughs (“Site Visit”) as often as is appropriate, in Gensler’s professional judgment, up to the extent specified in this section. The purpose of the site walkthroughs is to become generally familiar with the progress and quality of the Work and to determine whether the Work is in general conformance with the aesthetic design intent. Gensler’s T&M architectural fee allowance includes: (a) monthly Site Visits during active construction and (b) weekly additional progress meetings. If Gensler observes Work that does not conform to the Construction Documents, Gensler will recommend that Client reject it. Gensler will also recommend inspection or testing of the Work if Gensler believes it is appropriate.
B.1.3.3.3 Communications during Construction. Client and Contractor will communicate with each other, and with Gensler’s consultants, through Gensler. Gensler will maintain logs of documents received, reviewed, and/or issued by Gensler.
B.1.3.3.4 Requests for Information. Upon Client’s or Contractor’s request for information, Gensler will provide written or graphic interpretations and clarifications of the Construction Documents.
B.1.3.3.5 Bulletins. Gensler will use its Bulletin form to: a) authorize minor changes in the Work; b) issue supplemental instructions related to the Work; c) confirm Field Orders; and d) request proposals for changes in the Work.
B.1.3.3.6 Submittals. Gensler will review and take appropriate action on Samples, Product Data, Shop Drawings, and other submittals that the Construction Documents require Contractor to submit (“Submittals”), to determine whether those items and Contractor’s proposed methods of fabrication are generally consistent with the aesthetic design intent. Gensler will act on Submittals within the time specified in a submittal schedule to be provided by the Contractor and approved by Gensler, or otherwise within ten business days absent exigent circumstances. Gensler will conduct up to two reviews of Submittals as part of our CA T&M not to exceed architectural fee.
B.1.3.3.7 Changes. A reasonable number of changes in the Work are typically anticipated and the Project Budget will include adequate contingencies for such changes. Gensler may authorize minor changes in the Work if they are consistent with the aesthetic design intent and do not involve an adjustment in the Project Budget (including contingencies) or Schedule. Gensler will assist Client in reviewing properly documented Change Order proposals submitted by Contractor and in issuing Change Order Directives requested by Client. In any event, Client will notify Gensler promptly of any Client-approved changes in the Work that deviate from the Construction Documents prepared by Gensler.
190
City of Eastvale Civic Center Phase 1_Agreement for Architectural Services April 12, 2023
B.1.3.3.8 Contractor’s Payment Applications. Gensler will review Contractor’s monthly payment applications and make recommendations to Client regarding amounts due. Gensler’s approval of a payment application will represent to Client that, to the best of Gensler’s knowledge, information, and belief, the Work has progressed to the point indicated and is consistent with the aesthetic design intent.
If Gensler is requested to issue Certificates for Payment, such certification will be made to the best of Gensler’s knowledge, information and belief, based on the documentation provided with the Contractor’s payment applications and Gensler’s site observations, and will be subject to: (1) Gensler’s observation of the Work upon Substantial Completion, (2) results of subsequent tests and inspections, (3) correction of minor deviations from the Contract Documents prior to completion, and (4) any qualifications expressed by Gensler. The issuance of a Certificate for Payment will not be a representation that Gensler has: (1) made exhaustive or continuous on-site inspections to check the quality or quantity of the Work, (2) reviewed construction means, methods, techniques, sequences or procedures, (3) reviewed copies of requisitions received from Subcontractors and material suppliers and other data requested by Client to substantiate the Contractor’s right to payment, or (4) ascertained how or for what purpose the Contractor has used money previously paid on account of the Contract Sum.
B.1.3.3.9 Substantial Completion. Upon receipt of Contractor’s written representation that the Work is substantially complete, along with Contractor’s punch list of items to be completed or corrected, Gensler will conduct one field review to observe whether the Work is substantially complete. When Gensler determines that the Work is substantially complete, Gensler will issue the Certificate of Substantial Completion.
B.1.3.3.10 Final Completion and Project Close-Out. No later than thirty (30) days following Substantial Completion, upon Contractor’s and Client’s request, Gensler will conduct one field review to observe Contractor’s completed punch list items. When Gensler believes that the Work has been sufficiently completed per the Construction Documents, Gensler will approve Contractor’s final payment application. Multiple or separate field reviews may be requested as an Additional Service.
B.2 CAD Format and Standards. Gensler and its consultants will use Revit and Gensler’s CAD Standards.
At the completion of the Project, Gensler will deliver electronic as-designed record files, consisting of Gensler’s Construction Documents and Bulletins, in PDF. Gensler will translate CAD files provided by Client and/or Client’s consultants as an Additional Service. Preparation/review of as-built construction drawings, including incorporating Contractor’s as-built record drawings into Gensler’s as-designed record files, may be requested by Client as an Additional Service.
B.3 Optional/Additional Services. Gensler will provide services beyond the Basic Services described in Section B.1 (“Additional Services”) if requested by Client and confirmed in writing by Gensler.
Additional Services include, but are not limited to:
a. Services required due to accelerated deadlines, delays, untimely Client information, approvals, or instructions, out-of-sequence phasing, Project pauses or remobilization, or other schedule changes due to reasons beyond Gensler’s reasonable control; b. AGENDA STAFF REPORT
City Council Meeting
CITY COUNCIL BUSINESS
Agenda Item No. 13.3
May 10, 2023
Organizational Restructure
Prepared By:
Maricela Mejia, Human Resources and Risk Manager
Recommended Action(s)
Staff recommends that the City Council:
1 .
Approve and Adopt a Resolu!on Authorizing the Amendments to the City's Salary Schedule and Range Table; and
2 .
Approve and Adopt a Resolution Amending the 2022-23 Authorized Position List.
Summary
The City of Eastvale strives to assess its needs regularly to ensure alignment between strategic ini!a!ves and resources available to deliver on them. At this !me, an organiza!onal restructuring has been iden!fied to con!nue to stay in tune with community needs and to deliver on strategic plan ini!a!ves. Staff proposes transi!oning the Public Works/Engineering division into the Public Works/Engineering Department overseeing the Public Works Division and the Engineering Division.
The Community Development Department would oversee the Planning Division and Economic Development Division.
Background
The Community Development Department was created in December 2018 and was designed to oversee the Planning Division, Economic Development Division, Engineering/Public Works Division, Community Enhancement & Safety Division, and Building & Safety Divisions. At the !me, the team was small enough and was primarily operated by a contract staffing model that was manageable to operate in this fashion. As part of the Fiscal Year 2021-2022 budget, it was determined that to 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

212
provide adequate staffing and oversight of key projects, an organiza!onal restructuring was needed.
At that !me, the Community Enhancement & Safety Division and the Building & Safety Division were combined into the Community Safety Department and were removed from the Community Development Department. We again need organiza!onal restructuring to align our resources to con!nue mee!ng strategic objec!ves. Staff proposes transi!oning the Public Works/Engineering Divisions into their own department. The Community Development Department would now encompass the Economic Development Division and the Planning Division while the new Public Works/Engineering Department would encompass the Public Works Division and the Engineering Division.
With these organiza!onal changes, staff proposes defunding two (2) classifica!ons, reclassifying three (3) posi!ons to new classifica!ons, and transferring nine (9) exis!ng posi!ons to the proposed Public Works/Engineering Department. The objec!ve is to pursue a posi!ve impact in the community, support the professional success of all team members, and create a thriving organiza!onal culture, while maintaining fiscal responsibility. ACer an evalua!on of the immediate staffing needs, the results reflect opportuni!es for staffing changes that will allow the con!nuance of the Strategic Plan’s identified objectives.
