AB2561 Vacancy Report
Prepared By:
Maricela Mejia, Assistant Human Resources & Risk Management Director Recommended Action(s)
Staff recommends that the City Council receive and file the 2026 AB2561 Vacancy Report.
Summary
On September 22, 2024, Governor Newsom signed Assembly Bill (“AB”) 2561 into law to amend the Meyers-Milias Brown Act by adding Government Code Sec3on 3502.3, imposing new obliga3ons on public agencies related to tracking and presen3ng informa3on on job vacancies at least once per fiscal year prior to the adop3on of their respec3ve budgets to report on vacancy levels, recruitment and reten3on efforts, and allow for par3cipa3on by recognized bargaining units. The new law and the legal obligations took effect January 1, 2025.
Background
AB 2561 requires public agencies to:
Report annually on vacancies, recruitment activity, and retention strategies.
Identify any policies or practices that may hinder hiring or retention.
Provide recognized bargaining units with an opportunity to present during the public hearing; and
Upon request by a recognized bargaining unit with a vacancy rate of 20% or more, provide addi3onal data, including applicant volume, hiring 3melines, and efforts to improve compensation, benefits, and working conditions.
The City of Eastvale currently does not have bargaining units and is thus not required to meet the 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

requirements pertaining to bargaining units, but is s3ll required to report annually and to iden3fy items that may be hindering hiring or retention efforts.
The City is commiFed to maintaining high service standards for its residents and community members and recognizes the cri3cal role that qualified leadership and experienced professionals play in ensuring the effective delivery of municipal programs and services.
In response to ongoing organiza3onal needs and the compe33ve labor market, the City has priori3zed the swiH recruitment and onboarding of highly qualified staff. The ability to fill key vacancies in a 3mely manner is essen3al to sustaining opera3onal con3nuity, advancing strategic ini3a3ves, and mee3ng community expecta3ons. As such, the City has taken steps to enhance its recruitment and retention efforts and continues to adapt the process to the changing labor market.
As of May 11, 2026, the City has 77.75 full-3me equivalent budgeted posi3ons and a vacancy rate of approximately 6% citywide. This marks an improvement from last year’s vacancy rate of 9.86%, where we had seven vacant FTE’s out of the 71 full-3me equivalent budgeted posi3ons. Vacancies arise from a range of factors, including re3rements, internal/external promo3ons, resigna3ons, and separa3ons. The percentage discussed above translates to a total of 5 FTE vacancies throughout the organization.

Recruitment Efforts:
The City is con3nuously recrui3ng and onboarding new hires, including full-and part-3me personnel.
In Fiscal Year 2025/26, the City hired 12 new full-3me employees, 4 part-3me employees, and promoted 4 exis3ng employees who competed for the posi3on. Although AB 2561 requires local agencies to present annually on the status of vacancies and efforts to recruit and retain staff, the City has always priori3zed recruitment and reten3on efforts to minimize turnover. Table 2 below provides informa3on regarding the number of applicants, external recruitments, new hires, internal recruitments, and promotions for fiscal years 2022/23 through 2025/26 (through May 11, 2026).
The City casts a wide net in aFrac3ng qualified applicants. Since the adop3on of the recommenda3ons for the Classifica3on and Compensa3on Study, we have seen a tremendous increase in the quantity and quality of applicants for our roles.

*Total number of recruitments includes any acve recruitment within the Fiscal Year. Acve recruitments included recruitments that started in the previous Fiscal Year and were carried over into the following fiscal year.
The City recognizes that recruitment is about iden3fying, aFrac3ng, and hiring the right people for the organiza3on, and reten3on is about keeping employees engaged, sa3sfied, and commiFed to the organiza3on in the long term. Both efforts are cri3cal for the organiza3on’s success, especially in today’s compe33ve job market. AB 2561 acknowledges that recruitment and reten3on are currently challenges for public sector employers in California. In this regard, the City experiences similar challenges with respect to its recruitment efforts since it is compe3ng for a limited pool of qualified candidates. As discussed in further detail below, the City Council has taken proac3ve measures to support the City’s Human Resources Division by enhancing compensa3on levels, benefits, and supporting initiatives that promote a better work-life balance for employees.
Retention Efforts: 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

1717
Employee reten3on remains a central focus of the City’s workforce strategy. In 2024, the City implemented several ini3a3ves designed to improve employee sa3sfac3on, promote longevity, and enhance professional growth. The City implemented the following retention efforts:
Conducted a citywide classifica3on and compensa3on study and implemented a compensa3on philosophy of posi3oning the city 10% ahead of the market average for all positions
Adopted mul3-year cost-of-living adjustments of 3.5% over three years from FY 24-25 to FY 26-27
Enhanced the City’s benefits package to be more compe33ve and include comprehensive health benefits, retirement benefits, and work-life balance support.
Con3nued employee recogni3on efforts through the City’s Employee Recogni3on CommiFee, including Employee of the Quarter, Employee of the Year, Years of Service, and other professional recognition events.
Continued to offer training and development opportunities.
Received recogni3on by the Press Enterprise as a Top Workplace in the Inland Empire for 2025.
Achieved a 59% Engagement Rate according to Gallup’s Engagement survey.
As part of the City’s workforce planning and in alignment with AB 2561, the City con3nues to assess internal prac3ces and workforce condi3ons to iden3fy and address recruitment and reten3on efforts. This ongoing self-assessment helps the City to become an employer of choice, supports organizational resilience, and ensures effective delivery of public services.

Waste Management Fiscal Year 2026-2027 Annual Rate
Adjustment Request
Prepared By:
Simone Blackwell, Senior Environmental Compliance Analyst Recommended Action(s)
Staff recommends that the City Council adopt a Resolu
on approving the Rate Adjustment Request
by USA Waste of California Incorporated, also known as Waste Management (WM), per sec on 4.03
and section 4.04 of the Franchise Agreement.
Summary
Pursuant to Sec
on 4.03 of the franchise agreement with Waste Management (WM) , the waste hauler is eligible to request an annual rate adjustment based on changes to the Consumer Price Index (CPI) and other associated costs. The requested rate adjustment must be between 1-4%. WM is requesting a 4% increase in service rates.
In addi
on to the 4% annual rate increase, WM is reques
ng an extraordinary rate adjustment due
to increased labor costs. The proposed extraordinary adjustment includes a $0.33 increase for residen
al single family accounts. For commercial customers, the proposed extraordinary adjustment is a $0.25 increase per collected cubic yard and applies exclusively to mixed solid waste (MSW) service. This commercial adjustment does not apply to any other commercial services, including recycling or organics.
The rate adjustment would become effec
ve July 1, 2026. The proposed 4% rate adjustment in
addi
on to the extraordinary rate adjustment will result in a typical residen al account increasing
from $36.22 to $37.99 monthly. A commercial account with base bundled services (2-Yd Trash, 96- Gal Recycling, 64-Gal Organics serviced 1x per week) can expect an increase from $257.62 to 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |
eastvaleca.gov
1726
$270.09 monthly.
Background
In June and August 2011, the City entered into franchise agreements with WM and Burrtec Waste Industries to provide solid waste collec
on services. Prior to the agreement expira
on, the City
approved R3 Consul
ng Group to develop and facilitate a formal bid process for solid waste collec
on services. WM and Burrtec each provided formal proposals for review and Waste Management was ultimately awarded the contract October 28, 2020.
On October 28, 2020, The City of Eastvale entered into an exclusive franchise agreement with WM for solid waste collec
on services. The agreement commenced on July 1, 2022 and concludes on June 30, 2042. Per the agreement, WM services the en
re City boundary, including the por
on of
the City that was previously serviced by Burrtec.
WM services include city-wide commercial and residen
al collec
on of trash, recycling, and organic
waste. As of July 1, 2022, organic waste collec
on includes the collec
on of green waste, food
scraps, and food soiled paper which ensures compliance with Senate Bill 1383 requirements. City- wide street-sweeping services are also managed and provided by WM.
WM also provides addi
onal residen
al collec
on services for bulky items, used motor oil, used oil
filters, baBeries, and sharps. Addi
onal commercial services include construc
on and demoli
on
recycling, bulky item collec
on, and temporary bin service. In partnership with the City, WM also hosts two Residen
al Clean-up and Paper Shredding Events annually. The events include the collec
on of trash, green waste, recyclable materials, bulky items, household baBeries, and appliances.
Pursuant to Sec
on 4.03 of the franchise agreement with WM, the hauler may request an annual rate adjustment based on changes in the Consumer Price Index (CPI) and other associated costs. The agreement allows for an annual adjustment between 1% and 4%. Pursuant to Sec on 4.04 of the
franchise agreement, WM may pe
on the City in wri
ng for an extraordinary adjustment to service
rates. Such adjustments may be requested only once per agreement year and must coincide with rate adjustments effective July 1, 2026, or later.
For the 2026/2027 fiscal year, WM is proposing a 4% increase to the maximum service rates. This proposal is based on a 3.28% increase in the CPI and increases in disposal, recycling, and organics processing costs.
In addi
on to the 4% increase, WM is reques
ng an extraordinary rate increase due to increased
labor costs to provide waste collec
on services within the City pursuant to Sec
on 4.04 of the
franchise agreement. WM indicates that labor expenses have increased beyond the levels recovered through the standard annual adjustment process, and that the company has absorbed a por on of
these increased opera
ng costs over
me. The requested extraordinary adjustment is intended to align service rates more closely with current industry labor costs and ongoing opera onal demands
associated with providing waste collection services within the City.
For commercial customers, the proposed extraordinary adjustment is a $0.25 increase per collected cubic yard and applies exclusively to mixed solid waste (MSW) service. This commercial adjustment 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752

does not apply to any other commercial services, including recycling or organics. For residen al
single family accounts, the proposed extraordinary adjustment is a $0.33 increase to Standard Single Family Automated Cart Service, 64 Gallon Single Family Automated Cart Service, 32 Gallon Single Family Automated Cart Service, and the Senior Rate for 64 Gallon Trash service.
The rate adjustment would become effec
ve July 1, 2026. The proposed 4% rate adjustment in
addi
on to the extraordinary rate adjustment will result in a typical residen al account increasing
from $36.22 to $37.99 monthly. A commercial account with base bundled services (2-Yd Trash, 96- Gal Recycling, 64-Gal Organics serviced 1x per week) can expect an increase from $257.62 to $270.09 monthly. RE: Disposal Fee Increase - FY 2025/26
February 5, 2025
The Riverside County Department of Waste Resources (Department) is responsible for assuring that there is, and will be in the future, sufficient and accessible landfill space to properly serve the population of the County in its disposal needs. To fulfill this mandate, the Department continually maintains and expands County landfill sites, and encourages, supports, and develops recycling programs that minimize the dependence on landfill disposal facilities.
Due to sustained increases in labor expenses, capital improvement costs, regulatory compliance costs, and closed site maintenance, an increase in disposal rates is essential to allow for continued and improved services. This letter serves as a notice that subject to approval by the Riverside County Board of Supervisors, landfill disposal rates will increase in FY 25/26 by the Consumer Price Index (CPI), which is 2.88% for calendar year 2024. The FY 25/26 rate for the Moreno Valley Transfer Station will be $43.77 per ton. The new rate will become effective for tonnage deliveries starting on July 1, 2025.
Thank you for your past cooperation and support.

Background
In recent years, the City has experienced a significant increase in the use of electric bicycles (e- bikes), motorized scooters, and electric motorcycles (eMotos). This increase has resulted in growing community concerns related to proper operaon, enforcement challenges, and the need for clearer and more comprehensive regulations.
On April 28, 2026, the Public Safety Commission reviewed and provided comments on a proposed ordinance regulang e-bikes and eMotos within the City. The Commission expressed concerns regarding their use in parks, parcularly within the Riverwalk area, and emphasized the need for addional ordinance language addressing unsafe maneuvering and parental responsibility. The Commission also requested City staff explore the opon of entering into a memorandum of understanding (MOU) with the Jurupa Community Services District (JCSD) for enforcement related to e-bike and eMoto use. Conversaons with JCSD on that topic are ongoing, further JCSD has reviewed the City's proposed ordinance and confirmed it is consistent with the ordinance JCSD is considering. Addionally, several residents raised concerns similar to those expressed by the Commission.
To address these concerns, the ordinance has been revised to expand the definion of public property, ensuring it applies to any property owned or operated by a public agency within City boundaries. The ordinance also includes new provisions prohibing e-bike operators from passing pedestrians or vehicles in an unsafe manner. Addional language has been incorporated to clarify parental responsibility, specifying that a parent or guardian may not knowingly permit a minor child to violate the provisions of the ordinance. The scope of the ordinance was also expanded to include restrictions on motorized scooters.
Pursuant to Secon 312.5 of the California Vehicle Code, an electric bicycle is defined as a bicycle equipped with fully operable pedals and an electric motor that does not exceed 750 waGs of power.
Secon 407.5 defines a motorized scooter as
any two-wheeled device that has handlebars, has
either a floorboard that is designed to be stood upon when riding or a seat and footrests in place of the floorboard, and is powered by an electric or non-electric motor.
Secon 436.1 of the California
Vehicle Code defines an off-highway electric motorcycle, commonly referred to as an eMoto, as an off-highway motorcycle subject to idenficaon under the Code that meets all of the following criteria:
Is designed by the manufacturer for operation primarily off the highway.
Is powered by an electric motor for which a motor number is not required.
Has handlebars for steering control.
Has a straddle seat provided by the manufacturer.
Has two wheels.
Is not equipped with pedals from the manufacturer.
While the California Vehicle Code establishes statewide rules for the operaon of bicycles and e- bikes on public streets, highways, and designated bikeways, it also grants cies the authority to regulate their use on sidewalks, recreaonal trails, and other public areas, provided such regulaons do not conflict with state law.

To address safety concerns and reduce conflicts between riders, pedestrians, and other users of public spaces, the proposed ordinance establishes Chapter 12.20 of the Eastvale Municipal Code.
This chapter creates a clear regulatory framework tailored to local condions and intended to promote safe and responsible operation of e-bikes, motorized scooters and eMotos within the City.
Specifically, the ordinance includes the following regulations:
E-Bikes
E-bikes may not be ridden on a sidewalk when a bikeway is adjacent to that sidewalk.
E-bikes may not be operated on public property unless the area is specifically designated and posted as authorized for such use.
E-bike operators on sidewalks or public property must yield to pedestrians at all times.
E-bike operators shall not pass another pedestrian or vehicle in an unsafe manner, including failing to provide a reasonable and prudent lateral distance, passing at an unsafe speed, or passing in a way that endangers or interferes with the safe movement of the person or vehicle being overtaken.
When riding on a sidewalk, e-bike operators must travel in the same direcon as adjacent vehicular traffic.
Racing, speed contests, tricks, wheelies, stunts, or similar unsafe behaviors are prohibited on sidewalks or public property.
E-bike operators under the age of 18 must wear a properly fiGed and fastened helmet when riding on sidewalks or public property.
Motorized scooters
No person shall operate a motorized scooter on public property unless specifically designated and posted as authorized for such use.
Motorized scooter operators on public property must give way to pedestrians.
Motorized scooter operators on public property shall not pass another pedestrian or vehicle in an unsafe manner, including failing to provide a reasonable and prudent lateral distance, passing at an unsafe speed, or passing in a way that endangers or interferes with the safe movement of the person or vehicle being overtaken.
Motorized scooter operators on public property may not engage in racing or speed contests, and may not perform tricks, wheelies, or stunts.
eMotos
The operaon of any electric off-highway motorcycle on or through public property is prohibited.
Parental Responsibility
The parent of any child, and the guardian of any ward, shall not authorize or knowingly permit any minor child or ward to violate any of the provisions of this chapter.
These regulaons are intended to enhance public safety, reduce hazardous behavior, and provide clarity for both riders and the community regarding the appropriate use of e-bikes, motorized scooters and eMotos in Eastvale.

Proposed Five-Year Capital Improvement Plan (CIP) for Fiscal Years 2026/2027 through 2030/2031
Prepared By:
Jimmy Chung, Public Works Director/ City Engineer
Recommended Action(s)
Staff recommends that the City Council review and provide recommendations on the Proposed Five-
Year Capital Improvement Plan (CIP) for Fiscal Years 2026/2027 through 2030/2031.
Summary
Each year, as part of the City's budget process, the City Council reviews and adopts a Five-Year Capital Improvement Plan (CIP) in accordance with California Government Code Sec0on 65403. The City of Eastvale’s Five-Year CIP serves as a strategic blueprint for infrastructure planning and investment. It includes detailed project descrip0ons, cost es0mates, project status, priori0za0on, and categoriza0on—all with the goal of improving quality of life and addressing the City's long-term infrastructure needs. This comprehensive planning tool ensures transparency, fiscal responsibility, and efficient alloca0on of resources, thereby suppor0ng the successful delivery of capital projects throughout the five-year planning period.
The CIP addresses a broad range of project types, including cri0cal, essen0al, and desirable improvements across categories such as transporta0on, parks and recrea0on, public safety, maintenance, u0li0es, accessibility enhancements, and public facili0es. Each project is assessed and categorized based on its urgency and anticipated community benefit.
Pursuant to California Government Code Sec0on 65090, the adop0on of the Five-Year CIP requires public hearings by both the Planning Commission and City Council, providing opportuni0es for community input prior to formal adoption through resolution. 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

1756
At this mee0ng, the City Council will have the opportunity to review the proposed updates to the Five-Year CIP for Fiscal Years 2026/2027 through 2030/2031. Based on the Council’s feedback and direc0on, City staff will finalize the document and return at a future mee0ng for formal adop0on after Planning Commission review as required by Government Code Section 65403.
Background
The Capital Improvement Plan (CIP) is overseen by the Public Works Department and serves as a strategic framework for the planning, design, and construc0on of various infrastructure projects throughout the City. These include improvements in transporta0on, drainage, public facili0es, and parks. Public Works staff are responsible for managing all phases of CIP projects—from ini0al planning and design to final construction and project closeout.
For Fiscal Years
2026/2027 through 2030/2031
, staff has iden0fied a total of thirty-seven (37)
proposed capital improvement projects. These projects have been grouped into the following five categories:
1 .
Accessibility Improvements
2 .
Roadway Safety and Traffic Enhancements
3 .
Street Improvements
4 .
Citywide Maintenance
5 .
Land, Buildings, Facilities, and Equipment
Each project has also been assigned a priority level based on its urgency, funding availability, and alignment with community needs. The three priority levels are defined as follows:
Critical – Projects that are urgent and necessary for public safety or regulatory compliance Essential – Projects that significantly enhance operations or services Desirable – Projects that provide added value but are not immediately necessary
Staff respecEully recommends that the City Council review the proposed project list and priority designa0ons for the Five-Year CIP for Fiscal Years

Annual Project
Of the twenty-one (21) proposed Cri0cal projects in the Capital Improvement Plan, four are iden0fied as ongoing annual maintenance efforts essen0al for preserving and extending the life of the City’s infrastructure. These include recurring ini0a0ves such as annual pavement overlays and residen0al slurry seal programs. The remaining seventeen (17) projects are designated as Cri0cal due to their alignment with key priori0es outlined in the City’s Strategic Plan, adherence to grant funding timelines, or their urgency in addressing time-sensitive community and public safety needs.
Among these, the Civic Center con0nues to be one of the City’s highest priority capital projects. This comprehensive development aims to establish a centralized civic campus that includes the construc0on of a new City Hall (Project No. 95011), public library (Project No. 95012), police sta0on (Project No. 95014), and associated site improvements (Project No. 95023), suppor0ng the City’s long-term vision for enhanced public service delivery.
Below is a brief summary of the new projects added to the Critical list:
Civic Center Surface Parking Lot: this project will construct a new surface parking structure to support the anticipated increase in parking demand associated with the new Civic Center.
Parkway Landscape Infill and Enhancement Project: the project scope includes iden0fying parkway areas where landscaping has been removed and not replaced, and infilling those areas with in-kind materials to restore and enhance aesthetics.
Tree Management Plan and Installa0on Project: the project scope includes developing a tree management plan for the City and implemen0ng it by plan0ng new trees in the City’s right-of- way to fill gaps and enhance overall beautification

Despite the proposed project priority list, the City Council can revise the project priority list as needed. Based on City Council's direction, the adopted project priority list will be incorporated in the draN 5-Year CIP for the City Council's review at a subsequent City Council mee0ng and the proposed CIP budget will reflect as such.
Staff recommends the following projects to be modified or removed from the Five-Year CIP:
Modified:
92013 Cantu Galleano Ranch Interchange Gateway Feature
this project,
previously referred to as the Limonite Interchange Feature, involves the installa0on of a gateway monument at the Limonite Interchange within Caltrans right-of-way to welcome visitors and residents to the City. Because the project is located within Caltrans jurisdic0on, all coordina0on, review, and approval will be managed by Caltrans Landscape Architecture. Through ini0al coordina0on with Caltrans, staff learned that there are strict requirements governing the spacing and placement of mul0ple text elements to minimize driver distrac0on and ensure highway safety. Due to exis0ng leOering on the bridge overpass, the poten0al loca0ons for a new gateway monument at the original site were limited. As a result, staff proposes reloca0ng the gateway monument to the Cantu-Galleano Ranch Road Interchange. This alterna0ve loca0on presents a 12363 Limonite Avenue | Suite 910 | Eastvale, CA 91752 951.361.0900 |

Strategic Plan Action - Priority Level: 1
| Target #: E
| Goal #: A
The adop0on of the City's Five-Year CIP for the 2026-2027 budget cycle will support the development of a Civic Center and support financial planning efforts for newly proposed infrastructure projects.
Fiscal Impact
The ranking of top priority projects in Five-Year CIP does not result in a direct fiscal impact. However, the selected projects will determine the City's CIP budget for the upcoming 2026-2027 fiscal year.
The City's infrastructure projects are financed through various funding sources, including SB 1, Gas Tax, SB 132 Road Maintenance and Rehabilita0on Account, Measure A, Community Development Block Grant, federal grants, state grants, developer contribu0on, fire structural funds, County Flood Control funds, development impact fees, and General Fund. Budget for the 2026-27 fiscal year will be adopted in June with the Operating and Capital Improvement Budget.
