Agenda Item No. 10.2.

Meeting Date: October 14, 2026
Fiscal Year 2025-2026 State Mandated Fire Inspection
Reporting
Prepared By:

Johnny Terfehr, Community Safety & Technology Director
Recommended Action(s)
Staff recommends that the City Council adopt a resolution accepting the FY 2025-2026 State Mandated Fire Inspection Report of certain occupancies pursuant to Health & Safety Code Sections 13146.2 and 13146.3.

Summary
For the reporting period of July 1st through June 30th, of each fiscal year, the Fire Department identified and inspected Group E occupancies and Group R occupancies within the City of Eastvale. Annual inspections were completed for 100% of the identified buildings, structures, and facilities in FY 2025-2026. The Fire Department, in coordination with City staff, will continue to evaluate both existing buildings and new development to ensure that all applicable Group E and Group R occupancies receive annual inspections in accordance with SB 1205.

Background
In 2018, Senate Bill 1205 (SB 1205) added California Health and Safety Code Section 13146.4, which became effective on January 1, 2019. This section requires all fire departments that provide fire protection services to annually report to their administering authority on compliance with Health and Safety Code Sections 13146.2 and 13146.3. These provisions mandate yearly inspections of specific occupancies, including public and private schools used by

more than six persons for educational purposes through the 12th grade (Group E) and hotels, motels, lodging houses, apartment houses with three or more units, and certain residential care facilities (Group R), to verify compliance with building standards.

Senate Bill No. 1205
CHAPTER 854
An act to add Section 13146.4 to the Health and Safety Code, relating to fire protection.
[Approved by Governor September 27, 2018. Filed with
Secretary of State September 27, 2018.]
legislative counsel’s digest
SB 1205, Hill. Fire protection services: inspections: compliance reporting.

Existing law requires the chief of any city or county fire department or district providing fire protection services and his or her authorized representatives to inspect every building used as a public or private school within his or her jurisdiction, for the purpose of enforcing specified building standards, not less than once each year, as provided. Existing law requires every city or county fire department or district providing fire protection services that is required to enforce specified building standards to annually inspect certain structures, including hotels, motels, lodging houses, and apartment houses, for compliance with building standards, as provided.

This bill would require every city or county fire department, city and county fire department, or district required to perform the above-described inspections to report annually to its administering authority, as defined, on the department’s or district’s compliance with the above-described inspection requirements, as provided. The bill would require the administering authority to acknowledge receipt of the report in a resolution or a similar formal document. To the extent this bill would expand the responsibility of a local agency, the bill would create a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:

SECTION 1. Section 13146.4 is added to the Health and Safety Code, to read:
13146.4. (a) Every city or county fire department, city and county fire department, or district required to perform an annual inspection pursuant 93 STATE OF CALIFORNIA

to Sections 13146.2 and 13146.3 shall report annually to its administering authority on its compliance with Sections 13146.2 and 13146.3. (b) The report made pursuant to subdivision (a) shall occur when the administering authority discusses its annual budget, or at another time determined by the administering authority.
(c) The administering authority shall acknowledge receipt of the report made pursuant to subdivision (a) in a resolution or a similar formal document.
(d) For purposes of this section, “administering authority” means a city council, county board of supervisors, or district board, as the case may be.

SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.

Agenda Staff Report
City Council Meeting
Consent Calendar
Agenda Item No. 10.3.

Meeting Date: October 14, 2026
Support – H.R. 10257 (Diaz-Balart)
Prepared By:

Alexander Fung, Deputy City Manager
Recommended Action(s)
Staff recommends that the City Council adopt a Resolution to support H.R. 10257 (Diaz-Balart).

Summary
Throughout the past several years, staff partnered with federal and state legislators to introduce bills that support the City’s independent Zoning Improvement Plan (ZIP) code advocacy efforts. In the current congressional legislative cycle, multiple bills were introduced to address Eastvale’s outstanding challenges as a result of sharing ZIP codes with neighboring jurisdictions, including H.R. 672 (Diaz-Balart), H.R. 1225 (Calvert), S. 1455 (Scott), and S. 4505 (Ernst). The City Council previously adopted resolutions supporting these four bills.

Due to ongoing discussions and advocacy efforts in Washington, D.C., Congressman Mario DiazBalart (R-FL-26) partnered with 10 other Congressmembers, including Congressman Ken Calvert (R-CA-41) and Congresswoman Norma Torres (D-CA-35) to introduce H.R. 10257 on September 3, 2026. If passed, this bill would assign new and independent ZIP codes for 80 cities and communities across the nation, including Eastvale.

Staff recommends that the City Council adopt a resolution to support the newly-introduced H.R. 10257 (Diaz-Balart) to demonstrate support for the legislation in Washington, D.C.

Page 16 of 69 ends

Background
In 2023, the City formed the National ZIP Code Advocacy Coalition with the City of Castle Pines, Colorado to leverage resources and create partnerships to advance the City’s goal of obtaining a new and independent ZIP code for the Eastvale community. The Coalition, now co-chaired by Castle Pines and Eastvale, quickly grew to include more than 80 communities across the nation as other jurisdictions hear about the Coalition’s efforts.

A common challenge jurisdictions face in advancing ZIP code advocacy is the limited support from Congress, as many Senators and Representatives prioritize issues affecting their own constituencies and may not view ZIP code boundaries as a pressing concern. With the formation of the Coalition, impacted communities such as Eastvale can collaborate with peer cities nationwide, collectively amplifying their voices and leveraging broader legislative relationships to galvanize support among federal policymakers.

The current congressional legislative cycle, known as the 119th Congress, runs from January 3, 2025 to January 2, 2027. Due to the strong partnerships that were previously formed with federal legislators in the 118th Congress, Eastvale has already been included in multiple ZIP code bills in the first few months of the current congressional cycle.

Congressman Mario Diaz-Balart (R-FL-26) introduced H.R. 672 on January 23, 2025 to direct the USPS to establish new ZIP codes for 8 cities and communities across the nation, including Eastvale. Upon the bill’s passage, the USPS must designate new ZIP codes for these cities and communities within 270 days. This bill is co-sponsored by 13 Congressmembers, including Congressman Ken Calvert (R-CA-41) and Congresswoman Norma Torres (D-CA-35). H.R. 672 passed the House of Representatives on July 21, 2025 and has now been referred to the Senate Homeland Security and Governmental Affairs Committee. Additional information regarding H.R. 672 can be found on https://www.congress.gov/bill/119th-congress/house-bill/672.

H.R. 672’s Senate companion bill, S. 1455, was introduced by Senator Rick Scott (R-FL) on April 10, 2025. S. 1455’s bill language largely mirrors the language of H.R. 672, with the exception of the bill including 6 additional cities and communities. The bill is co-sponsored by Senator Alex Padilla (D-CA) and Senator Joni Ernst (R-IA). S. 1455 has been read twice and referred to the Senate Committee on Homeland Security and Governmental Affairs. Additional information regarding S. 1455 can be found on https://www.congress.gov/bill/119th-congress/senatebill/1455.

Additionally, Congressman Ken Calvert introduced H.R. 1225 on February 12, 2025 to direct the USPS to designate a single and unique ZIP code for Eastvale. Upon the bill’s passage, the USPS must designate a new and independent ZIP code for Eastvale within 180 days. The bill is cosponsored by Congresswoman Norma Torres and has been referred to the House Committee on Oversight and Government Reform. Additional information regarding H.R. 1225 can be found on https://www.congress.gov/bill/119th-congress/house-bill/1225.

Furthermore, Senator Joni Ernst (R-IA) introduced S. 4505 on May 12, 2026 to direct the USPS

Page 17 of 69 ends

to designate new ZIP codes for 83 cities and communities across the nation, including Eastvale.

This bill is co-sponsored by Senator Alex Padilla (D-CA) and 9 other Senators. S. 4505 was passed by the Senate Homeland Security and Governmental Affairs Committee on September 6, 2026 and has now been referred to the Senate floor for consideration. Additional information regarding S. 4505 can be found on https://www.congress.gov/bill/119th-congress/senatebill/4505/text.

While H.R. 672, H.R. 1225, S. 1455, and S. 4505 were introduced to address Eastvale’s ongoing challenges related to shared ZIP codes, there is a need to consolidate the bills into one consistent package for Congress’ consideration.

In the Senate, S. 4505 represents 83 cities and communities that have been striving for immediate relief from ZIP code-related challenges for years. The City is currently advocating for the passage of S. 4505 in the Senate floor.

In the House of Representatives, H.R. 672 currently only includes 8 cities and communities, whereas a separate House measure, H.R. 3095 (Boebert), encompasses 66 additional Coalition jurisdictions. The two bills were not originally combined due to prior disagreements among Congressmembers when similar proposals were introduced last year. As of last month, Congressmembers agreed that a unified approach would be more effective in the House. On September 3, 2026, H.R. 672 and H.R. 3095 were consolidated into a single bill, H.R. 10257 (Diaz-Balart), which now represents 80 Coalition member cities. Information regarding H.R. 10257 can be found at https://www.congress.gov/bill/119th-congress/house-bill/10257/text.

Separately, several Senators have expressed concerns about advancing ZIP code legislation without addressing the underlying issues within the United States Postal Service (USPS). There is a growing interest in examining the USPS ZIP Code Boundary Review Process, rather than solely pursuing legislation that assigns independent ZIP codes to impacted communities. In response to this concern, Senator James Lankford (R-OK) introduced S. 3175 last year, proposing the creation of a pilot program that would allow jurisdictions to voluntarily contribute toward ZIP code boundary adjustments when cost is a barrier for USPS approval.

Additional information regarding the bill can be found on https://www.congress.gov/bill/119thcongress/senate-bill/3175/text.

At the May 13, 2026 City Council meeting, Councilmembers directed staff to support efforts to potentially merge the City’s outstanding ZIP code legislation with S. 3175. This direction reflects the Senate’s increasing interest in reviewing and reforming the USPS process, as a combined approach may improve the likelihood of achieving near-term relief for the Eastvale community.

Should H.R. 10257 and/or S. 4505 ultimately be combined with S. 3175, staff will return to the City Council to request approval of an updated letter of support.

With the 119th Congress concluding on January 2, 2027, staff will continue to pursue all viable strategies to maximize the City’s chances of securing passage of meaningful ZIP code reform legislation.

Strategic Plan Action
Priority Level: 2 | Target #: B | Goal #: C
Efforts to secure an independent ZIP code directly support the City to develop branding and identity for Eastvale.

Fiscal Impact
There will be no direct fiscal impact as a result of this item.

Prior City Council/Commission Action
The City Council received preliminary presentations on the City’s independent ZIP code advocacy efforts on September 28, 2022, January 25, 2023, and May 17, 2023.

As part of a compromise offered by the USPS, the City Council voted to approve USPS’ proposal to survey all ZIP Code 92880’s addressees in an attempt to revise ZIP Code 92880’s official municipality name to “Eastvale” on June 28, 2023. With the City Council’s approval to proceed with USPS’ survey, the City Council voted to approve Professional Services Agreement with KHK Solutions and Mind & Mill to support USPS’ survey outreach efforts on October 25, 2023.

Following the USPS’ decision to axe the survey and grant ZIP Code 92880’s official municipality name change to “Eastvale,” staff provided a detailed update regarding the City’s independent ZIP code advocacy efforts on December 13, 2023.

A year later, staff provided another advocacy update presentation to the City Council on December 11, 2024.

On May 28, 2025, the City Council adopted a resolution supporting the City’s ZIP code bills in the 119th Congress, including H.R. 672 (Diaz-Balart), H.R. 1225 (Calvert), and S. 1455 (Scott).

After the 2025 Washington, D.C. Lobbying Trip, the City Council approved a letter to be sent to the U.S. Senate Homeland Security and Governmental Affairs Committee on December 10, 2025, urging support for the passage of H.R. 672 and S. 1455.

On May 13, 2026, the City Council provided feedback regarding supporting the consolidation of outstanding ZIP code bills with S. 3175 (Lankford). Shortly after, the City Council adopted a resolution supporting S. 4505 (Ernst) on June 10, 2026.

Additionally, the Planning Commission received presentations on the City’s ZIP code advocacy efforts on September 20, 2023, December 20, 2023, and January 21, 2026. The Public Safety Commission received similar updates on September 26, 2023, November 28, 2023, September

Agenda Item No. 10.4.

Meeting Date: October 14, 2026
Approval of the First Amendment to the Agreement with
Onyx Paving Company, Inc for the 2026 Annual Asphalt
Concrete Overlay Project
Prepared By:

Jimmy Chung, Public Works Director/City Engineer
Recommended Action(s)
Staff recommends that the City Council:

1. Approve the first amendment to the construction contract with Onyx Paving Company, Inc. for the 2026 Annual Asphalt Concrete Overlay Project in the amount of $524,724 for pavement repairs on Goodman Way and Fuji Street, increasing the total contract’s notto-exceed amount from $1,117,000 to $1,641,724; and

2. Approve and Adopt a Resolution amending the Fiscal Year 2026-27 Capital Improvement Plan and Budget for the Annual Overlay Project; and

3. Authorize the City Manager to execute the amendment, associated change orders, and other necessary documents, subject to approval as to form by the City Attorney.

Summary
The City Council awarded Onyx Paving Company, Inc. a $1,117,000 construction contract on August 12, 2026, for the 2026 Annual Asphalt Concrete Overlay Project. Since execution of the agreement, the City has requested two change orders totaling $524,724. The first change order request in the amount of $492,224 for Goodman Way covers approximately 61,528 square feet

Page 24 of 69 ends

of six-inch-deep pavement dig-outs and replacement. This work must be completed before Goodman Commerce Center performs the grind and overlay required under its post-acceptance agreement and before issuance of a final certificate of occupancy. The second change order request in the amount of $32,500 for Fuji Street addresses sinkholes that developed along a trench line.

Pursuant to the City’s purchasing ordinance, Council approval is required for these change orders as they exceed 10% of the original contract amount. Approval would increase the contract’s not-to-exceed amount to $1,641,724, and amend the FY 2026–27 Budget to appropriate $292,000 from CFD 2017-1 Fund 400 fund balance.

Background
The 2026 Annual Asphalt Concrete Overlay Project includes pavement dig-outs and overlay work on various streets throughout Eastvale. The City advertised Invitation for Bids No. 26- 113CIP and received eight responsive bids. Onyx submitted the lowest responsive and responsible bid, and the City Council approved its $1,117,000 contract on August 12, 2026. The executed agreement requires advance written City approval of material changes in scope or price through a valid change order. It also requires a written amendment executed by the parties for a contract modification. The type of work included in these two change orders was competitively bid through IFB No. 26-113CIP; these change orders are the result of adding new locations to the scope of work.

The two change order requests cover the following work:

Location Proposed work Amount
Goodman
Way
Approximately 61,528 square feet of six-inch pavement dig-outs and asphalt replacement, and traffic control.
$492,224
Fuji Street Repair of sinkholes along a trench line. $32,500 Total $524,724
Environmental
The original 2026 Annual Asphalt Concrete Overlay Project was determined to be categorically exempt under CEQA Guidelines Section 15301, which applies to existing facilities. The proposed amendment and budget resolution do not change that determination.

Page 25 of 69 ends

Fiscal Impact
The total fiscal impact for the requested contract increase is $524,724, resulting in a revised total contract not-to-exceed amount of $1,641,724. The first change order request in the amount of $492,224 for Goodman Way will be funded by an additional appropriation of $292,000 from Fund 400 (CFD-2017-1) fund balance and $200,224 from existing RMRA Fund 205 appropriations. The CFD houses available fund balance, but funds were not previously budgeted for this work.

The second change order request in the amount of $32,500 for Fuji Street will be funded through the existing 2026 Annual Asphalt Concrete Overlay Project budget.

A budget resolution is required to amend the fiscal year 2026-27 Capital Improvement Budget in the amount of $292,000 in the Community Facilities District (CFD) 2017-1 Fund Streets account 400-510-6660-93018-0000. CFD 2017-1 was formed in 2017 and is currently levied for maintenance services in a portion of the project area including Goodman Way. As of the publish date of this report the CFD 2017-1 Fund is projected to complete the fiscal year with a $343,711 fund balance; as such there is adequate fund balance to appropriate additional budget for this one-time expenditure. The requested budget amendment totals $292,000. No additional appropriation is requested for the RMRA portion or the Fuji Street repairs.

Meeting Date: October 14, 2026
Approval of First Amendment to the Professional Services Agreements with Smith-Emery Laboratories for the Eastvale Civic Center Project
Prepared By:

Yurhi Choi, Principal Engineer
Recommended Action(s)
Staff Recommends that the City Council:

1. Approve the First Amendment to the Professional Services Agreement with SmithEmery Laboratories for providing special inspection and material testing services for the Eastvale Civic Center Project, increasing the total contract amount by $50,950.45 and amending the total compensation not-to-exceed amount to $524,062.66; and

2. Authorize the City Manager to execute all necessary documents.

Summary
At its meeting on June 25, 2025, the City Council awarded a construction contract to Clark Construction for the Eastvale Civic Center project. Due to the complexity of the project an the variety of materials and systems involved, it was necessary to engage a selection of specialty consultants with expertise in multiple areas. Smith-Emery Laboratories (Smith-Emery) was contracted to provide special inspection and material testing services to ensure compliance with approved plans, specifications, and procedures, in accordance with the California Building Code (Title 24). The professional services agreement with Smith-Emery was approved during

Page 37 of 69 ends

the City Council meeting on August 13, 2025. The project has been progressing effectively with Smith-Emery's support. To complete the remaining scope of services, an additional budget has been requested from Smith-Emery.

Background
Smith-Emery Laboratories (Smith-Emery) was retained to provide special inspection and material testing services to ensure compliance with approved plans, specifications, and procedures in accordance with the California Building Code (Title 24). The original contract (A2025-099) included several optional add/alternate services, including Curtain Wall Testing/Performance Mock-up services and Steel Shop Source Inspection, which were ultimately not required. As a result, a portion of the budget was available to be reallocated toward routine special inspection services.

Following a reconciliation of charges incurred to date and a review of the contractor's updated schedule, it has been determined that additional funding is necessary to complete the remaining scope of services through project completion. Accordingly, staff recommends amending Smith-Emery's contract to increase the total not-to-exceed amount to $524,062.66, ensuring continued inspection and testing support through project completion.

Environmental
Approval of the agreement is categorically exempt from the California Environment Quality Act (CEQA) review under the CEQA Guidelines Section 15303.

Strategic Plan Action
