Agenda Item 2.

DATE: 11/19/2024
TO: Honorable Mayor and City Councilmembers
FROM: Mara Romano, Purchasing Agent
SUBJECT: Award of RFP No. 023-25 – Fleet Vehicles
RECOMMENDATION:

That the City Council adopts the next Resolution, in order, to:

Approve the modification of existing vehicle authorizations and related appropriations as detailed in the report;

1. Award a purchase order to PFVT Motors, LLC dba Peoria Ford (PF), in the amount of $2,612,193.61 contingent upon the requirements as set forth in the agenda report. If conditions are not met, direct staff to rescind the award to PF and award a purchase order to UAG Cerritos I, LLC (UAG) in the amount of $1,608,994.73; and

2. Authorize the City Manager to approve any modifications not to exceed $100,000.3.

BACKGROUND:

On September 10, 2024, the City Council authorized the acquisition of vehicles totaling $3.0 million. These vehicles are summarized in Table A: Vehicles FY 2024-2025 (American Rescue Plan Act Funding) in the attached Vehicle Authorization Exhibits. Additionally, several vehicles remain unpurchased that were authorized as part of the Fiscal Year 2023-2024 Annual Budget and the Fiscal Year 2024-2025 Annual Budget. These remaining vehicles are summarized in Table B: FY 2023-2024 / FY 2024-2025 Remaining Vehicles in the attachment.

As the acquisition of these vehicles progressed, staff determined that it would be advantageous to consolidate these procurements to maximize efficiency, pricing advantage, and timeliness.

Therefore, a series of funding source modifications (Table C: Proposed Vehicle Funding Modifications) are proposed. These changes include updating estimated amounts to match those included in the following award. No additional vehicles are included in these proposed adjustments. However, changes in the impact to individual funding sources is unavoidable and driven in a large part by updating authorization for known amounts.

On September 30, 2024, the City of El Cajon issued a Request for Proposals (RFP) for Fleet Vehicles which included Ford vehicles or an equal or better in quality and utility of the named product. Two proposals were received before 5:00 p.m. on October 30, 2024, and were independently reviewed by a three-person evaluation committee. The committee assessed the proposals per vehicle type (as listed below) utilizing the evaluation criteria specified in the RFP:
delivery information; delivery lead time; vehicle specifications; and cost. .!!!!_ Valley of opportunity

Offerors and quoters must be registered in System for Award Management (SAM) when an offer or quotation is submitted to comply with the annual representations and certification requirements. Federal Acquisition Regulations Section FAR 52.204-13 System for Award Management Maintenance, starts in part:

The City determined the proposal received from PF best met the City’s requirements in all categories (as outlined in the attached memorandum detailing the evaluation process).

However, as of the date this report was prepared, PF’s SAM registration is marked as “ID Assigned” and the recommended award is contingent upon provision 52.204-7 (included by reference in the specifications). The pricing below includes the specified vehicle, California Tire fees, Department of Motor Vehicle Registration fees, service manual, and extended warranty.

After thorough evaluation of the responses, staff recommends the City Council adopts resolutions to (1) Approve the modification of existing vehicles authorizations and related appropriations, (2) Authorize the Purchasing Agent to issue a purchase order to PF, in an amount of $2,612,193.61 contingent upon requirements cited above. If conditions are not met, the award would be rescinded by staff on behalf of the City, and is directed to issue a purchase order to UAG in the amount of $1,608,994.73, and (3) Authorize the City Manager to approve any modifications not to exceed $100,000 that may occur due to vehicle availability pricing revisions.

CALIFORNIA ENVIRONMENTAL QUALITY ACT:

This action is exempt from the California Environmental Quality Act (“CEQA”) in accordance with State CEQA Guidelines section 15378(b)(2). It will not result in any direct or indirect physical change in the environment because it solely provides authorization for the purchase of equipment.

FISCAL IMPACT:

The fiscal impact of the award is $2,612,193.61 (if awarded to PF) or $1,608,994.73 (if the award is rescinded due to PF's failure to meet the contingency within 30 days and the award is made to UAG). Funds are available in Fiscal Year 2024-25 Annual Budget: American Rescue Plan Act Funds (ARP23).

Proposed vehicle authorization changes will decrease appropriations in the Vehicle Replacement Fund (606/ $44,073) and the Wastewater Enterprise Fund (650/ $293,000) and increase the Gas Tax Fund (213/ $8,668).

TO: Honorable Mayor and City Councilmembers
FROM: Mara Romano, Purchasing Agent
SUBJECT: Contract Amendment for Bid No. 012-25 – Citywide Street Beautification RECOMMENDATION:

That the City Council adopts the next Resolution, in order, to:

Appropriate $600,000 of Transnet EL03 and $600,000 of additional ARPA (ARP10) funds for the purpose of increasing the Citywide Street Beautification project (243833PWCP); and

1. Amend the bid quantities and increase the compensation and working days for the Public Works Contract with Eagle Paving, LLC (Eagle) in the not-to-exceed amount of $1,244,784.43.

2. BACKGROUND:

On August 13, 2024, the City Council authorized the award of the Citywide Street Beautification project in the not-to-exceed amount of $2,319,000. On September 18, 2024, the City entered into a contract with Eagle; funded by Coronavirus State & Local Fiscal Recovery (American Rescue Plan Act) Grant Funds.

Proposed Construction Change Order No. 1 includes:

Adjustment of bid quantities;
Increase of compensation for the work under the Change Order in the amount of $1,244,784.43;
Add an additional 20 working days to the project; and
Authorize the City Manager to execute such change orders, not to exceed $100,000, in the aggregate, to increase the quantity of work, and extend the working days, under the bid.

As a result of the bid, the City will consider whether available savings can be used in an early Change Order No. 2 to increase the quantity of work at additional locations. This would allow for the use of available ARPA funds. The City Manager may approve a change up to $100,000, but any increase exceeding $100,000 in the aggregate requires City Council approval under City Council Policy B-4, and could be considered at the City Council meeting on December 10, 2024, or at a special meeting of the City Council prior to December 31, 2024. .!!!!_ Valley of Opportunity

SUBJECT: Award of Bid No. 018-25 – ADA Concrete Improvements 2025 RECOMMENDATION:

That the City Council adopts the next Resolutions, in order, to:

Approve the Plans and Specifications for ADA Concrete Improvements 2025, Bid No. 018-25;

1. Find the protest submitted by RAC Construction & Engineering, Inc. (RAC) to merit revision of prior award recommendation;

2. Find RAC’s omission of signature notarization on the bid bond a minor irregularity; and 3.

Award the bid to the lowest responsive, responsible bidder, RAC in the not-to-exceed amount of $719,260, with the option to renew for four additional one-year periods.

4. BACKGROUND:

The ADA Concrete Improvements 2025 includes pedestrian curb ramps, sidewalks, curbs, gutters, cross gutters, and other concrete improvements. The bid includes an opportunity for the City to renew the contract for up to four optional one-year terms.

The bid was advertised on September 6, 2024. The City received nine responses on October 8, 2024, and the top five lowest responses were evaluated. A bid summary is attached, and proposals are on file in the Purchasing Division.

The bid specifications required all bidders to submit a bid security in an amount not less than 10% of the bid amount, to be signed by both the bidder and the surety. The principal’s signature binds the contractor to their bid and is in accordance with California Code of Regulations 11 CCR § 50.10, as adopted by the State of California, Department of Insurance.

The apparent low bid was submitted by RAC and contained a bid bond without the principal’s signature. Upon notification of non-responsiveness, RAC submitted a written protest dated November 6, 2024.

After thorough review of the municipal code, ordinances, and case law, City staff reversed its non-responsive determination as the inadvertent omission of the principal's signature, while contrary to the bid instructions, does not likely create an unfair advantage. The City Council has the discretion to waive the principal’s signature requirement on the bid bond and approve the absence of the signature as immaterial for this bid.

CALIFORNIA ENVIRONMENTAL QUALITY ACT:

The proposed ADA concrete improvements project is exempt from the California Environmental Quality Act ("CEQA"). In accordance with State CEQA Guidelines section 15301(c)(3), minor alterations and safety improvements within existing public right-of-ways are exempt from the provisions of CEQA.

FISCAL IMPACT:

The fiscal impact for the initial one-year term is $719,260. Sufficient funds are available in the Fiscal Year 2024-25 ADA Concrete Improvements 2025 (253845PWCP) project. Subsequent four-year costs are estimated to total $3,671,894.23, based on a projected increase of 10% annually.

Agenda Report
Agenda Item 6.

DATE: 11/19/2024
TO: Honorable Mayor and City Councilmembers
FROM: Ryan Villegas, Senior Management Analyst
SUBJECT: Reallocation of Residual ARPA Funds
RECOMMENDATION:

That the City Council accepts the reallocation of residual funds from ARP21: Business Façade Grant to ARP17: Street Camera System for the purchase of additional Flock Cameras.

BACKGROUND:

ARP21: Business Façade Grant Program
Earlier this year, the City Council directed staff to create a Business Façade Grant program aimed at improving the exteriors of businesses within the City. With a budget of $1 million funded through the American Rescue Plan Act (ARPA), the grant program enabled 60 individual businesses to make enhancements to their exteriors. These include:
52 sign grants ($717,265);
20 paint grants ($212,057); and
3 window grants ($2,825).

In total, 75 façade grants were issued, totaling $932,147, with some businesses applying for and receiving grants in different categories.

ARP17: Street Camera System

The City Council approved an Automated License Plate Reader (ALPR) program in March 2023 using ARPA funds, from which the City contracted with Flock Safety as the provider of the cameras for the program. The fixed license plate reading cameras were installed in July 2023 and the system became operational on August 6, 2023.

During the first year of the program, the crime-fighting capability of the technology has proven extremely successful. In the first year alone, the El Cajon Police Department recovered 128 vehicles worth more than $1.2 million and made 151 arrests related to the stolen vehicles. Last month, the City of El Cajon was recognized by the San Diego County Taxpayers Association with the Golden Watchdog Award for this program as a public agency that demonstrates effective and efficient use of taxpayer dollars.

The El Cajon Police Department is currently in the process of purchasing additional ALPR cameras from Flock Safety to expand and bolster the program’s success. With the deadline to obligate/encumber ARPA funds quickly approaching on December 31, 2024, insufficient time remains to identify new projects or programs that would safeguard these funds from having to be returned to the Federal Government. Therefore, staff recommends reallocating the remaining $67,853 from ARP21 to ARP17 to ensure funds are captured, which will also reduce the amount of funding used from the City’s General Fund.

CALIFORNIA ENVIRONMENTAL QUALITY ACT:

This action to reallocate funds from one project to another is exempt from the California Environmental Quality Act ("CEQA") because it is not a “project” under section 15378(b)(5) of the State CEQA Guidelines. It is an organizational or administrative activity of government that will not result in a direct or indirect physical change in the environment.

FISCAL IMPACT:

This action will result in the re-allocation of $67,853 from ARP21 (Business Facade Grant Program) to ARP17 (Street Camera System).
