Agenda Report
Agenda Item 1.

DATE: 03/25/2025
TO: Honorable Mayor and City Councilmembers
FROM: Dave Richards, Director of Public Works - Operations SUBJECT: Declaration of Emergency for Sewer Main Repairs; Authorization to Waive Bidding
RECOMMENDATION:

That the City Council:

Adopts the next Resolution, in order, to establish a Declaration of Emergency and determine that the public interest and necessity require the immediate expenditure of public money to safeguard life, health, or property as required by the Public Contract Code section 22050; and

1. Approves $700,000 for repairs in Wastewater Operations to cover the cost of the emergency work.

2. BACKGROUND:

On March 17, 2025, at 10:00 a.m., Public Works staff received a report of a sinkhole in the side yard of 842 Brockton Street. City records show that a City-owned and maintained 24" corrugated metal pipe (CMP) travels through the property to move storm water from the street to a natural storm water channel behind the property. Public Works inspected the sinkhole measuring approximately 3’ x 4’ wide and 5’ deep. This sinkhole is approximately 5' from the slab of the home and adjacent to the City's storm water pipe. The sinkhole was filled to protect the property from immediate danger. Additionally, City staff attempted to video inspect the failed pipe but staff were unable to inspect the entire pipe segment due to pipe failures on both ends of the pipe. Given the multiple failures and unknown conditions between both points, up to 250' of pipe will need to be replaced.

Due to the excessive moisture in the surrounding soil, the failed pipe, and the potential for additional rainfall during the regular rainy season, it is prudent to move forward with a plan to remove and replace 250’ of pipe and prevent any expansion or creation of additional sinkholes.

The conditions require immediate repairs to protect adjacent public improvements, maintain critical street thoroughfares, and preserve life and safety.

With the risk that existing utilities, street, and sidewalk infrastructure could collapse, staff recommends that the City Council declare an emergency, per the attached resolution. Selection of the appropriate repair method and contractor is underway. The anticipated cost for removal and replacement of the storm water pipe is up to $700,000. The work will replace a section of the damaged pipeline, backfill voids, and restore surface improvements. .!!!!_ Valley of opportunity

RESOLUTION NO. ___-25

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CAJON

PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY FOR

SEWER MAIN REPAIRS, AND AUTHORIZATION TO WAIVE BIDDING
WHEREAS, on March 17, 2025, at 10:00 a.m., City of El Cajon ("City")Public Works staff received a report of a sinkhole in the side yard of 842 Brockton Street; and WHEREAS, records show that a City-owned and maintained 24" corrugated metal pipe (CMP) travels through the property to move storm water from the street to a natural storm water channel behind the property; and
WHEREAS, City Public Works staff inspected the area directly above an approximate 3’ x 4’ wide, 5’ deep sinkhole, which is approximately 5' from the slab of the home; and WHEREAS, the sinkhole was filled to protect the property from immediate danger; and WHEREAS, City Public Works staff attempted to video from both sides of the sinkhole, but were unable to inspect the entire pipe segment due to pipe failures on both ends of the pipe and because of the failure to obtain video and unknown conditions between the two points, it is likely that up to 250' of pipe will need to be replaced; and WHEREAS, due to the excessive moisture in the surrounding soil, the failed pipe, and the potential for additional rainfall during the regular rainy season, it is prudent to move forward with a plan for immediate action to repair or replace the 250’ pipe and prevent any expansion or creation of sinkholes, to protect adjacent public improvements, maintain critical street thoroughfares, and preserve life and safety; and
WHEREAS, with the risk that existing utilities, street, and sidewalk infrastructure could collapse, staff recommends that the City Council declare an emergency, per the attached resolution.

WHEREAS, selection of the appropriate repair method and contractor is underway; and WHEREAS, the work will replace a section of the damaged pipeline, backfill voids, and restore surface improvements, and the anticipated cost for removal and replacement of the storm water pipe is up to $700,000; and
WHEREAS, the time needed to publicly bid and contract out the work would unnecessarily delay repair efforts and place the City and private property at further risk, Public Works staff recommended that repairs should be performed immediately using the City’s emergency powers; and
WHEREAS, the City Manager is authorized to (1) enter into any emergency contract(s) to

WHEREAS, the City Council has been requested by the City Manager as the Director of Emergency Services of the City, to proclaim the existence of a local emergency therein and make such findings as set forth herein; and
WHEREAS, the proposed repairs are exempt from the California Environmental Quality Act ("CEQA") subject to CEQA Guidelines section 15269(b) (Emergency Projects) as emergency repairs to publicly-owned service facilities are necessary to maintain service essential to the public health, safety, or general welfare.

4. That wastewater operations funds in the amount of $700,000 in Organization Code 650720 (Wastewater Maintenance) are available and hereby designated for any necessary emergency repairs as determined by the City Manager to address the local emergency.
