Settlement of Workers’ Compensation Claims
City staff, in conjunction with the City’s third-party administrator, may choose to settle a Workers’ Compensation claim as a means to reduce overall liability and manage insurance premiums.
Claims can be settled in one of two ways:
1. Stipulation: A Stipulation Award settles the Permanent Disability portion of the claim. The claim may also include periods of Temporary Disability not previously compensated to the employee. The Stipulation leaves access to future medical care open to the employee.
2. Compromise and Release (“C&R”): A Compromise and Release settles Future Medical, Permanent Disability, and unpaid Temporary Disability balances. If the employee is Medicare eligible, then a Medicare Set -Aside (“MSA”) document is completed and that total is considered as part of the overall settlement. If the injured worker is receiving Social Security Insurance and the overall settlement is greater than $25,000, then the Center for Medicaid Services must approve the MSA.
Workers’ Compensation Claim Settlement Authority
1. The City’s third -party administrator shall have authority to settle claims in an amount up to $2,500.
2. The City Manager or designee is authorized to settle claims in an amount not less than $2,500 and not more than $50,000.
3. All claims which require payment of more than $50,000 shall be approved by the City Council.
4. All claims in excess of $125,000, or the City’s Self -Insured Retention (“SIR”), whichever amount is greater, shall first be approved by the City Council and must also be approved by the City’s insurance carrier.

Agenda Report
Agenda Item 7.
DATE: February 10, 2026
TO: Honorable Mayor and City Councilmembers
FROM: Yazmin Arellano, Director of Development Services SUBJECT: 405 E. Lexington Ave Tenant Improvements — Project Update RECOMMENDATION:
That the City Council:
Receives the 405 E. Lexington Avenue Tenant Improvements (263878PWCP) project update; and
1. Authorizes staff to continue the design phase of the 405 E. Lexington Avenue Tenant Improvements project.
2. BACKGROUND:
In January 2024, the City purchased the property at 405 E. Lexington Avenue—a 6,693 square foot, two-story office building. The City subsequently entered into a lease agreement with the Chaldean Community Council to operate social services operation and a business incubator at the site. During the pre-purchase property inspection, the City determined that several critical improvements were required, including the need for a new roof, HVAC replacement, correcting unpermitted work, and ensuring ADA accessibility.
On August 12, 2025, the City Council adopted the 405 E. Lexington Avenue Tenant Improvements capital project with a total budget of $588,420, using one-time Federal grant funding. The scope of work includes roof replacement, six new HVAC units, correction of unpermitted work, improvements to the small business incubator, general building repairs, and ADA accessibility improvements.
Staff issued a Request for Proposals (RFP) to the City's on-call building architects on August 26, 2025, and received four proposals on September 10, 2025. Davy Architecture was selected to analyze the building and prepare construction drawings, specifications, and cost estimates for the proposed work. The professional services agreement with Davy Architecture, for $74,953, was executed on September 25, 2025. Davy Architecture proceeded with a preliminary investigation of the building, developed schematic drawings, and prepared a cost estimate in December 2025.
The initial report from the City's architect estimates the necessary improvements to the building to be over $1 million in costs. Critical infrastructure, such as a new roof and replacement of the original rooftop HVAC units account for roughly $377,000 of the cost estimate. Items such as demolition of unpermitted work, removal of non-ADA-compliant improvements, plumbing and electrical work, renovations to restrooms to be ADA compliant, elevator repair, stair handrails, .!!!!_ Valley of opportunity

finishes such as flooring, ceilings, doors, and cabinetry, and parking lot improvements are estimated to be about $692,000.
The available construction budget is $488,420. Staff typically reserves a 15% construction contingency before soliciting competitive bids, which protects against higher-than-anticipated bids and unforeseen conditions encountered during construction. Based on the available construction budget and 15% contingency, the current budget only allows for the roof, HVAC units, and other minor improvements to be addressed.
Staff seeks City Council approval to continue with design work for the roof and HVAC improvements only, with some additional ADA improvements if bids are lower than currently expected. In order to complete construction and expend American Rescue Plan Act funds by the required deadline of December 31, 2026, the bidding process must begin by early spring of this year.
Once final construction bids are complete, staff will return to the City Council with an update and will provide options of whether to rely on General Fund reserves to complete the project, modify the scope of what needs to be repaired, or determine whether to dispose of the property.
CALIFORNIA ENVIRONMENTAL QUALITY ACT:
This project is exempt from the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guideline section 15301, Class 1 (Existing Facilities) as it is a minor alteration involving such things as interior partitions, plumbing, electrical conveyances and other repairs or maintenance.
FISCAL IMPACT:
No fiscal impact is anticipated. The project is budgeted in the City Capital Improvement Program Fund (501) with American Rescue Plan Act funding, 405 E. Lexington Avenue Tenant Improvements (263878PWCP).

SUBJECT: United States Semiquincentennial
RECOMMENDATION:
That the City Council provides direction on potential special activities to commemorate the 250th anniversary of the United States, and if so, authorizes a specified budget amount to support related events, partnerships, and programming.
BACKGROUND:
This summer, the United States will celebrate its semiquincentennial, commemorating the signing of the Declaration of Independence in 1776. This historic milestone presents an opportunity for communities across the nation to reflect on the country’s founding principles, recognize civic progress, and engage residents in a shared celebration of national history.
Many cities are considering ways to acknowledge the semiquincentennial through special events, educational programming, and community partnerships. While participation is not required, the anniversary provides a unique opportunity to enhance existing community events and foster civic pride.
If the City Council is interested in recognizing the semiquincentennial, staff recommends building upon existing, successful City events and partnerships rather than creating entirely new standalone programs. Potential approaches could include, but are not limited to:
Enhancing the City's annual Fourth of July fireworks celebration with semiquincentennial branding, patriotic themes, historical acknowledgments, or special programming.
Partnering with the local business community to encourage themed promotions, sponsorships, or coordinated events that support economic activity while celebrating the anniversary.
Initiate community and educational elements, such as historical displays, youth engagement activities, or recognition of local civic contributions tied to American ideals.
Collaborating with community organizations, service clubs, or cultural institutions to broaden participation and outreach.

These options could be scaled based on the City Council's interest and available resources.
CALIFORNIA ENVIRONMENTAL QUALITY ACT:
Direction from the City Council regarding potential special activities to commemorate the 250th anniversary of the United States is exempt from the California Environmental Quality Act (CEQA) pursuant to State Guidelines section 15378(b)(5) because it is an administrative activity of government. All future special activities directed by the City Council will be assessed in accordance with CEQA.
FISCAL IMPACT:
The current FY 2025-26 budget does not include a budget line item or funding for additional semiquincentennial activities.

SUBJECT: Permanent Local Housing Allocation Program City Council Subcommittee RECOMMENDATION:
That the City Council considers forming an ad hoc City Council subcommittee to review the 2026 Permanent Local Housing Allocation Program applications and appoints two members to that subcommittee.
BACKGROUND:
The City Council will consider the allocation of Community Development Block Grant (CDBG), HOME, HOME-ARP, and Permanent Local Housing Allocation (PLHA) funds in Spring 2026.
Staff has developed funding recommendations for all sources except PLHA funds.
Staff is currently soliciting applications for the use of PLHA funds for homeless services, which are anticipated to support housing navigation/outreach services and/or emergency shelter/navigation center activities. Given the expected diversity of applicants, staff believes there is value in establishing an ad hoc City Council subcommittee to assist in the review of the 2026 PLHA funding applications. The ad hoc subcommittee would work with staff to review applications and develop a funding recommendation for consideration by the full City Council before June 2026.
If the City Council wishes to establish this subcommittee, staff recommends that the City Council appoint two City Councilmembers to serve in this capacity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT:
This is an informational item being considered by the City Council. Therefore, it is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” under Section 15378(b)(5) of CEQA Guidelines. It is an organizational or administrative activity of government that will not result in a direct or indirect physical change in the environment.
FISCAL IMPACT:
