DISCUSSION:
If the City wishes to continue with virtual meetings, then the Council should consider and adopt this Resolution. It will apply to all Brown Act covered bodies within the City.
The previous teleconferencing provisions continue to apply but only for Council members on a trip or vacation do not change.
The bases for determining to continue virtual meeting participation are either the inability effectively to socially distance at public meetings (a health and safety issue) or a determination that a public meeting would present imminent danger to the participants. The inability to socially distance is set out in this Resolution.
In addition, AB 361 states requirements for virtual meetings (many of which were part of various Governor’s orders): requirements for clear noticing, allowing time for public comment during meetings, and observance of all statutory and constitutional rights of participants. The public may not be required to provide written comments in advance of the meeting. The legislation also provides that if the internet connection is lost, the meeting must stop until it is reacquired. Action taken without an internet connection is subject to challenge.
The ability to hold a virtual meeting lasts only as long as the Governor’s declaration of a statewide emergency. The Council may terminate virtual meetings at any time before that.

WHEREAS, the City is committed to preserving and encouraging public access and participation in City Council meetings; and
WHEREAS, all meetings of the City’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and

Goal #4: Recreation and Lifelong Learning

Not applicable.
BACKGROUND:
The City of El Centro Aquatics Center Staff was approached by the Calexico Unified School District in order to provide American Red Cross Lifeguard and Water Safety Instructor certification courses. In order for the public pool in Calexico to operate over the summer months, lifeguards as well as Water Safety Instructors are necessary for the successful operation of the facility.
DISCUSSION:
In March 2022, Aquatic Center Staff was asked to provide aquatic professional services in order to train Lifeguards and Water Safety Instructors. A Professional Services Agreement is required between the City of El Centro and the Calexico Unified School District in order for City of El Centro Staff to provide aquatics professional services.
Rebecca Corfman, Aquatics Supervisor and Adrian Villardaga, Aquatics Coordinator, are both certified Lifeguard Instructors through the American Red Cross, who will be conducting the courses needed by Calexico Unified School District. The instruction will occur at the swimming pool in Calexico and not at the El Centro Aquatic Center. This agreement holds Calexico Unified School District responsible for the payment of all certifications received. For the students receiving both certifications the cost will be $300, and for the students receiving one certification, the cost will be $200. The goal is to teach 40 students in both Lifeguard and Water Safety Instructor. 9 Packet Pg. 43
Action Item (ID # 5513) Meeting of May 3, 2022
Calexico Unified School District is requesting aquatic professional services to be conducted in order to offer aquatic recreational programming for the residents of Calexico. Locally, few persons have the adequate certifications necessary to train individuals in order to become lifeguards and water safety instructors. As part of the due diligence process, Human Resources staff has contacted the joint powers authority (JPIA) to ensure City Staff is covered while training outside of El Centro and JPIA has confirmed they are covered.
The Calexico Unified School District approved the Agreement on April 14, 2022 and the Agreement is scheduled for review and approval by the City of El Centro on May 3, 2022.
CONCLUSION:
Staff recommends the approval of the Independent Contractor Agreement between the Calexico Unified School District and the City of El Centro for professional services for the instruction of CPR, First Aid, and AED Training in accordance with the American Red Cross Lifeguard and Water Safety Instructor training.
