BACKGROUND:

The Community Services Department strives to provide extensive recreational programs and services to citizens within our community. In order to augment the number of sports fields, the City of El Centro has had a Joint Use Agreement for various park facilities owned by the El Centro Elementary School District. The Joint Use Agreement attached for Council's consideration includes the following sports fields:

Sunflower Baseball Diamonds, Sunflower Soccer, Frazier Fields #3 and #4, which are adjacent McKinley Elementary School. The fields are primarily used by leagues, inclusive of Rise Baseball, IVUSA Soccer, and Little League.

DISCUSSION:

The attached Joint Use Agreement was completed to identify and clarify the roles and responsibilities of each of the parties involved. Specifically, Section VII. identifies the responsibilities for maintenance and utilities (p. 2 of Agreement). Pursuant to City policy, the City does not collect fees for youth leagues that have a nonprofit designation.

As such, the City does not gain monetarily from the Joint Use Agreements. In fact, the Agreement stipulates maintenance of facilities inclusive of dugouts, bleachers, baseball 5 Packet Pg. 88

fencing, and infield. Parking lot maintenance, payments for electricity associated with field and parking lot lighting, as well as water usage are the responsibility of the City.

The City manages the sports fields owned by the El Centro Elementary School District, similar to other parks and facilities owned by the City. City Staff ensures that both the City and the School District are listed on the endorsed insurance certificate (COI) as additional insureds. A copy of that COI is also provided to the District via email to Administrative Services to demonstrate proper insurance coverage.

As it relates to routine grass and field maintenance, City Staff coordinates with School District Staff to ensure proper notification to League Presidents. City Staff has a great working relationship and rapport with School District Staff to ensure adequate levels of service to sports field users and league organizers.

CONCLUSION:

Staff recommends Adoption of Resolution No. 23- , A RESOLUTION OF THE CITY

Every three years the California Fire Code is updated. We review the code and make minor revisions that apply to our area. The codes are updated and referenced for planning and prevention within our city.

The City Attorney and ECFD staff have reviewed the codes. In addition to the published California Fire Codes, we reached out to neighboring counties and reviewed their adopted ordinances. Adopting current codes and revisions assures that site improvements and developments offer the safest accommodations for the citizens of our community.

BACKGROUND:

On September 19, 2022 City staff responded to a sink hole developed near the intersection of Imperial Avenue and Euclid Avenue. On September 9, 2022 the City of El Centro WWTP experienced significant additional water flow attributed to Hurricane Kay.

The additional water flow in the collection system and the fact that Imperial Avenue was flooded during the rain event just south of the sinkhole is indicative of increased water flow into the sewer collection system. It is my assessment that the increased flow in the sewer main at the sink hole location eroded the sewer main and subsequently eroded the surrounding soil, thus eventually creating the sinkhole at the location on September 19, 2022.

On September 27, 2022 Council approved an emergency declaration regarding Hurricane Kay through Resolution 22-103.

On October 4, 2022 City Council approved emergency repair work at the Imperial Avenue and Euclid Avenue sinkhole and authorized up to $750,000 Waste Water Enterprise Fund budget towards repairs through a change order to the existing city contract with A&R Construction for the Alder Sewer Repairs. The approval was through Resolution 22-106.

The proclamation was renewed by Council on November 15, 2022 through Resolution 22-125, January 17, 2023 through Resolution 23-02, and March 21, 2023 through Resolution 23-20.

On April 18, 2023 staff informed the emergency repairs at Imperial Avenue and Euclid Avenue intersection had been completed and that the roadway was now fully open. 12 Packet Pg. 117
Resolution (ID # 6013) Meeting of June 20, 2023
Council reviewed and confirmed the termination of the proclamation of local emergency in the City of El Centro through Resolution 23-30.

DISCUSSION:

City staff continues to work with CalOES for reimbursement of costs related to this storm.

On June 7, 2023 staff attended an applicant’s briefing for Tropical Storm Kay (CDAA 2023-06), for which the California Disaster Assistance Act (CDAA) was granted for the City of El Centro.

State cost shares 75 percent and local 25 percent of eligible costs. Eligible costs include emergency work such as debris removal and response and protective measures and permanent work such as roads and bridges, buildings and equipment amongst others.

Overtime work is also eligible for emergency work and regular and overtime is eligible for permanent work.

As part of the CDAA application packet, a Designation of Applicant's Agent Resolution for Non-State Agencies is required of all applicants to be eligible for funding. This is a universal resolution effective for all open and future disaster disasters/grants declared up to three (3) years following the approval date.

Staff will be submitting for reimbursement costs associated with the emergency, including the emergency repairs and overtime costs incurred for preparation, response, and prepositioning of resources in response to the tropical storm. Additionally, damage costs to ECRMC will be included as part of the application.

The cost estimate for the emergency repairs is $591,113.86.

Packet Pg. 120 Attachment: DESIGNATION OF APPLICANT'S AGENT RESOLUTION FOR NON-STATE AGENCIES FORM (6013 : CAL OES Resolution) Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.

When completing the Cal OES Form 130, Applicants should fill in the blanks on pages 1 and 2. The blanks are to be filled in as follows:

Resolution Section:

Governing Body: This is the group responsible for appointing and approving the Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity established under the laws of the State of California.

Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.

There are two ways of completing this section:

1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It does not require the Governing Body’s signature.

2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document, or their title changes.

Packet Pg. 121 Attachment: DESIGNATION OF APPLICANT'S AGENT RESOLUTION FOR NON-STATE AGENCIES FORM (6013 : CAL OES Resolution) Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.

Governing Body Representative: These are the names and titles of the approving Board Members.

Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.

Certification Section:

Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.

Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”

Discussion and any necessary action regarding the
cancellation or reduction of Council meetings during the summer months.

CITY MANAGER’S RECOMMENDATION:

Direction from City Council regarding the cancellation or reduction of Council meetings during the summer months.

BACKGROUND:

Council traditionally modifies its meeting schedule during summer months either by cancelling or reducing Council meetings if there are no time-sensitive matters requiring Council action. Advance notice of cancelled meetings allow Council Members and Staff to plan accordingly.

DISCUSSION:

Discussion on whether to cancel or reduce the City Council meeting dates for the months of August and September, 2023 for summer recess. A special meeting could be called should a pressing matter arise, and immediate action is needed.

CONCLUSION:

Council may choose to reschedule, cancel certain meetings, or cancel no meetings in August and September 2023.

AB 918 - Countywide Healthcare District
CITY MANAGER’S RECOMMENDATION:

Discussion and direction from City Council to update letter regarding City’s position on AB 918.

DISCUSSION:

Assembly member Eduardo Garcia has introduced AB 918 which forms a countywide healthcare district within the Imperial Valley. We have been fortunate to work with him and his staff regarding how that process would occur. The process is evolving as the bill enters the State Senate.

The City supports the need for and formation of a countywide health care district and will offer comments as to its structure.

An act to add Chapter 11 (commencing with Section 32499.5) to Division 23 of the Health and Safety Code, and to amend Section 7286.21 of the Revenue and Taxation Code, relating to health care districts.

LEGISLATIVE COUNSEL'S DIGEST
AB 918, as amended, Garcia. Health care district: County of Imperial.

Existing law, the Local Health Care District Law, authorizes the organization and incorporation of local health care districts and specifies the powers of those districts, including, among other things, the power to establish, maintain, and operate, or provide assistance in the operation of, one or more health facilities or health services, including, but not limited to, outpatient programs, services, and facilities; retirement programs, services, and facilities; chemical dependency programs, services, and facilities; or other health care programs, services, and facilities and activities at any location within or without the district for the benefit of the district and the people served by the district.

This bill would dissolve the Heffernan Memorial Healthcare District and the Pioneers Memorial Healthcare District within the County of Imperial. The bill would form a local health care district within the County of Imperial, designated as the Imperial County Healthcare District, that includes all of the County of Imperial. The bill would transfer the assets, rights, and responsibilities of the dissolved health care districts to the Imperial County Healthcare District.

The bill would require the initial board of directors of the district to be composed of specified members, including among others, board members appointed from and by the dissolved district boards and members from and appointed by the El Centro
Regional Medical Center Board of Directors. The bill would require the board of directors to conduct a financial feasibility study regarding the acquisition of El Centro Regional Medical Center and health care service integration within the district. The bill would require the board of directors to initiate conversations with El Centro Regional Medical Center to decide the terms of acquiring the hospital and require the board to finalize those conversations by November 1, 2026. The bill would require the initial board of directors to create a staggered board of directors, as specified.

The bill would require the board of directors to adopt a resolution to divide the Imperial County Healthcare District into voting districts for the purpose of electing members of the board of directors from and by the electors of those voting districts beginning with the next district election after January 1, 2024, as specified. By imposing new duties on the County of Imperial, the bill would impose a state-mandated local program.

This bill would rename the Pioneers Memorial Healthcare District as the Imperial Valley Healthcare District. The bill would authorize the expansion of the district to include all of the County of Imperial. The bill would require the district to submit a resolution of application to the Imperial County Local Agency Formation Commission to initiate proceedings to expand the district. The bill would require the commission to order the expansion of the district subject to a vote of the registered voters residing within the territory to be annexed at an election following the completion of those proceedings. The bill would require the Board of Supervisors of the County of Imperial, upon direction by the commission, to place approval of district expansion on the ballot at the next countywide election following the completion of commission proceedings, including a public hearing. The bill would provide for expansion of the district upon voter approval, if a funding source sufficient to support the operations of the expanded district is, if required, approved, as specified. The bill would require the district to pay for election costs, as specified.

The bill, following expansion, would dissolve the Heffernan Memorial Healthcare District and would transfer the assets, rights, and responsibilities of that district to the Imperial Valley Healthcare District. The bill would require the board of directors of the Imperial Valley Healthcare District, following expansion, to adopt a resolution to increase the number of members of the district’s board of directors from 5 to 7, and to appoint 2 members who are residents of the territory annexed by the district to fill the vacant positions, as specified. Following the expansion of the board of directors, the bill would require the board of directors to adopt a resolution to divide the Imperial Valley Healthcare District into voting districts for the purpose of electing members of the board of directors from and by the electors of those voting districts beginning with the next district election, as specified. By imposing new duties on the County of Imperial, the bill would impose a state-mandated local program.

This bill would state the intent of the Legislature that the Imperial County Valley Healthcare District maximize the use of its assets to provide direct health care services to individuals within the district, as specified.

This bill would make legislative findings and declarations as to the necessity of a special statute for the County of Imperial.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

BACKGROUND:

On May 5, during routine sewer main inspection, a void was discovered in a sewer inspection hole wall. On the other side of said hole an approximate 9' x 9' void was discovered under the intersection. On May 11, 2023, traffic control was set to protect the area from collapsing and producing additional damage.

City Code Section 2-185.14 provides that the City Manager is authorized to task direct emergency repairs and notify the Council of that action.

Local Emergency Proclamation was approved by City Council on May 16, 2023.

Per Cal. Gov't Code Section 22050, staff will return with an update on the emergency every Council meeting for review until the repairs are complete.

DISCUSSION:

Work has been completed. The inspection hole wall was eroded at its base thus consuming the underground soil surrounding the wall. The wall was repaired and the inspection hole sealed. Staff identified alternative strategies to mitigate the problem and the void was filled from the top via 2" diameter access holes in order to not open up the street and reduce impact to the traveling public. 18 cubic yards of material (about the size of a small SUV) was used to fill the void. Traffic was opened to full circulation May 25, 2023.

Staff will return on July 18, 2023 to Council with a resolution to end the proclamation. 16 Packet Pg. 139
