Presentation by Adriana Nava, Community Services Director, discussion and related action regarding Change Order #1 for Dog Park Project – located at the Southeast Corner of Adams Avenue and 7th Street with Duggins Construction. Mayor Cardenas-Singh asked if the restroom would get too hot since it was open from the top and Ms. Nava said that they are other restrooms that are not air conditioned. Mayor Pro-Tem Marroquin asked if the cost savings from the other projects would cover the short fall on the dog park and Ms. Nava confirmed it would cover the shortfall and a 10% contingency in case of incidentals. Mr. Oliva asked for the total savings of the Debbie Pittman

Lighting Project which was $200,000. Mr. Olivas also asked for the savings on the Swarthout Park Field Lighting Project which the savings was a significant amount. Council has several concerns regarding the restrooms and the cost to build this park. Council Member Oliva has a concern that we now have a change order and its costing the City more money to build this park. He would prefer option #1 which is the lowest option. Ms. Nava was asked if there was anticipation of any additional costs and no other costs are anticipated.

Moved by Marroquin, second by Garcia, approval of Change Order #B, which includes a Portland Loo Restroom, and approve a budget amendment in the amount of $200,000 from the Debbie Pittman Lighting Field Project and allocation of the project savings to the Dog Park Project. Additionally, reallocate $96,565 from the Swarthout Park Field Lighting Project to the Dog park Project.

Additionally, it is anticipated that approximately $14,000 will be available for Program Income generated by previous awarded grants. Therefore, approximately $577,406 is expected to be available for program year 2024/2025.

BACKGROUND:

The City of El Centro was designated as an entitlement community by the U.S.

Department of Housing and Urban Development (HUD) back in 2004. As part of the public participation process, a Five-Year Consolidated Plan (Con Plan) needs to be prepared and submitted to HUD as a prerequisite for funding under the entitlement program. Additionally, an Annual Action Plan must be prepared on a yearly basis to outline the activities that will be undertaken each fiscal year toward the goals established within the Con Plan.

DISCUSSION:

In preparation for the required Annual Action Plan for CDBG Program year 2024/2025, City staff will open the Request for Proposal (RFP) process on November 28, 2023, and end the RFP period on January 12, 2024. Staff will hold two public meetings, the first will occur at the El Centro Adult Center on November 28, 2023, and a second meeting is scheduled for December 6, 2023, at the City Council Chambers. 8 Packet Pg. 109
Action Item (ID # 6037) Meeting of November 21, 2023
Staff is requesting the direction and/or recommendation of Council as to what will be its funding priorities under the CDBG Program year 2024/2025, prior to opening the RFP process on November 28, 2023.

All proposals submitted must meet one of the three (3) National Objectives set by HUD.

Those objectives are:

1. Benefit at least 51% low and moderate-income persons;

2. Aid in the prevention or elimination of slum or blight; and

3. Meet other community development needs having a particular urgency.

In addition, HUD requires that all activities funded be eligible activities. These activities include but are not limited to housing activities, public facilities, public services, and economic development. In addition, activities need to take place within the city limits of the City of El Centro and services need to be provided to El Centro residents.

Staff would like to take this opportunity to summarize to Council HUD's requirements of certain activities:
1) Fair Housing Activity - The City is required to provide fair housing services to its residents as per HUD regulations. The contract amount for the 2024/2025 program year is $47,250.
2) Grant Administration - These funds will be used to pay salaries and benefits of Economic Development staff members who are involved with the CDBG program. Time-sheets are prepared on a bi-weekly basis to document the number of hours applied on CDBG activities and will be submitted to the Finance Department on a quarterly basis.

CONCLUSION:

Staff is requesting the direction and/or recommendation of City Council as to what will be its priority to fund under the CDBG Program Year 2024/2025.

Summary Sheet
Under the Entitlement Program, the City automatically receives an annual allocation of CDBG funds based on a formula which considers such things as overcrowded housing, population and poverty, age of housing and population growth lag, and poverty. The City is required to prepare a five-year Consolidated Plan which outlines the action steps the City will take to address its housing and community development needs. The Consolidated Plan should include a listing of activities that the City will undertake during the five-year period of 2024-2028 and also describe the specific planned uses of the CDBG funds. The City is also required to prepare a one-year action plan, which describes the specific planned uses of the CDBG fund current program year. The City will also have available approximately $14,000 Program Income generated by previous State awarded grants.

Program Objectives:

All activities proposed for CDBG funding must achieve at least one of the following national objectives:
• Benefit at least 51% low and moderate-income persons; • Aid in the prevention or elimination of slum or blight; • Meet other community development needs having a particular urgency To meet the primary objective, the CDBG regulations require that grantees expend not less than 70 percent of CDBG funds for activities which benefit low- and moderateincome persons.

Eligible Activities:

The program allows jurisdictions to select those activities that best meet the needs of their communities, in accordance with the national objectives and requirements of the CDBG Program. The following is a partial list of eligible activities:

Goal#3: Community Health, Safety & Welfare
DUE DILIGENCE CHECK FOR CONTRACTORS/CONSULTANTS: DID THE

BACKGROUND:

Assembly Bill 481 codified at Government Code sections 7070 through 7075 requires the Police Department to obtain approval from its governing body, via adoption by ordinance of a “military equipment” use policy by Ordinance prior to the police department funding, acquiring, or using military equipment. Such policy was reviewed and approved by the City Council last year. Pursuant to Govt. Code Section 7072, in order to continue to possess and use the military equipment, the ordinance approving the use and Policy must be reviewed annually to establish compliance with specified criteria.

Items deemed to be “military equipment” by AB 481 are used as a component of overall best practices for police departments throughout the country. These tools have been tested in the field, and are used by police departments to enhance citizen safety as well as officer safety. Loss of use of these items would jeopardize the welfare of citizens and peace officers.

The term “military equipment”, as used in AB 481, in fact, does not necessarily indicate the equipment that has been used by the military. Pursuant to AB 481, items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less-lethal 40mm projectile launchers, long-range acoustic devices, and light and sound diversionary devices.

ECPD is committed to using the up-to-date tools and equipment to safeguard the 9 Packet Pg. 113
Ordinance (ID # 6187) Meeting of November 21, 2023
citizens of the City. These items provide peace officers with the ability to safely resolve volatile situations which otherwise might rise to the level of a lethal force encounter.

The items listed in the Military Equipment Use Policy also provide peace officers with vital tools that facilitate compliance with its stringent use of force policy. The form of policy was developed by Lexipol to be used by departments throughout California.

Following a review of the items listed in AB 481 and comparing that to the inventory of equipment in use by ECPD, it was determined that ECPD uses some, but certainly not all, of the allowed military equipment and that use was approved.

DISCUSSION:

ECPD now has prepared the materials for the annual report to be reviewed by the City Council pursuant to AB 481. Those materials include a list of the current equipment and a summary of how the equipment meets the criteria set out in Govt. Code Section 7072 and in the ordinance. After review and approval by the Council, Ordinance No. 22-06 may be renewed for another year. The annual report must be posted on the Police Department website. In addition, within 30 days of that posting, the Police Department must hold an open and publicized community meeting to discuss military use equipment.

CONCLUSION:

Introduce Ordinance No. 23- , AN UNCODIFIED ORDINANCE OF THE CITY

COUNCIL OF THE CITY OF EL CENTRO APPROVING THE FIRST RENEWAL OF ORD. NO 22-06 REGARDING THE CONTINUING USE OF ANNUAL MILITARY
