BACKGROUND:
The Bureau of Justice Assistance has conditionally approved the city’s application for funding under the Edward Byrne Justice Assistance Grant (JAG) Program in the amount of $10,123. Fiscal year 2024 JAG funding will be utilized to purchase a staff scheduling software.
DISCUSSION:
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary source of federal criminal justice funding for local jurisdictions. JAG funds support law enforcement activities including law enforcement equipment and supplies, prevention and, education programs, or prosecution and court programs. On September, 4, 2024, the Bureau of Justice Assistance solicited 2024 JAG with an application deadline of December 6, 2024. JAG grants are non-competitive and the City was allocated $10,123. Staff obtained the Chief of Police's authorization to submit an application for 2024 JAG funds and now seeks the City Council's approval to accept funding to purchase a staff scheduling software.

DUE DILIGENCE CHECK FOR CONTRACTORS/CONSULTANTS: DID THE
DEPARTMENT VERIFY CURRENT EL CENTRO BUSINESS LICENSE,
CONTRACTOR'S LICENSE, REFERENCE CHECKES, INSURANCE, ETC.:
Nicklaus Engineering Inc. is currently under an On-Call Contract BACKGROUND:
On August 4th, 2020, City Council approved an agreement for on-call engineering services for Nicklaus Engineering, Inc. through Resolution No. 20-70.
Resolution requires that Task Orders over $200,000 be approved by City Council. Further, the agenda report requires that contracts for on-call services be limited to $250,000 per fiscal year per consultant for any combination of task orders approved that fiscal year.
On June 2021, City staff submitted a grant application to the Imperial County Air Pollution Control District for funding to pave selected alleyways within the City of El Centro under the Targeted Airshed Grant Program for reduction of PM 2.5 and PM 10 (dust).
City Council approved a funding agreement from the Imperial County Air Pollution Control District in the amount of $3,485,940 for the paving of alleyways project under the Target Air Shed Grant and authorized the City Manager to sign the funding agreement under Resolution No. 22-95 on the August 16, 2022, council meeting On April 04, 2023, the Imperial County Board of Supervisors approved and thus executed
the funding agreement.
City staff then reached out to Nicklaus Engineering Inc. for a proposal for design services under the existing On-Call Contract for General Civil Engineering Services.
DISCUSSION:
Nicklaus Engineering Inc. provided a proposal for design services to improve 30 alleyway segments within the City of El Centro including pavement and drainage improvements (segments and improvements are more specifically described in exhibit A). Staff has reviewed the proposal and recommends for approval.
The City has received a cost proposal from Nicklaus Engineering, Inc. for $344,161.33.
In reviewing the approved resolution, task orders over $200,000 are required to be approved by Council. Also, the agenda report required that contracts for on-call services be limited to $250,000 per fiscal year per consultant.
The spending limit of $250,000 per fiscal year is satisfied as the expenses will occur over a two-year period as follows:
Fee Breakdown per Fiscal Year:
Fiscal Year 2025: $200,000.00

BACKGROUND:
Construction management services provide third-party inspections and project management for major construction projects. They augment city staff during construction and are present on-site to monitor progress and budget. They also assist and coordinate with different vendors and agencies to deliver a successful project.
On June 26, 2023, the City approved an agreement with Balfour Beatty Construction, LLC for construction management services related to the construction of the new police station facility.
DISCUSSION:
The contract with Balfour Beatty was awarded based on a contract duration of 18 months and prior to the construction contract being awarded. During the construction contract procurement, the expected contract duration was increased to 24 months. The proposed contract amendment in this report expands the contract duration for Balfour Beatty to match the expected construction time and award funding to cover said increased time commitment.

Approval of Change Order 3 to Rove Engineering related to the Southern Pump Station Project
CITY MANAGER'S RECOMMENDATION:
Authorize budget as requested and authorize Change Order No. 3 to Rove Engineering as presented.
FISCAL IMPACT:
No Impact to the General Fund. The project is funded through ARPA funds, Wastewater Enterprise Funds and Wastewater Capacity Fees.
Previously Approved Funding Sources:
ARPA $5,205,544
Wastewater Capacity Fees $5,000,000
Wastewater Enterprise Funds $2,189,424
Total $12,394,968
Revised Estimated Cost Summary:
Construction Phase 1a (Base Bid) - $11,794,968
Construction Change Order No.3 $ 326,385 (proposed tonight) Construction Management and soft costs - $ 600,000
Revised Total $12,721,371
Proposed Revised Funding Sources:
ARPA $5,205,544
Wastewater Capacity Fees $5,000,000
Wastewater Enterprise Funds $2,515,809 (proposed tonight) Total $12,721,371
Funding source description:
1. ARPA. This fund was initially created to fund public health projects, assist General Government expenses due to COVID, and address water and sewer infrastructure needs. The infusion of ARPA funding to this project mitigates against potential future rates adjustment.
2. Wastewater Capacity Fees. These are funds collected from new development that adds capacity to Wastewater infrastructure. Over the years, this fund builds up, thus allowing one-time expenses such as this project to proceed.
3. Wastewater Enterprise Funds. Over the years, staff has built up our working capital to allow one-time expenses such as this to be funded.

DUE DILIGENCE CHECK FOR CONTRACTORS/CONSULTANTS: DID THE
DEPARTMENT VERIFY CURRENT EL CENTRO BUSINESS LICENSE,
CONTRACTOR'S LICENSE, REFERENCE CHECKES, INSURANCE, ETC.:
NA, City has performed various projects with this contractor successfully.
BACKGROUND:
Our wastewater master plan calls for constructing a regional sewer lift station near Farnsworth and Danenberg.
Projects of this nature are financed through wastewater customer fees and capacity fee revenues, which constitute the Wastewater Enterprise Fund. These funds are selfsufficient, requiring revenues to match expenditures, akin to a business model. Over the years, the City has increased its available working capital within the Wastewater Enterprise Fund, enabling the delivery of this and other ongoing projects without the need for additional bonding. Current operational expenses are maintained without impact.
The new regional station increases system reliability and expands capacity, thereby strengthening the city's appeal for both commercial and residential development and stimulating economic growth.
The project supports the development of property generally located southerly of Interstate 8, northerly of McCabe Road, easterly of 8th Street, and westerly of Dogwood Avenue, approximately 1,000 acres of land. This includes the ability to provide service to the recent Dogwood Annexation and proposed residential subdivisions such as Willowbend residential subdivision.
Additionally, the lift station will help address odor concerns in the southwest and northwest quadrants of the city. Furthermore, the regional pump station will eliminate the need for two existing local pump stations, thereby reducing maintenance requirements and enhancing system reliability.
An environmental review was completed in December 2014.
On November 14, 2019, the Council approved a design contract with Psomas to update and revise plans and phase the project. The phasing of work was pursued in an effort to reduce costs to manageable amounts while allowing for the completion of the work and enjoyment of its main benefits in a more expedient manner.
Staff has obtained the required ROW for this property and is working with the railroad to update the required permits.
On June 1, 2021, the City Council authorized the plans and specifications for the Southern Pump Station to be placed to bid.
On December 7, 2021, City Council authorized the rejection of bids after receiving a single
unfavorable bid.
On May 7, 2024, City Council authorized revised plans and specifications for the project.
The revised plans and specifications included dividing the initial Phase 1 of the Southern Pump Station project into Phase 1a and Phase 1b in an effort to allow the award of a construction project within the available budget. Both phases must be completed in order to operate a functional pump station.
On June 25, 2024 City staff opened bids.
On July 31, 2024 City Council awarded the contract to Rove Engineering in the amount of $11,794,968, without authorizing the standard additional 10% budget contingency for the project.
DISCUSSION:
During the July 31, 2024 Council meeting, staff outlined its plan to work with the design engineer and contractor to identify cost-saving measures that would accelerate the advancement of Phase 1b of the project. In addition, staff committed to reviewing the wastewater enterprise fund balance, cross-referencing it with upcoming system improvement projects, and assessing the availability of funding to fully support Phase 1b. It is important to note that the successful completion of Phase 1b is essential for the overall functionality of the project.
The change order being presented tonight is result of these value engineering efforts. By eliminating certain scope items from Phase 1a and utilizing the associated savings, we are able to reallocate funds to advance scope of Phase 1b to a logical termination point.
Specifically, this change order will allow the completion of the deep sewer trunk main between Beverly Lane and Farnsworth Drive along Danenberg Avenue—approximately 2,200 linear feet of sewer infrastructure.
While this change order does not fully fund Phase 1b, it is a necessary step forward, allowing the contractor to begin work on the new scope immediately, without any delays.
Meanwhile, the city will continue to explore funding options to cover the remaining Phase 1b work.
This approach represents a strategic and proactive step in moving the project forward, ensuring continued progress while maintaining fiscal responsibility and exploring all available funding opportunities for the full scope of Phase 1b.
CONCLUSION:
Authorize budget as requested and authorize Change Order No. 3 to Rove Engineering as presented.

FISCAL IMPACT:
The Permanent Local Housing Allocation (PLHA) Program was established pursuant to Senate Bill 2 and provides a permanent, ongoing source of funding to local governments for housing-related projects and programs that assist in addressing unmet needs.
The City of El Centro and Colonia area were allocated grant funding through the Permanent Local Housing Allocation. The total amount estimate to be available to the City of El Centro combining both Colonia and City-designated funds over the next five years from (2019 – 2023) is $2,773,039.

DUE DILIGENCE CHECK FOR CONTRACTORS/CONSULTANTS: DID THE
DEPARTMENT VERIFY CURRENT EL CENTRO BUSINESS LICENSE,

Due diligence checks were completed through the Request for Proposal process.
BACKGROUND:
On November 15, 2022, City Council approved a Five-Year Plan for the PLHA Program, which allocated 95% of both the City of El Centro and El Centro Colonia funding toward the goal of assisting persons who are experiencing or at risk of homelessness. The remaining 5% of each funding source was allocated toward Program Administration expenses. Subsequently, in February 2024, the City Council completed a Five Year Plan Amendment and added new activities, as recommended by Staff.
The purpose of this report is to provide a synopsis of activities completed to date and update the designated individual authorized to sign Permanent Local Housing Allocation (PLHA) Agreements and all related documents.
DISCUSSION:
Since the approval of the Five-Year Plan and submittal of grant applications for funding, the City has entered into agreements with the Department of Housing and Community
Development for each funding allocation. These grant agreements are further identified as follow: City Allocation 22-PLHA-17655 and Colonia Allocation 22-PLHA-17776.
Thus far, Staff has been collaborating with Catholic Charities on the Helping Hands Program, a pilot program that provides navigation center resources those experiencing homelessness. The Helping Hands Program is also a street outreach program with a workforce development component; wherein individuals experiencing homelessness will be given the opportunity to provide labor services for community cleanups in exchange for a weekly wage. By targeting employment opportunity and providing job training and other resources in a coordinated way, the City strives to reduce the number of chronically homeless individuals in the community. [Refer to the presentation attached, which further describes the program.]
Additionally, the Helping Hands Program ensures the provision of wrap around services through their Navigation Center. Services provided to program participants include assisting in obtaining State identification cards, obtaining/retrieving Social Security information and benefits, education on banking, including assistance opening a bank account, and tax assistance.

Request For Funds (RFF) were submitted to the Department of Housing and Community Development to advance Fiscal Year 2019-2020 PLHA funding for a combined amount of $462,173. These funds have been received and have facilitated the operation of the Helping Hands Program and Navigation
Center.
A second Request for Funds will be issued given that these funding allocations were from previous fiscal years. However, the Request for Funds cannot be issued until the City provides new resolutions updating the designated individual authorized to execute the agreements and related documents. The objective is to provide these resolutions in order to prevent loss of grant funds.
