2026 Win: Expedited SR-123 Project Funding
State Route 123 Paving Project on San Pablo Avenue
• In early 2026, the project was slated for reprogramming to Fiscal Year 2027-28, a significant delay that would have deferred construction until early 2028. • CPPG worked with the City to secure a joint letter from Senator Arreguín and Assemblymember Wicks urging the California Transportation Commission to expedite the project on public safety grounds, citing pedestrian fatalities along the corridor. Members of the City Council met in person with Caltrans staff in Sacramento in March to discuss the matter and underscore the project’s importance to the City. CPPG also testified on the City’s behalf at the Commission’s February meeting.
• On August 31, Caltrans announced a $13,113,000 allocation for the SR-123 paving project, which will rehabilitate pavement, add street trees, and make pedestrian safety improvements.

Construction is now anticipated to begin in early 2027.

AGENDA BILL
Agenda Item No. 6.E.

Date: October 20, 2026
To: El Cerrito City Council
From: Claire Coleman, Budget/Financial Services Manager, Finance Department
Subject: Authorization to Round Cash Transactions to the Nearest Five Cents

ACTION PROPOSED
Adopt a resolution making Government Code Section 6158 applicable to the City and allowing rounding of cash transactions to the nearest five cents.

BACKGROUND
In 2025, the federal government directed the U.S. Treasury to stop producing one-cent coins, citing a production cost of nearly four cents per penny. The last circulating penny was minted in November 2025. While existing pennies remain legal tender, with no new production, the supply available to the City through its bank will decline over time.

Congress has also moved to formalize the change through the Common Cents Act, which is pending before the President and would set a national framework for rounding cash transactions.

Until this year, California local agencies lacked clear statutory authority to round cash payments or refunds. Senate Bill 1005 (Caballero), signed by the Governor and effective as of September 18, 2026, resolves that gap. The bill added Government Code Section 6158, which allows a local agency to round any payment made wholly or partly in cash, and any refund or other amount tendered in cash by the agency, to the nearest five cents. The authority applies to a local agency only after its governing body adopts a resolution by majority vote.

ANALYSIS
The City accepts cash at public counters for fees, permits, fines, and other services.

Without rounding authority, staff would have to continue making exact change from a declining supply of pennies or risk accepting or returning incorrect amounts. This creates operational risk at the counter, including delayed transactions, cash drawer variances during reconciliation, and customer disputes.

Staff recommends that the City Council approve a resolution allowing the City to round cash payments, refunds, and change to the nearest five cents, while checks, cards, and other noncash payments continue to be processed for the exact amount due. The resolution authorizes the City Manager to implement the practice through an Administrative Policy to allow flexibility to respond to administrative needs and changing legislation. The City's Rounding Policy, Administrative Policy/Procedure III 6, is a separate document approved by the City Manager and is provided to show how staff intends to apply the authority. Under the policy, amounts ending in 1 or 2 cents are Agenda Packet Page 94 of 102
Agenda Item No. 6.E.
rounded down to zero, 3 or 4 cents up to 5, 6 or 7 cents down to 5, and 8 or 9 cents up to 10. Because rounding is symmetrical, staff expects the net fiscal effect to be negligible.

Implementation will primarily affect cashiering staff and Finance. Staff will need training on the rounding method, updated cashiering and reconciliation procedures, configuration of any payment systems that calculate totals, and public notice at cashhandling locations. These changes can be completed within existing resources.

Federal and state rules on cash rounding are still developing. Because the policy is administrative, the City Manager can update it as laws and guidance change without returning to Council for each technical adjustment.

STRATEGIC PLAN CONSIDERATIONS
This action supports the City’s Strategic Plan Goal(s) of:
• High Performing Organization

ENVIRONMENTAL CONSIDERATIONS
This section is not applicable to this agenda item.

FINANCIAL CONSIDERATIONS
No appropriation is requested. Rounding is expected to have a negligible net effect on revenue, and there is sufficient budget capacity for the minor costs of staff training and public notice.

LEGAL CONSIDERATIONS
This action is consistent with the requirements outlined in Government Code Section 6158.

RESOLUTION 2026-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CERRITO AUTHORIZING

ROUNDING OF CASH TRANSACTIONS TO THE NEAREST FIVE CENTS PURSUANT TO GOVERNMENT CODE SECTION 6158
WHEREAS, the United States Mint has ceased production of pennies, and local agencies face a diminishing supply of one-cent coins through their banking partners; and WHEREAS, the City accepts cash payments for fees, fines, permits, and other services, and issues cash refunds and change, and has lacked clear statutory authority to round those transactions; and

AGENDA BILL
Agenda Item No. 8.A.

Date: October 20, 2026
To: El Cerrito City Council
From: Shannon Bassi, Human Resources Manager, City Management Subject: Adopt a Resolution Approving a Side Letter Agreement between the City of El Cerrito and the Public Safety Management Association (PSMA) to Modify Language on Salaries, Benefits, Conditions of Employment

ACTION PROPOSED
Adopt a Resolution Approving a Side Letter Agreement between the City of El Cerrito and the Public Safety Management Association (PSMA) to Modify Language on Salaries, Benefits, and Conditions of Employment

BACKGROUND/ANALYSIS
The El Cerrito Public Safety Management Association (PSMA) is recognized as the bargaining unit representing full-time, sworn Public Safety Managers within the City's Police and Fire Departments and consists of three bargaining group units: the Police Chief Unit, the Fire Chief Unit, and the Battalion Chief/Police Management Unit. The Battalion Chief/Police Management Unit consists of the following classifications: Police Captain, Police Lieutenant, Fire Battalion Chief, and Fire Battalion Chief/Paramedic/Training. On December 3, 2024, the City Council approved a three year Memorandum of Understanding (MOU) with the PSMA - Battalion Chief/Police Management Unit through Resolution 2024-92, making the current agreement effective July 1, 2024 through June 30, 2027.

On August 18, 2026, the City Council approved an MOU with the PSMA - Fire Chief Unit through Resolution 2026-53 that included a 7.5% education incentive pay for the attainment of a Ph.D. or doctorate degree. This education incentive was negotiated with the intent that it qualifies as reportable special compensation to CalPERS.

As noted above, the Fire Chief Unit is a separately recognized unit/MOU within PSMA, similar to the Police Chief Unit/MOU. Both the Police Chief Unit and the Fire Chief Unit consist of a single incumbent and compensation, benefits, and terms of employment are negotiated separately. CalPERS applies its own requirements for the purpose of determining reportable special compensation, especially for those considered a group or class of one. Under CalPERS regulations governing reportable compensation, special compensation that is provided to an employee who CalPERS considers constitutes a group or class of one, such as the Fire Chief, must align with compensation available to the closest related group or class of employees. Accordingly, the Education Incentive pay negotiated in the Fire Chief Unit MOU must be evaluated in relation to the next closest related bargaining group or classification to comply with CalPERS reporting purposes.

Agenda Packet Page 97 of 102
Agenda Item No. 8.A.

For the Fire Chief, the closest related group or class is the PSMA - Battalion Chief/Police Management Unit. While the existing PSMA MOU provides Education Incentive pay, it does not currently include the Ph.D./Doctorate Education Incentive level that was negotiated with the Fire Chief. As such, the modification to the existing Education Incentive Program within the PSMA MOU as proposed is necessary in order to align the benefit across the entire PSMA bargaining group, and furthermore allow the Fire Chief's Education Incentive pay to qualify as reportable special compensation under CalPERS regulations.

City representatives met in good faith with PSMA - Battalion Chief/Police Management Unit representatives to successfully discuss and negotiate a side letter agreement modifying the existing Education Incentive Program in Article 6.1 of the PSMA MOU to comply with CalPERS regulations. The modification allows any PSMA employee who has successfully obtained a Ph.D. or doctorate degree from an accredited college or university the opportunity to receive an Education Incentive in the amount of 7.5% of base pay effective July 1, 2025. It should be noted that there are no employees who are eligible to receive this incentive in the PSMA - Battalion Chief/Police Management Unit at this time.

The following is a summary of the language change:

Effective July 1, 2025, all incumbents and classifications with PSMA, including the Police Chief, Police Captain, Police Lieutenant, Fire Chief, and Battalion Chief, who are eligible or who become eligible for the education incentive program shall receive one of the following:
• An employee who has an AA/AS degree from an accredited college or university shall receive a differential of three percent (3.0%) of base pay. • An employee who has completed 60 semester units from an accredited college or university and completes 6 semester units every 24 months shall receive a differential of three percent (3.0%) of base pay.
• An employee who has a BA/BS degree from an accredited college or university shall receive a differential of five percent (5.0%) of base salary. • An employee who has a MA/MS degree from an accredited college or university shall receive a differential of six percent (6.0%) of base salary. • An employee who has a PhD or doctorate degree from an accredited college or university shall receive a differential of seven and one-half percent (7.5%) of base pay.

Employees are eligible to receive only one of the listed educational incentives, as the incentives are not cumulative or compounding. The educational incentive is calculated as a percentage of base pay using the following formula: (Payrate × Hours Worked = Earnings) × % Educational Incentive = Educational Incentive Pay.

Agenda Packet Page 98 of 102
Agenda Item No. 8.A.

The above listed educational incentives are recognized as enhancing an employee’s ability to perform their job duties.

With this proposed change, the Education Incentive Program language will be in alignment with applicable CalPERS requirements for reportable compensation while implementing the education incentive previously negotiated with the Fire Chief.

The City would like to thank the Public Safety Management Association for their continued leadership and collaboration with the City.

STRATEGIC PLAN CONSIDERATIONS
This action supports the City’s Strategic Plan Goal(s) of:
• High Performing Organization by ensuring the City maintains a high-performing organization where employees feel a sense of inclusion and belonging.

ENVIRONMENTAL CONSIDERATIONS
This section is not applicable to this agenda item.

FINANCIAL CONSIDERATIONS
At this time, there are no incumbents within the PSMA- Battalion Chief/Police Management who qualify for Ph.D. or doctorate pay, therefore at this time there are no financial impacts associated with this proposed action.

LEGAL CONSIDERATIONS
This section is not applicable to this agenda item.
