includes five criteria that must be met for a project to qualify for the exemption. 1 Appellant
originally claimed that the Project did not comply with two of those criteria because it was not substantially surrounded by urban uses and may impact habitat for sensitive-status species. 2 Now, however, Appellant appears to claim otherwise. Per Appellant’s consultant Clark & Associates:

The Project site is within an urban area that is less than five acres in size and surrounded by other industrial and commercial businesses. The Project site does not contain any habitat for endangered, rare, or threatened species as the site is graded, does not have vegetation, and there has been a building on site since the early 1980’s [sic].

Maverik agrees. As explained in our November 10 letter, and in the Planning Department’s Staff Report to City Council (CC Staff Report), the Project is substantially surrounded by urban uses and has been considered as such for many years.3 Also, it has no value as habitat for endangered, rare or threatened species.
4 B. Hazards Analysis Is Appropriate
As explained in Maverik’s November 10 letter, CEQA Guidelines include six exceptions to exemptions that preclude an exemption from applying.5 The “Hazardous Waste
Sites” exception disallows a categorical exemption to be used “for a project located on a site which is included on any list compiled pursuant to Section 65962.5 of the Government Code.”6 This list is commonly referred to as the “Cortese List,” named after the Legislator who authored the bill enacting the applicable legislation, 7 and was established to provide
information about the location of hazardous materials release sites. The Cortese List is updated “at least annually” to include new sites or remove sites that have been cleaned up pursuant to applicable federal and state regulations.8
Appellant appears to misunderstand the Hazardous Waste Sites exception and the proper use of the Cortese List when analyzing impacts. Appellant’s consultant Clark & Associates states that nearby properties located at 10473 Stockton Blvd and 10466 Grand Line Road are identified by the State Water Resources Control Board (SWRCB) as containing leaking underground storage tanks. preclude the use of an exemption if a property located near a project site appears on the Cortese List, only when a project itself is located on a Cortese List site. This requirement comports to the question asked in Section IX of the CEQA Appendix G Checklist, when assessing potential project impacts associated with hazards and hazardous materials: “Would the project….[b]e located on a site which is included on a list of hazardous materials sites compiled pursuant to Government Code Section 65962.5 and, as a result, would it create a significant hazard to the public or the environment?”
The Project is not located on a site included on the Cortese List, as explained in the Staff Report9 and demonstrated in a May 31, 2024, Phase I Environmental Site Assessment prepared for the Project site by RMA Geoscience (Phase I ESA),10 which was recently submitted to the City for its consideration. A review of the current Cortese List confirms this finding.11 Accordingly, the Hazardous Waste Sites exception does not apply.

Moreover, the nearby properties identified by Clark & Associates are not included on the Cortese List. SWRCB classifies the status of these properties as either “case closed” or “no further action,” and they do not appear on the current Cortese List. 12 Appellant provides
no evidence that any contamination that occurred at 10473 Stockton Blvd and 10466 Grand Line Road in 1990 and 2003, respectively, and that was subsequently cleaned up such that the sites were removed from the Cortese List, would pose any risk during construction and operation of the Project. CEQA does not require analysis of these sites under the Class 32 exemption or the Hazardous Waste Sites exception or under any further analysis the City performed for the Project (e.g., for compliance with CEQA Guidelines section 15183 criteria).

C. Air Quality Analysis is Appropriate
Appellant’s consultant Clark & Associates claims that the City deficiently analyzed the Project’s cumulative air quality impact because it did not consider “past, present, or reasonably foreseeable probable future projects.” Appellant again misinterprets the requirements for exceptions to categorical exemptions. As explained in Maverik’s November 10 letter, the “Cumulative Impact” exception disallows a categorical exemption to be used “when the cumulative impact of successive projects of the same type in the same place, over time is significant.”13 The assessment here need only comport with the express language in the exception, as previously explained. required when preparing an environmental impact report (EIR), which was the CEQA document prepared for the project in Bakersfield Citizens for Local Control v. City of Bakersfield, (2004) 124 Cal. App. 4th 1184, upon which Appellant mistakenly relies in its recent criticism of the Project’s cumulative impacts analysis.

As explained in Maverik’s November 10 letter and the Staff Report, there are no “successive projects of the same type in the same place.” No fueling stations or comparable development have been contemplated for the CMD Court Special Planning Area (SPA) surrounding the Project site14 as they would be disallowed under an agreement executed between Maverik and the property owner.15 Despite no CEQA requirement for a broader cumulative air quality analysis, one was nevertheless prepared by Ascent Environmental Inc. (Ascent) and peer reviewed by consultant AECOM. 16 The Project was found to have no significant cumulative impact to air quality:

The Air Quality Assessment for the Maverik Elk Grove Gas Station Project was prepared consistent with the Sacramento Metropolitan Air Quality Management District’s (SMAQMD) CEQA Guide and associated numeric thresholds that addresses both project and cumulative quality impacts using the California Emissions Estimator Model version 2022.1 and the Gasoline Service Station Risk Assessment Look-up Tool (version 1.0). The analysis concludes that the Project air pollutant emissions would be below SMAQMD numeric thresholds and no significant air quality impact would occur. SMAQMD CEQA Guide identifies that If a project’s emissions are estimated to be less than the thresholds, the project would not be expected to result in a cumulatively considerable contribution to the significant cumulative impact (SMAQMD CEQA Guide page 8-1).17
Clark & Associates, on behalf of Appellant, further criticizes the air emissions modeling performed by Ascent and contends that the City needed to prepare some additional “health risk analysis” for the Project. Again, the air quality analysis, including a modeled health risk analysis using an industry standard tool for assessing gas station health risks and Sacramento Metropolitan Air Quality Management District CEQA guidance,18 was performed by a 14 Also as explained in Maverik’s November 10 letter, the Court CMD SPA is an area redesignated in 2008 from industrial uses to allow commercial uses, like Maverik. credible consultant and peer reviewed by another credible consultant. This constitutes substantial evidence.19 No more is required here.20
D. Traffic Analysis Is Appropriate
Kimley-Horn and AWA will respond separately to comments from Tom Brohard and Associates on behalf of Appellant regarding traffic analysis performed for the CMD Court SPA and explain why Appellant’s traffic concerns are misplaced. 21 As explained in the Staff
Report:
[The] Kimley-Horn [analysis] focused on operational considerations for Grant Line Road, East Stockton Boulevard, and conditions at the Project driveways, and utilized updated trip generation factors…. While level of service is no longer the metric for measuring the significance of transportation impacts pursuant to State CEQA Guidelines Section 15064.3, staff required this operational analysis to demonstrate consistency with General Plan performance thresholds.”22 After reviewing all traffic analysis prepared for the Project and the larger CMD Court SPA, City staff concluded that “the Project would address operational needs through conditioned improvements, consistent with the General Plan.”23
II. CONCLUSION
The City’s analysis, determinations, and findings on the application of the Class 32 exemption and Project consistency with zoning, the General Plan, and the General Plan EIR pursuant to CEQA Guidelines section 15183 is supported by substantial evidence. Appellant has not provided any material that diminishes or effectively challenges the City’s substantial evidence or that constitutes substantial evidence in its own right.24 19 CEQA defines substantial evidence as “facts, reasonable assumptions predicated upon facts, and expert opinion supported by facts.” (Pub. Resources Code, § 21082.2(c); CEQA Guidelines, § 15384(b).) If a lead agency relies on substantial evidence when making a determination about the applicability of a categorical exemption or CEQA Guidelines section 15183 criteria then nothing more is require even if “other conclusions might also be reached.” (CEQA Guidelines, § 15384(a); see also, e.g., Working Families of Monterey County v.

King City Planning Com. (2024) 106 Cal.App.5th 833, 845; Lucas v. City of Pomona (2023) 92 Cal.App.5th 508, 532; Muzzy Ranch Co. v. Solano County Airport Land Use Com. (2007) 41 Cal.4th 372, 388-389.) 20 Protect Tustin Ranch v. At the request of our client, Reynolds & Brown, we have prepared these responses to comments received from Tom Brohard and Associates in a letter dated November 7, 2025, and prepared on behalf of Protect Elk Grove, the appellant of the City of Elk Grove Planning Commission’s September 18, 2025, approval of the Maverik Fueling Station (PLNG-24-031).

Overview
The purpose of this memorandum is to respond to comments from Tom Brohard and Associates in a letter dated November 7, 2025, and prepared on behalf of Protect Elk Grove—appellant of the City of Elk Grove Planning Commission’s September 18, 2025, approval of the Maverik Fueling Station (PLNG-24- 031) located at the northwest corner the Grant Line Road intersection with East Stockton Boulevard. As background, in May 2025, Kimley-Horn prepared a Local Transportation Analysis1 for Reynolds & Brown, the owner of several parcels located at Grant Line Road and East Stockton Boulevard, including the 2.93- acre site on which the Maverik Fueling Station will be located. This collective property has been referred to as CMD Court since it was redesignated as a Special Planning Area and rezoned in 2008 for commercial development from industrial uses. In August 2025, Kimley-Horn prepared a Conditioning Summary2 for CMD Court.

These studies were prepared for Reynolds & Brown for informational purposes, and at the City’s request, to provide a comprehensive assessment demonstrating that applicable City Performance Targets could be met upon future full development of CMD Court, including Maverik. Although no other development is proposed or known at this time, so some reasonable assumptions had to be made about potential future development, Reynolds & Brown has been pursuing CMD Court tenancy for several years and wanted to ensure that the proposed use by Maverik would not preclude future development of the remainder of the property.

The following are specific responses to three (3) of the traffic-related comments offered by the appellant. 1 CMD Court Commercial – Local Transportation Analysis, Kimley-Horn, May 21, 2025. 2 CMD Court Commercial – Project Conditioning Summary, Kimley-Horn, August 15, 2025.

Maverik Trip Generation
Comment: Table 2 in the LTA provides a trip generation forecast for the future CMD Court Commercial Project described above. However, this forecast includes a significant error (circled in blue ink) showing only 1,503 daily trips to and from the Maverik Project. As disclosed in Table 1 in the August 15, 2025 Project Conditioning Report, the Maverik Project will actually generate 6,010 daily trips, four times higher than reported in the LTA.

Response: Trip generation for the Maverik Project was developed using Maverik-specific transaction data for comparable facilities. This transaction data and the associated trip generation characteristics of the Maverik Project were documented in a memorandum by AWA Engineering3 .The AWA Engineering memo
was submitted to City of Elk Grove (“City”) staff for their review and concurrence.

The AWA Engineering memo was subsequently referenced in the Local Transportation Analysis (LTA) produced by Kimley-Horn1 for the CMD Court development. Table 2 in the CMD Court LTA1 referenced page 1 of the AWA Engineering memo to establish 1,503 as the number of Daily trips for the Maverik Project. The Weekday AM and PM transactional rates (including a “factor of safety” multiplier of 1.25) from page 2 of the AWA Engineering memo were used to establish the Weekday AM and PM trips for the Maverik Project in Table 2 in the CMD Court LTA1
. The Weekday AM and PM operations for the study
intersections were subsequently considered both with and without the CMD Court development.

After review and consultation with City staff, a project conditioning memo was produced by Kimley-Horn2 for the CMD Court development. As the CMD Court development trip generation was being revised with various land use considerations, Kimley-Horn recognized that the 1,503 Daily trip number for the Maverik Project previously reported in Table 2 of the LTA1 included a 75% reduction for “pass-by” trips3. As this information within Table 2 of the LTA1
is intended to be upstream of any reductions accounting for internal capture and pass-by dynamics, Kimley-Horn recalculated the Daily trip number for the Maverik Project. As such, Table 1 of the Conditioning Summary2 (CS) establishes 6,010 as the number of Daily trips for the Maverik Project independent of the 75% “pass-by” reduction. As the Weekday AM and PM transactional rates do not include reductions for “pass-by” trips, the Weekday AM and PM trip generation for the Maverik Project did not change between Table 2 of the LTA and Table 1 of the PCS.

As the study intersection operations reported for the CMD Court development are based on an evaluation of the Weekday AM and PM peak-hours, the revision of Daily trips for the Maverik Project from 1,503 to 6,010 does not have any effect on the conclusions or findings presented in the LTA1 or CS2 .

Comment #1 – Truck Turn Templates
Comment: Public speakers with significant truck driving experience at the Public Hearing pointed out that large trucks would not be able to make some left and right turns within the site in a single, smooth movement. Large trucks would also have difficulty making left and right turns in to and out of the Maverik site without swinging wide and encroaching into other travel lanes. One of the speakers indicated that trucks frequently must go outside of their designated lanes to make these turns. If they cannot, then trucks would track up and over curbs and sidewalks, causing damage to street furniture and landscaping.

Trucks must be able to smoothly travel within and in and out the Maverik site. It appears that some of the required turns cannot be made by large trucks without backing up and causing considerable delay and congestion on East Stockton Boulevard and within the development site. As part of the design review at this point, large truck turning templates must be overlaid at each of the required truck turns to validate that turns can be smoothly negotiated, or how larger radii can be implemented on paper before they are 3 Maverik – Transactional Trip Generation Memo, AWA Engineering, February 14, 2025.

built and then must be rebuilt in the field. Such considerable delays have not been addressed in the traffic studies for the Maverik Project and so, it appears that such delay and congestion would be significant.

Whether or not the Project falls within the City's goals of VMT, such direct and indirect impacts are foreseeable and must be addressed.

Response: Truck turning templates have been prepared for each of the required truck turns to validate that they can be completed efficiently (see Attachment A to this memorandum). Kimley-Horn has reviewed these exhibits and confirmed that the underlying geometry and associated truck movements are consistent with the access and circulation assumptions inherent to the previously prepared Local Transportation Assessment (LTA)1
.

Comment #4 – Westbound Grant Line Road Merging/Weaving Lane Comment: The relocation and conversion of the westbound on-street bike lane to a westbound off-street trail may not provide sufficient length beyond the free-right turn lane for merging/weaving before the signalized on-ramp. If further evaluation discloses this issue and with review and approval from Caltrans for portions of the Grant Line Road under their jurisdiction, then additional traffic control such as "Yield" signs for the merging/weaving area will be required. If jointly approved by the City and Caltrans, the fourth westbound lane on Grant Line Road between East Stockton Boulevard and the SR99 Freeway On-Ramp would then be restriped and remarked as a merging/weaving lane.

Response: The commenter appears to suggest that the addition of the CMD Court project will result in four westbound lanes along the project’s Grant Line Road frontage. It is important to clarify, and as depicted in the Attachment A exhibits, the intersection improvements associated with the project make use of the existing #3 westbound lane and an additional (fourth) westbound lane is not contemplated at this time.

The condition to which the commenter refers exists today, without the addition of the CMD Court project. The current geometry and signal phasing allows right-turns on red from southbound East Stockton Boulevard, concurrently with westbound Grant Line Road traffic. These movements today have the same potential for merging/weaving associated with the downstream SR-99 freeway ramps. Because the existing #3 westbound receiving lane is not fed directly today by westbound traffic, and this #3 lane will be the recipient of the proposed free right-turn lane under conditions with the CMD Court project, the existing and proposed operational conditions are considered to be very similar. Both movements can currently, and would ultimately, operate concurrently. Both the SR-99 northbound and southbound ramps are entered from the right-side of westbound Grant Line Road downstream of the East Stockton Boulevard intersection. As such, because the majority of the trips associated with the CMD Court project are anticipated to come from or be destined for SR-99, the majority of project trips added to this merging/weaving area are reasonably anticipated to remain in the #3 receiving lane. Because these project trips do not need to leave the #3 receiving lane, the effect of their addition is not anticipated to result in a noticeable change to the merging/weaving condition that is noted as existing today.

As a testament to the efficiency and effectiveness of the existing conditions, review of readily available Statewide Integrated Traffic Records System (SWITRS) data for the most recent five-year period (January 2020 – December 2024) reveals that there have been a limited number of collisions at this intersection or in the vicinity of the noted merge/weave area. Because the conditions are similar (existing and proposed), it is reasonable to anticipate that the conditions resulting from the addition of the project will also have efficient operations.

Last week, a moving truck flipped across from the Maverick gas station on Highway 69 in Prescott.

Many of us saw the photos and videos shared online — but what most people didn’t know is that this truck was carrying the entire household of a veteran who proudly served our country for 28 years.

His wife, Alejandra, just learned that everything they owned — their memories, photos, military awards, and personal belongings — was stolen after the crash.

The truck was left unattended, and within hours, the contents of their life were gone.

They’ve lost furniture, clothing, and household goods… but what breaks their hearts most are the irreplaceable items:

Military medals and certificates

SACRAMENTO — There is a clash going on between big rigs and residences in a Sacramento neighborhood that city hall said is creating an unsafe environment.

The Robla neighborhood in north Sacramento has trucking companies right next door to family homes with little kids. It's not a good mix, and the City of Sacramento is trying to find a fix.

Amelia Sanchez lets her two boys play all day inside the gates of their front yard, but they can't go out.
"I don't let my kids play outside," she said. "It's dangerous for them to be out here." Truck traffic is nonstop in the Robla neighborhood, where the city allowed family homes to be built in an industrial zone for decades.

A truck driver was arrested for multiple charges after crashing into another semi truck in a Love’s parking lot on Tuesday evening.

The incident occurred at about 9 p.m. on February 11th at the Love’s Travel Stop on 22 Road in Grand Junction, Colorado.

According to ABC 8, 62-year-old Joseph Kelly slammed into another semi truck so hard that it overturned in the Love’s parking lot.

Both truck drivers were taken to a nearby hospital for evaluation. Information on their injuries has not been released.

Kelly was arrested on DUI and careless driving charges and is being held in the Mesa County Detention facility.

A 21-year-old semitruck driver accused of being under the inuence of drugs and causing a ery crash that killed three people on a southern California freeway is in the country illegally, U.S. Homeland Security ofcials said Thursday.

Jashanpreet Singh was arrested and jailed after Tuesday’s eight-vehicle crash in Ontario, California, that also left four people injured.

He faces three counts of vehicular manslaughter while intoxicated and driving under the inuence causing injury, the San Bernardino District Attorney’s ofce said.

Singh is scheduled for arraignment Friday. The district attorney’s ofce said he does not yet have a lawyer.

Singh, of Yuba City, California, is from India and entered the U.S. illegally in 2022 across the southern border, Homeland Security said Thursday in a post on X.

California’s Highway Patrol said in a release that trafc westbound on Interstate 10, about 26 miles (42 kilometers) west of San Bernardino, had slowed about 1 p.m. Tuesday when a tractor-trailer failed to stop, struck other vehicles and caused a chain-reaction crash.

Dashcam video from the tractor-trailer obtained by KABC-TV shows the truck slamming into what appears to be a small, white SUV in the freeway’s center lane. It continued forward, plowing into several other vehicles, including another truck. It then crossed over two lanes before crashing into an already-disabled truck on the freeway’s right shoulder.

Flames can be seen erupting alongside the tractor-trailer as it crosses the two right lanes.

California Highway Patrol Ofcer Rodrigo Jimenez says the agency has seen the KABC video and believes it is dashcam video from the truck that caused the crash.
“This tragedy follows a disturbing pattern of criminal illegal aliens driving commercial vehicles on American roads, directly threatening public safety,” Homeland Security said Thursday in its X post.

Deadly crash in Florida
In August, a truck driver made an illegal turn on Florida’s Turnpike, about 50 miles (80 kilometers) north of West Palm Beach, and was struck by a minivan. Two passengers in the minivan died at the scene, and the driver died at a hospital.

Homeland Security said Harjinder Singh obtained a commercial driver’s license in California, which is one of 19 states, as well as the District of Columbia, that issue licenses regardless of immigration status, according to the National Immigration Law Center.

The Trump administration has pointed to the Florida crash while sparring with California’s Democratic Gov.

Gavin Newsom.

In April, Trump issued an executive order saying truckers who don’t read and speak the English language proficiently would be considered unfit for service.
“A driver who can’t understand English will not drive a commercial vehicle in this country. Period,” Duffy said the following month.

Under the new Transportation Department rules imposed last month, only noncitizen drivers who have three specic visas are allowed to qualify for commercial licenses. And states will be required to verify their immigration status. Only drivers who hold either an H-2a, H-2B or E-2 visa will qualify. H-2B is for temporary nonagricultural workers, while H-2a is for agricultural workers. E-2 is for people who make substantial investments in a U.S. business
The licenses will only be valid for up to one year unless the applicant’s visa expires sooner than that.

On Thursday, Duffy called the California crash “outrageous” in a social media post. “This is exactly why I set new restrictions that prohibit ILLEGAL IMMIGRANTS from operating trucks,” he wrote on X. “@CAgovernor must join every other state in the U.S. in enforcing these new actions to prevent any more accidents and deaths.”

PAYETTE -- Idaho State Police continue to investigate an officer-involved shooting outside a Payette convenience store Thursday afternoon.

Ontario Police say the driver did not point the gun at anyone or at anything. They also say that students at May Roberts School were not in danger, and the school did not go into a lockdown.

However, traffic from the school was diverted for some time to allow investigators search of evidence.

A witness contacted police giving them the description of the vehicle and license plate information, which was then given to local law enforcement, in addition to those in the surrounding area.

Mark Clark, Payette Chief of Police, says the Payette County Sheriff's deputy was responding to the attempt-to-locate call, and that the deputy called for backup when he spotted the vehicle at the Maverik store gas pump.

The police chief says as the deputy asked the driver to get out of the vehicle, the suspect started shooting. The deputy and 24-year-old Fruitland man exchanged gunfire. [The deputy] started giving the driver commands to get out of the vehicle. He was not complying with the deputy, Clark said. Within a few minutes of giving the commands, the suspect came out of the car, started shooting at the deputy multiple times. The deputy returned fire, and the deputy was struck in the leg with a non-life threatening bullet wound, and the suspect was also shot in the exchange of gun fire.

Witnesses reported hearing multiple shots fired over 10 to 15 seconds.

We actually heard shots fired, several rounds, and we looked out the window. It sounded like firecrackers. We looked out there and there was an officer with his weapon drawn and a gentleman on the ground, Amber Swann, who works across the street, said.

I heard five or six gunshots, what I counted. Hard to tell, five or six. Seemed like four of them were in a row. The other one or two were earlier, but all within a few seconds of each other, Rich Hanna, who lives about a block away, said.

Witnesses said they saw a child, likely a little boy between the ages of 4- and 8-years-old, carried by an officer from the scene. Police said they could not confirm anything about the child. Baker says the critically wounded man was flown by air ambulance to Saint Alphonsus Regional Medical Center in Boise. The deputy was struck in the leg, and does not appear to have a lifethreatening injury.

Clark says there are bullet holes in the Maverik storefront, and a couple witnesses say they were nearly hit, though no one else was injured.

The store was absolutely full of people. It's usually one of the busiest places in town. I understand that during the gun fight, there were a couple people that had a couple near misses, and we do have bullet holes in the store windows and in the front door, Clark said.

SPOKANE, Wash– Spokane Police are investigating an overnight shooting that killed one person and injured another.

According to SPD, this happened around 3:15 a.m. at the Maverik at the intersection of Division and Montgomery.

SPD says multiple people called to report the shooting to 911. Officers arrived and found two people had been shot. One died at the scene and the other was taken to the hospital in critical but stable condition.

SPD Major Crimes detectives are investigating.

North Spokane shooting suspect in custody, investigation continues On April 28th, Quentin M.D. Hutchison (18) turned himself in to MCU Detectives in regard to the shooting at the Maverick gas station on the 25th that left one man dead and another critically injured. Hutchison was taken into custody and booked into the Spokane County Jail for 2nd Degree Murder and 1st Degree Assault. The investigation into the shooting continues and SPD asks anyone with information to please call Crime Check at 509 456-2233.

Officers quickly arrived to find two victims in the parking lot. Officers began life saving measures, but one of the victims succumbed to their injuries and was pronounced deceased at the scene. A second victim was transported to a local hospital and at the time of this release is listed in critical but stable condition.

MERIDIAN – Idaho State Police detectives are investigating an officer-involved shooting that occurred Thursday afternoon at Maverik store in Payette.

At about 2:15 p.m. this afternoon a Payette County Sheriff's deputy located a car at a gas pump at the Maverik store on North 16th Street in Payette that was suspected as being involved in an incident where shots were fired in Ontario, Oregon. The deputy approached the suspect driving the vehicle in an attempt to talk with him. The suspect then drew a gun on the deputy and began firing at the deputy. The deputy sustained a gunshot wound to the leg. The deputy was able to return fire and struck the suspect.

Both the deputy and the suspect were transported by air ambulance to a Boise hospital. The injuries to the deputy are not life threatening while the suspect has critical injuries.

The names of the deputy and the suspect are not being released at this time. The Idaho State Police will continue to lead in the investigation. ————

Jashanpreet Singh was arrested and jailed after Tuesday’s eight-vehicle crash in Ontario, California, that also left four people injured.

He faces three counts of vehicular manslaughter while intoxicated and driving under the inuence causing injury, the San Bernardino District Attorney’s of
ce said.

Singh is scheduled for arraignment Friday. The district attorney’s ofce said he does not yet have a lawyer.

Singh, of Yuba City, California, is from India and entered the U.S. illegally in 2022 across the southern border, Homeland Security said Thursday in a post on X.

SOUTH SALT LAKE — Police on Tuesday
arrested a man who they say shot another
man in the face at a convenience store in
South Salt Lake earlier this month.

Christopher Lee Barros, 33, was arrested for
investigation of attempted aggravated
murder, aggravated robbery, mayhem,
felony discharge of a firearm, possession of
a weapon by a restricted person,
obstruction of justice and possession of drug paraphernalia and burglary tools.

On Dec. 4, just after 6:30 a.m., a shooting was reported at Maverik, 3260 S. West Temple.

A spokeswoman for South Salt Lake police said a man in his late 20s got out of a silver and blue Dodge Durango, stumbling across the gas station parking lot after being shot.

He was then taken to the hospital in critical condition.

South Salt Lake police said the man is recovering from his injuries.

Ontario Police say the driver did not point the gun at anyone or at anything. They also say that students at May Roberts School were not in danger, and the school did not go into a lockdown.

However, traffic from the school was diverted for some time to allow investigators search of evidence.

A witness contacted police giving them the description of the vehicle and license plate information, which was then given to local law enforcement, in addition to those in the surrounding area.

Witnesses reported hearing multiple shots fired over 10 to 15 seconds.

We understand that happened over there near a school zone, and possibly it had something to do with him picking up his child. To that extent, we don't know any other details at this point, Clark said.

Clark says there are bullet holes in the Maverik storefront, and a couple witnesses say they were nearly hit, though no one else was injured.

Principal Kipp McKenzie of the nearby Payette Primary School says they did go on lockdown around 2:20 p.m. for about 15 minutes due to the incident at the Maverik. The two men argued before the shooting, according to police. (Salt Lake City Police Department) A man was shot to death outside this Maverik convenience store at 310 S. 900 East.

A man was killed in Salt Lake City early Friday and police are looking for the suspected shooter.

Salt Lake City police said they received a report of the shooting outside a Maverik convenience store at 310 S. 900 East just after 1 a.m. When officers arrived, they found a man who had suffered at least one gunshot wound. The man died at the scene despite witness and officer efforts to save him, police said.

No information about the man killed had been released as of Sunday evening.

“We can’t apologize enough. We did not communicate well, we were not proactive in reaching out.

And, it affected the community,” said Maverik President Chuck Maggelet at a Tuesday meeting at the Lander Community Center.

Leaders from the community were invited to the presentation regarding the discovery of a fuel leak from the Maverik fueling station at 135 E. Main Street.

On April 2nd, Lander firefighters were dispatched to a section of the Popo Agie River between 1st Street and Caring Way for the fuel leak report. A pedestrian reported being able to see a gasoline-like substance in the water and that he could smell fumes from the river.

Maggelet and Vice President of Fuels, John Hillam explained to Lander leaders that the leak occurred after three simultaneous system failures. A check valve, pump relay, and alarm reporting system all failed to work. “We’ve never seen had anything like this in any of our stores,” Maggelet explained.

A timeline was provided as part of the presentation of the series events leading up to the leak.

January 16th – Maverik conducts underground storage tank inspection, vendor reports everything was okay
February 12th – Warn check valve found by a technician
February 19th – Controller relay kept running on a pump tank. For approximately 160 hours, the pump kept running and the check valve failed
February 22nd – Fuel leak begins. Leak averaged 3/10 of a gallon per minute February 27th – Maverik technician who identified the check valve issue on the 12th noticed the relay issue and fixed it. This likely stopped the leak
April 2nd – Lander Fire Department responds to concerns about fuel in the Popo Agie River, closed fuel operations
April 3rd – Test for system tightness and pressure showed that it was not still leaking April 4th – Wyoming EPA took control of the site, installed a wall to protect the river April 19th – Maverik and Wyoming DEQ organize work plan April 20th – Installation of EPA wall is complete
May 8th – Maverik contractor completes tank system upgrades May 8th and 9th – Follow up testing is completed with Wyoming DEQ May 10th – DEQ completes investigation, lifts red tag order Despite the red tag order being lifted, Maverik said they did not plan to open fueling operations right away. Hillam told those at the meeting, “once you’ve been through this you’re humbled by it. You’re not chomping at the bit to open it before it’s ready. It’s a measure twice, cut once mentality.” Maverik reported that it’s estimated 2,700 gallons of fuel leaked from one of the store’s four underground tanks. They report that up to 300 gallons may have reached the river, and they believe the remaining product leaked into the ground near the tank area.

The company confirmed repairs to the system that caused the incident and that they have mounted an audio/visual alert monitor to the side of the store to help alert staff of future issues. Employees are being trained on the use of the alert system and a transfer switch and shut off. 

Maggelet replied, “We can’t apologize enough.

Senior management was involved in the issue right away, but we weren’t here on the ground, and that’s unacceptable.” He said that Maverik plans to streamline communication for critical situations in the future and vowed for more transparency in the company.

North Spokane shooting suspect in custody, investigation continues On April 28th, Quentin M.D. Hutchison (18) turned himself in to MCU Detectives in regard to the shooting at the Maverick gas station on the 25th that left one man dead and another critically injured. Hutchison was taken into custody and booked into the Spokane County Jail for 2nd Degree Murder and 1st Degree Assault. The investigation into the shooting continues and SPD asks anyone with information to please call Crime Check at 509 456-2233.

On April 25th, 2025 at approximately 3:15am SPD responded to a gas station located at Montgomery and Division on a report of a shooting. 911 received multiple calls about the incident with the information being provided that two people had been shot. Officers quickly arrived to find two victims in the parking lot. Officers began life saving measures, but one of the victims succumbed to their injuries and was pronounced deceased at Emergency Services

When officers arrived on scene, they discovered a white semi-truck crashed into the side of another semi-truck causing it to flip over. The Grand Junction Fire Department transported both drivers to the hospital to be evaluated.

The driver, Joseph Kelly (age 62), was arrested and remanded to the Mesa County Detention Facility for DUI and Careless Driving. There is no further information available at this time.

Woman dead after being run over in truck stop parking

A woman is dead after getting run over by a semi truck at a truck stop in Washington on Monday night.

The incident happened on August 15th at around 7:45 p.m. at the Pilot Flying J Travel Center in Ellensburg off of Interstate 90.

The 65-year-old-woman was run over by a semi truck in the parking lot as she was walking. The event was even captured on video, which can be viewed on NBC.

The woman was treated at the scene before being flown to a hospital where she died of her injuries.

Investigators say that impairment was not a factor in the accident, but have not determined if anyone was at fault. The driver and the woman have not been identified.

SACRAMENTO — There is a clash going on between big rigs and residences in a Sacramento neighborhood that city hall said is creating an unsafe environment.

The Robla neighborhood in north Sacramento has trucking companies right next door to family homes with little kids. It's not a good mix, and the City of Sacramento is trying to find a fix.

The site currently operates as a convenience store and gas station with four underground storage tanks (USTs) located onsite. In 1996, the USTs were re-lined, but not removed and former product lines and dispensers were drained, capped, and abandoned in place. The site has been a truck stop and fueling station operated by Pilot Travel Centers before 1996 until 2010, when Love's Travel Stops and Country Stores took over ownership and operation. Previous to 1996, spills and leaks at the site polluted the soil and groundwater. In 2018, a fuel leak near the gas pumps led to increased levels of pollution in nearby groundwater. The most recent incident occurred in October 2023, when over 700 gallons of unleaded gasoline were accidentally spilled during tank maintenance. Not all of the spilled fuel was recovered, leading to additional pollution.

Early investigations in 1996 and 2010 identified pollution at the site but did not fully measure its extent. Monitoring wells were installed to check pollution levels in the groundwater over time. After the 2018 fuel leak, some emergency measures were taken to address the increased pollution. Following the 2023 spill, some of the spilled gasoline was recovered, but a complete cleanup did not occur. The full extent of pollution in soil and groundwater remains unknown, indicating a need for more detailed studies.

The main pollutants at the site are petroleum hydrocarbons, including gasoline and diesel fuels, which contain harmful chemicals like benzene. Benzene is a toxic substance found in gasoline that poses serious health risks.

Exposure to benzene can occur through breathing polluted air, touching polluted soil or water, or drinking polluted water. Short-term exposure to high levels of benzene can cause dizziness, headaches, and irritation of the eyes, skin, and respiratory tract. Long-term exposure is linked to more serious health problems, including anemia and cancer.

These contaminants also pose environmental risks. Benzene and other petroleum pollutants can harm plants and animals by polluting soil and groundwater. They can move through the soil into groundwater, potentially affecting drinking water sources and ecosystems.

Q&A
For years Maverik has been an above average gas station and I always hated getting out of “Maverik country” while on road trips and rolling the dice on other gas stations.

Food quality and variety has gone down hill, many of the Maverik stores have a terrible smell, and even their cups and lids are getting worse.

This is just a complaint, in hopes someone at Maverik sees this and learns that they are damaging a good brand as they cut costs and quality.

Does anyone else feel like it is getting worse?

Because those machines are garbage, but increase store profits in the short term.

The valves wear out and start to leak other flavors and/or mix improperly. More complexity = more points of failure. When I see the multi-flavor spouts they're often so broken they actually vibrate and leak from the sides. All 3 options would be manageable if they did proper maintenance on the machines, but most chains and nearly all small restaurants neglect maintenance. They'll point the finger at Coke and the machine manufacturer, while Coke will point the finger at the store/restaurant. In reality it's a whole partnership failure made worse by overly-complex machines made with extremely cheap parts.

I have first-hand knowledge of a study that looked at syrup, CO2, and bacteria levels. The organization behind it took a massive payoff from Coke to "study something else," e.g. to not publish anything. I wish I had a copy of the preliminary results that I could leak, but suffice it to say most soda fountains are mixed poorly and far from sanitary.

There's one off of exit 99 that does Heaven in a Cup and has a drive thru window! An apt name for the treat (1/2 soft serve ice cream and 1/2 frazil slushie) and really amusing to use the drive thru, it can double as doors for their deliveries, so I felt it a super smart design! (The drive thru isn't super busy most of the time too!)
Love Holiday, though the nearest Maverick's food is superior. I watch them make it at Maverick almost every time I'm in there, Holiday? Never seen 'em making any of it no matter what time I went in.

Their burritos cheese now is DISGUSTING. And their soda used to have carbonation and flavor. Now it’s literally semi flat light brown Coke Zero of disappointment. To top it all off they raised their prices on everything. I go to gas stations in California and get this, their convenience stores are CHEAPER. They switched to lids that fit both the regular plastic and the foam cups, and they don't necessarily fit well in my experience. I hope they sort it out.

The burritos and kolaches ("bundles") at the stores i frequent have always sucked, so idk about food quality in general.

Yeah, maybe it’s just my area, but all the Mavericks near me have slushies and fountain drinks that taste and smell like sewage, hotdog bread that’s always stale, and self checkouts are almost always out of order. I go out of my way to avoid Mavericks nowadays lol

I was just ranting to my wife about this the other day! I mean, to be fair, everything is getting enshittified. It seems to be the way of late-stage capitalism, but I was really sad to see Maverick start to go to shit. The cup thing really struck me because for awhile their cups were way stronger than those from 7/11 or Holiday. Now they're on par, structurally, and cost more.

How does the number of truck accidents in Wyoming compare to the rest of the country? According to data collected by Forbes, Wyoming is tied with Idaho for the highest rate of car ownership, with 96.2% of households in the state owning at least one vehicle.

TruckInfo finds that in 2022 the following states are the top states with the most truck accidents:

Texas – 19,424
California – 13,603
Florida – 9,243
Pennsylvania – 7,646
Illinois – 7,555
Where does Wyoming fall on the list? There were 1,103 truck crashes in the state in the same year.

Of those crashes, 198 resulted in injuries, and 26 resulted in fatalities.

Large Truck Crash Statistics
The National Safety Council (NSC) is dedicated to keeping everyone safe on the road. Their most recent data from 2022 shows that 5,837 large trucks were involved in fatal crashes across the country.

That represents an increase of 1.8% from 2021 and a 49% increase in the last ten years.

Diving deeper into the numbers reveals that 46.02% of those crashes occurred in urban areas and the remaining in rural areas. Additionally, 26.61% of the accidents occurred on interstate roadways and 73.39% on non-interstate roadways.

Despite what you might assume, the majority of those accidents (61.3%) occurred during the daytime, and the months with the highest numbers were September (494) and October (497).

Why Truck Accidents Are Complex
The Federal Motor Carrier Safety Administration (FMCSA) regulates the trucking industry. This agency sets the service hours, inspection requirements, and standards for loading cargo. When a truck is involved in an accident, the FMCSA conducts its own inspection to determine whether the truck driver followed the regulations.

Those regulations extend to the trucking company that hired the driver and set the schedule.

Often, trucking companies exert pressure on their drivers to make deliveries, regardless of potential delays on the road. In 2007 one out of every nine traffic fatalities was caused by one of these big trucks. These trucks often weigh more than 10,000 pounds, so the injuries sustained when you are hit by one are far more severe than in a regular car accident. Eighteen-wheelers only account for 3% of all the vehicles registered on the road today, but according to the National Center for Statistics and Analysis, account for 12% of all of the vehicles involved in fatal crashes. In Missouri, and particularly in St. Louis, there are so many more commercial trucks driving across our roads because 3 major highways intersect, allowing trucking companies to move goods from east to west, north to south, right across our cities. Couple that with the fact that from 1992 to 2002, the number of big trucks involved in fatal crashes increased by 10% due to driver fatigue, dangerous vehicle operation, large or unstable loads or faulty equipment. And with our economy, more unqualified or new drivers are taking to the road and being hired by the trucking companies to carry their loads.

Driving while fatigued is the number one safety issue facing the trucking industry and is a factor in almost 40% of all crashes in the U.S. The drivers for these trucking companies are under considerable pressure to move the cargo as quickly as possible, making 16 hour days not uncommon. Studies have revealed that 20% of semi tractor trailer drivers on the road had reported that they had fallen asleep at the wheel within the last 30 day period. There are Federal Motor Carrier Safety Regulations which address the hours of service that drivers are allowed to log. Unfortunately, many trucking companies find ways around these restrictions or flat out choose to violate the regulations, putting us all in danger. Many times, in order to keep their jobs, truckers have no choice but to keep the wheels moving.

Trucking regulations are designed to reduce the number of people injured or killed by these big trucks and govern such things as what route the trucks are allowed to drive, how the trucks are maintained, the necessary training for the drivers, how loads should be safely secured, and the responsibility that the company must take for causing these collisions. Yet, every year there are more truck drivers on the road, more accidents, more fatalities and more violations of the regulations designed to keep us safe.

Truck-car collisions often involve some type of neglect on the part of the truck driver, the trucking company, or both. The most common causes of these crashes is poor training, drivers falling asleep at the wheel, improper or no maintenance of the truck or trailer, improper loading or aggressive driving, including speeding.

Sometimes trucking companies hire incompetent or unskilled drivers and fail to provide appropriate training. These trucks are 10,000 pound monsters, are very hard to maneuver and are very unlike a passenger vehicle in their behavior. It takes great skill and experience to drive one safely and responsibly. According to the National Center for Statistics and Analysis, more than 25% of the truck drivers involved in crashes resulting in a fatality in 2004 had received at least one prior speeding conviction. Unfortunately for those of us traveling on the highway with these trucks, seven percent of the truck drivers had previous license suspensions or revocations and additionally some had prior felony convictions. The only plausible explanation for hiring such drivers with such bad driving records is so that the trucking company could move cargo at the cheapest cost possible.

Many people injured in collisions with these large trucks are surprised to find out the lengths that some companies or their insurers will go to in order to keep from accepting responsibility. But the trucking industry hauls in major revenues. Last year trucking company revenues totaled $610 billion dollars and are forecasted to almost double by 2015.

And if a crash does occur between a truck and a smaller vehicle, how serious are the consequences?
According to the most recent data from the Federal Motor Carrier Safety Administration (FMCSA), which regulates the U.S. trucking industry, approximately 415,000 crashes involving large trucks were reported in 2020. Of the crashes for which severity was reported, 4,444 were fatal, and 101,000 resulted in injury.

While those numbers are concerning, when you consider the number of registered large trucks and the hundreds of billions of miles they travel each year, the crash rate is lower per mile traveled than for passenger vehicles. The FMCSA reports that in 2020, the large truck fatal crash rate was 1.46 fatal crashes per 100 million vehicle miles traveled, compared to 1.53 for passenger vehicles.

However, this doesn’t mean that trucks are safer than cars. Commercial trucks have a much higher risk exposure since they accrue many more miles on the road each year than the average passenger vehicle. A typical automobile is driven around 12,000-15,000 miles annually, while a long-haul truck may cover over 100,000 miles in the same time span. More miles equate to more opportunities to get into an accident.

So, what causes large truck accidents, and are the contributing factors different than passenger vehicle crashes? Driver-related factors are critical reasons (the last failure leading to a crash) in 33% of fatal truck accidents, according to the FMCSA. Some of the most common critical driver-related factors are:

Distracted driving
Impairment by fatigue, alcohol, illness, or other factors Failure to yield the right of way
Careless driving
Overcorrecting

Many of these causes, like speeding, driver distraction, and impairment, are also leading factors in automobile crashes. However, some risk factors are more pronounced or unique when it comes to large trucks:

Driver Fatigue – Strict hours of service (HOS) regulations aim to prevent truck driver fatigue, but demanding delivery schedules still frequently lead to drowsy driving in the trucking industry. Driving while drowsy slows reaction time and decision-making ability.

Bigger Blind Spots – The massive size of trucks means they have much larger blind spots than passenger vehicles. Other motorists lingering in those blind spots can lead to lane change collisions.

Longer Stopping Distances – Loaded tractor-trailers can weigh up to 80,000 lbs. It takes significant time and distance for them to come to a complete stop, especially at highway speeds. If traffic suddenly slows, it can be difficult to avoid a rear-end collision.

Overview
Most deaths in large truck crashes are passenger vehicle occupants. The main problem is the vulnerability of people traveling in smaller vehicles. Trucks often weigh 20-30 times as much as passenger cars and are taller with greater ground clearance, which can result in smaller vehicles underriding trucks in crashes.

Truck braking capability can be a factor in truck crashes. Loaded tractor-trailers require 20%-40% more distance than cars to stop, and the discrepancy is greater on wet and slippery roads or with poorly maintained brakes. Truck driver fatigue is also a known crash risk. Drivers of large trucks are allowed by federal hours-of-service regulations to drive up to 11 hours at a stretch. Surveys indicate that many drivers violate the regulations and work longer than permitted (McCartt et al., 2008).

The following facts are based on analysis of data from the U.S. Department of Transportation’s Fatality Analysis Reporting System.

Deaths in crashes involving large trucks, 1975-2023
A total of 4,354 people died in large truck crashes in 2023. Sixteen percent of these deaths were truck occupants, 65% were occupants of cars and other passenger vehicles, and 17% were pedestrians, bicyclists or motorcyclists. The number of people who died in large truck crashes was 38% higher in 2023 than in 2009, when it was the lowest it has been since the collection of fatal crash data began in 1975. The number of truck occupants who died was 58% higher than in 2009.

Among vehicle occupants killed in large truck crashes, both the rate of passenger vehicle occupant deaths per truck mile traveled and the rate of large truck occupant deaths per truck mile traveled have declined substantially since 1975. This decline stopped around 2009, and rates have varied little since then (Federal Highway Administration, 2024).

Forty-nine percent of fatally injured large truck drivers in 2023 were using seat belts, which was similar to fatally injured passenger vehicle drivers (46%).

However, belt use was unknown for 21% of fatally injured large truck drivers, compared with 10% of fatally injured passenger vehicle drivers.

Thirty-one percent of passenger vehicle occupants killed in two-vehicle crashes with a large truck in 2023 were in vehicles that collided head-on with the truck and another 23% were in vehicles that were side-struck by the truck. Twenty-two percent were killed in crashes in which the front of the passenger vehicle struck the rear of the large truck.

Large truck drivers killed in fatal crashes are much less likely than passenger vehicle drivers to have high blood alcohol concentrations (BACs). Truck drivers are subject to strict government regulations concerning drinking and driving. Five percent of fatally injured large truck drivers had BACs at or above 0.08% in 2023. That proportion is far below the 17% seen in 1982. For comparison, 31% of fatally injured passenger vehicle drivers in 2023 had BACs at or above

0.08%, down from 51% in 1982.

Causes
A truck accident can stem from all the same causes as a regular car accident. Disobeying road rules, driving under the influence and driver distraction can all lead a truck driver to cause an accident. However, truck drivers have additional risk factors and concerns that typical drivers don’t share because of the nature of their jobs. A truck driver, for example, may drive long hours on the road at a time while alone, and this can increase the chance of an accident related to fatigued driving.

Driver Error Is More Common Than You’d Think
Errors by a truck driver are actually the leading cause of truck accidents. Truck drivers are far more likely to be the responsible party in an accident than any other factors, including weather and road conditions. FMCSA found that truck drivers were the main cause in close to 90 percent of truck accidents, but this is not that surprising when you think about the industry.

A truck driver is often under a lot of pressure to meet deadlines, and this can mean staying on the road for long hours to make deliveries on time and stay on schedule. Sleep-deprived drivers and drivers under the influence are not unusual, and fatigue, use of legal and illegal drugs, speeding and distraction are all factors that can also play a part in truck driver errors. A truck driver may lose control of the truck, drift out of the travel lane, speed, doze off or drive while their attention is elsewhere, and the results can be devastating.

Equipment Failure Happens
The next leading cause of truck accidents is an equipment issue, with major mechanical problems often stemming from a lack of proper truck maintenance. When a truck’s front brakes aren’t maintained as they should be, for example, it can cause the truck to jackknife. A truck that isn’t inspected properly could have tire troubles that lead to a dangerous blowout and a loss of truck control on the road.

If a truck contains a part that was defective when it was installed, the maker or the distributor of that part can be liable if the part’s malfunction causes an accident.
