IC COMMENT
El
len B., Lindsey Halsell, Rico G., Allison Randall, Jeff Toone, Sydney Pool, and Stephen F. addressed Item 7.11, speaking in opposition to the item believing consideration of the amendment to the contract with Flock Group, Inc. for A utomatic License Plate Readers (ALPRs) should be continued until an audit of the security of data collected was conducted by the State of California Department of Justice (DOJ). Speakers raised concerns of illegal access to data that agencies could utilize for surveillance of the populace, concerns of the practices of the Flock Group, Inc. company, and suggested the City initiate the request to the DOJ to conduct an audit. Ellen B. raised concerns of the exemptions cited to waive competitive bidding for the contract amendment.

Police Chief Robert Davis ensured that police department systems were protected and the City has not, does not, and would not share data with federal agencies. He noted that stories being referenced were of instances or hacked technology in other jurisdictions based on their practices or deployment of technologies, and were not issues in Elk Grove.
He noted that the DOJ conducted a study in 2023 of ALPR data sharing, and he confirmed the City implemented security checks and protocols for general system operations and updates, no agencies that have shared data were affiliated with the City, and any association an agency has with federal connections he affirmed the City would not share data with such a group. Police Chief Davis clarified that though there was reporting that several agencies had cancelled contracts with Flock Group, Inc., numerous agencies actually had not cancelled their contracts, and a significant number of organizations continued use of the technology.
City Attorney Jonathan Hobbs addressed questions raised during public comment about the contracting process, noting use of a best interest exemption was available to the City Council, and the City Council ha d the authority to award or amend the contract . He clarified the recommendation in the staff report did not rely on a sole source exemption, and the legislative act of approving the contract gave the City Council broad discretion to decide to award with or without a competitive process, no evidentiary findings were necessary, and the City Council held discretion to proceed without going through a competitive process.
Vice Mayor Suen appreciated the concerns raised by members of the community , but was confident with City practices to secure the data of the systems . He believed the technology as utilized was beneficial to assisting law enforcement in the community, and the practices and protocols provided assurances of appropriate use of the technologies.
The City Council encouraged the community that if they remained unsure of the safety and security of the technologies utilized, and the security of the data collected, to reach out to the City and continue the dialogue.
