SUBJECT:

Resolution Of The City Council Of The City Of Emeryville Authorizing Acceptance Of Twenty Thousand Dollars ($20,000) Allocated By The Department Of Resources Recycling And Recovery (Calrecycle) SB 1383 Local Assistance Grant Program And Authorizing The City Manager To Apply For All Future Calrecycle Grant And Payment Programs For Which The City Of Emeryville Is Eligible For Five Years Recommendation
Staff recommends the City Council approve the above-entitled resolution authorizing the Director of Public Works to accept funds allocated by the Department of Resources Recycling and Recovery (CalRecycle) for the SB 1383 Local Assistance Grant Program and authorizing the City Manager for five years to apply for future CalRecycle grant programs for which the City of Emeryville is eligible.

Background
On November 16, 2021, the City Council adopted Ordinance 21-008, amending Section 6-4.25 of the Emeryville Municipal Code and opting into the Alameda County Organics Reduction and Recycling Ordinance (ORRO). The Ordinance became effective in January 2022, consistent with the Organics Reduction and Recycling Ordinance adopted by the Alameda County Waste Management Authority. The ORRO serves as the enforcement mechanism for compliance with the Short-Lived Climate Pollutant Reduction Act of 2016 (Senate Bill 1383).

The Senate Bill (SB) 170 Budget Act of 2021 provided $57 million to assist local jurisdictions with their efforts to implement SB 1383 requirements. To this end, CalRecycle is administering a one-time, non-competitive grant program allocating these funds to jurisdictions statewide. The City of Emeryville has been allocated $20,000 for implementation assistance under this program.

In addition to the one-time funding of the SB 1383 Local Assistance Grant Program, the City of Emeryville often annually applies for and receives multiple smaller grants from CalRecycle including their Beverage Container Recycling City/County Program and Used Oil Payment Program. These programs typically require a resolution or other formal declaration from the governing body to apply, regardless of size or timing. To reduce administrative burden, CalRecycle has recently begun encouraging entities with governing bodies to authorize a signature authority by resolution and include an effective time period of no greater than five years.

DisCussion
The Short-Lived Climate Pollutant Reduction Act of 2016 (Senate Bill 1383) is a state mandate requiring diversion of 75% of organic waste from landfills and recovery of 20% of edible food statewide by 2025. The intent of SB 1383 is to reduce greenhouse gas emissions to curb global climate change through reduction of organics in landfills. Local jurisdictions are the primary entities responsible for implementation and enforcement of SB 1383 requirements. The requirements affect all organic waste generators in the residential and commercial sectors, and implementation will require coordination between all City departments and many County agencies.

Implementation of SB 1383 regulations require significant staff time and funding for outreach and education to residential and commercial customers, record keeping and reporting, procurement of recycled-content paper products, as well as other implementation activities. The City will use payment program funds to cover some personnel costs associated with implementation of SB 1383 regulations.

In addition to SB 1383 funds, the City of Emeryville also annually receives small awards from various CalRecycle programs to support a zerowaste consultant at Emery Unified School District and used oil recycling outreach. Both programs have been running for over a decade with minimal changes. A five-year authorization would streamline and expedite the application process.

ENVIRONMENTAL IMPACT
None.

Fiscal Impact
None.

SB 1383 Local Assistance Grant Program a non-competitive payment program distributed to cities statewide on a per capita basis. The City has been allocated $20,000 by CalRecycle and no local match funds are required to qualify. Additionally, all other CalRecycle payment programs and grants have not historically required matching funds.

Staff Communication with the public
None.

Conclusion
Staff recommends the City Council approve the above-entitled resolution authorizing the Director of Public Works to accept the SB 1383 Local Assistance Grant Program funds and authorize them as a signature authority to execute documents to implement and secure payment.

Additionally, staff recommends authorizing the City Manager or their designee for five years to apply for eligible CalRecycle grant and payment program funding.
