Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A Contract With Bay Construction, Inc. In An Amount Not To Exceed $301,135 For The Construction Of The Davenport Mini-Park Renovation Project, CIP No. 16475017, And Transfer $165,000 From The Marina Navigation Channel Maintenance Dredging Program Funds, CIP No. 19495003, To The Davenport Mini Park Rehabilitation, CIP No. 16475017, Both In Fund 495 WHEREAS, the Davenport Mini-Park Renovation Project is a Capital Improvement Program project, CIP #16475017, with the purpose of renovating and improving an existing mini-park and upgrading an existing play structure (“Project”); and WHEREAS, the City of Emeryville is authorized to perform the work of the project under BCDC permit number M2021.020.00; and
WHEREAS, on July 21, 2021, the City Council unanimously adopted Resolution No. 21- 87 to authorize the City Engineer advertise for public bids, transfer funds to cover anticipated costs to expand the scope of work to include a new play structure and improved fall-zone safety provisions, and accept a CEQA “categorically exempt” determination; and
WHEREAS, the project construction contract was advertised on February 10, 2022, and the bids were opened on March 3, 2022. A total of five (5) bids were received; and WHEREAS, On March 3, 2022, the following responsive bid proposals for the project were received:
1. Bay Construction $301,135
2. Suarez Munoz Construction $301,350
3. CF Contracting $356,283
4. Terramark General Eng. Contractors $406,114
5. NBC Construction $416,194; and
WHEREAS, staff recommends that the City Council authorize the City Manager to enter into a Construction Contract with Bay Construction, Inc. of Oakland, CA, who submitted the lowest responsive bid in the amount of $301,135; and WHEREAS, with an additional $165,000 in new project funding from the Marina Navigation Channel Maintenance Dredging Program Funds (CIP Project No. 19495003), adequate funding will be available in the Davenport Mini-Park Renovation Project (CIP #16475017) budget to fund this contract;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Emeryville determines that Bay Construction, Inc. is the lowest responsible bidder and the City Manager is hereby authorized to enter into the attached contract with Bay Construction, DocuSign Envelope ID: 739D8D11-68CC-482F-87C2-6997D41CAA26 Resolution No. _____

Inc. of Oakland, CA in an amount of $301,135 for the construction of the Davenport MiniPark Renovation Project (CIP #16475017); and, be it, further RESOLVED, that the City Council of the City of Emeryville authorizes the transfer of an additional $165,000 from the Marina Navigation Channel Maintenance Dredging Program Funds (CIP Project NO. 19495003) to the Davenport Park Rehabilitation Project (CIP Project No. 16475017).
