SUBJECT:

Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A Contract With Bay Construction, Inc. In An Amount Not To Exceed $301,135 For The Construction Of The Davenport Mini-Park Renovation Project, CIP No. 16475017, And Transfer $165,000 From The Marina Navigation Channel Maintenance Dredging Program Funds, CIP No. 19495003, To The Davenport Mini Park Rehabilitation, CIP No. 16475017, Both In Fund 495.

Recommendation
Staff recommends that the City Council adopt the above-entitled resolution.

Background
The Davenport Mini-Park Renovation Project is a Capital Improvement Program project, CIP #16475017, with the purpose of renovating and improving an existing mini-park and upgrading an existing play structure (“Project”).

The site is located along the north side of Powell Street between the Emery Cove Yacht Harbor and the Watergate Commons residential complex. The work area is located between the Bay Trail and the curb and gutter along Powell Street. The park consists of open space, native grasses and other landscaping, picnic table, benches, and low chain link fencing.

Community meetings were held in 2018 to discuss the ideas and needs of parents and children in the area. That same year the City’s Parks and Recreation (P&R) Committee recommended increasing funding to improve the site playground. On October 16, 2018, the City Council considered the P&R Committee recommendation and directed staff to continue development of the project and bring back additional details for funding and improvement of the site.

Staff retained John Calalan Landscape Architect (JCLA) to develop plans, specifications and construction estimates for the project.

On July 21, 2021, the City Council unanimously adopted Resolution No. 21-87 to authorize the City Engineer to advertise for public bids, transfer funds to cover anticipated costs to expand the scope of work to include a new play structure and improved fall-zone safety provisions, and accept a CEQA “categorically exempt” determination.

The City experienced COVID challenges and staffing changes that significantly delayed developing bid specifications and issuing an RFP for the project. In early 2022, Public Works staff authorized Coastland Civil Engineering, LLP to finalize the project specifications and prepare the project documents for bidding under their existing professional services contract.

Staff was able to obtain BCDC approval for the project on February 28, 2022, and the City is authorized to perform project work under BCDC permit number M2021.020.00. The BCDC permit is attached as Attachment 2.

Discussion
The project construction contract was advertised on February 10, 2022, and the bids were opened on March 3, 2022. A total of five (5) bids were received.

Construction Bids:

On March 3, 2022, the following responsive bid proposals for the project were received:

Bay Construction $301,135
Suarez Munoz Construction $301,350
CF Contracting $356,283
Terramark General Eng. Contractors $406,114
NBC Construction $416,194
Staff recommends that the City Council authorize the City Manager to enter a Construction Contract with Bay Construction, Inc. of Oakland, CA, who submitted the lowest responsive bid in the amount of $301,135 plus contingency for construction of the Project. The two lowest bids submitted by Bay Construction and Suarez Munoz Construction were within $215 of each other; however, Bay Construction’s bid is 38% higher than the Landscape Architect’s Estimate of $218,374.

Fiscal Impact
The cost for the rehabilitation of the Davenport Mini-Park Project was estimated in 2021 when the City Council was originally requested to authorize bidding for the project at $271,412 and included a 15% contingency.

Now that actual costs are known and the project has been publicly bid, additional funding is required to complete the project.

Staff recommends that the City Council authorize the transfer of an additional $165,000 from the Marina Navigation Channel Maintenance Dredging Program Funds (CIP Project No. 19495003) to the Davenport Park Rehabilitation Project (CIP Project No.16475017). The Marina Navigation Channel Maintenance Dredging Project has funds available beyond the base scope of the existing project. The improvements at Davenport Park are specifically intended to address the need for a children’s play area on the west side of Emeryville.

Maintenance costs at Davenport Mini-Park are not anticipated to significantly increase because of this project.

Staff Communication with the Public
City Staff has discussed this Project at the following meetings:

City Council meetings from 2018-2021
Parks and Recreation Committee at various meetings from 2018-2021 BCDC Administrative Listing on February 17, 2022.

Conflict of Interest
Not applicable.

Conclusion
Staff recommends that it is in the public interest for the City Council to adopt the above-titled resolution.
