SUBJECT:
Request To Remove An ADA Blue Disabled Parking Zone At 1048 45th Street, Emeryville, California Recommendation
The Transportation Committee and staff recommend that the City Council approve the above referenced request.
Background
The City received a request to remove an existing ADA Blue Disabled Parking Zone on December 20, 2021, from applicant Charles Hubert. The disabled parking space had initially been requested by the former owner of the residence at 1048 45th Street, Emeryville, and approved by the City Council. Mr. Hubert has since purchased and moved into the residence and the disabled parking space is no longer needed.
The request was forwarded and considered at the January 12, 2022, Transportation Committee meeting. The location of the parking zone was noticed 72 hours in advance of the Committee meeting, and the Committee meeting agenda was posted as required by Government Code Section 54950 (the “Ralph M. Brown Act”). There were no members of the public in attendance in favor of or opposed to the removal of the parking zone. The Transportation Committee moved to approve the request to remove the blue disabled parking zone and voted unanimously to forward the request to the City Council for consideration and action.
The applicant has been notified by email, and the parking zone will be noticed 72 hours in advance of the April 5th City Council meeting. Any comments received will be forwarded to the City Council.
Discussion
Staff requests that the City Council consider the application of Mr. Hubert for the removal of an ADA blue disabled parking zone in front of 1048 45th Street, Emeryville. Attached to this staff report is Exhibit C, a map of the surrounding neighborhood. The blue lines show the locations of other ADA blue disabled parking zones in the area, as well as the residence of the applicant and the existing disabled parking zone. As indicated in the map, there are two additional disabled parking zones located nearby along 45th Street.
Fiscal Impact
The cost for staff to remove the ADA blue disabled parking zone and sign panel can be covered by the Public Works’ existing operating budget at a cost of approximately eight hundred dollars ($800.00) for materials and staff labor.
Staff Communication with the Public
Staff will physically post notice of request to remove the disabled parking zone area at least 72 hours in advance of the April 5th meeting date. Staff has also communicated with the applicant regarding this application process.
