Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Submit An Application To The Volkswagen Environmental Mitigation Trust Fund, Execute Certain Assurances, And Administer Funds WHEREAS The City of Emeryville received notice that all existing diesel vehicles over 14,001 gross vehicle weight rating (GVWR) with a 2007-2009 engine will no longer be compliant with California Air Resources Board’s Truck and Bus Regulations and, as a result, DMV registration will be automatically denied for these vehicles effective January 1, 2023; and
WHEREAS, The California VW Mitigation Trust Fund provides $130 million in funding for pubic and private agencies to replace older, high-polluting vehicles and buses with new battery-electric or fuel cell vehicles and buses; and
WHEREAS, Since public and non-profit transportation providers that apply for administration, capital, and operation assistance under local, state, and federal programs are required to designate an individual authorized to submit an application and administer the trust funds, the City Manager is authorized to submit an application for funding and administer the funds;
WHEREAS, The City estimates that an additional amount of $22,500 will need to be appropriated from the Vehicle Replacement Fund to cover the difference between grant funds and the cost for a replacement vehicle; and
WHEREAS, Applicants for the Volkswagen Environmental Mitigation Trust Fund must apply online, and will be processed on a first come, first served basis as long as project funds are available; and
RESOLVED, The City Council of the City of Emeryville hereby authorizes the City Manager to submit an application to the Volkswagen Environmental Mitigation Trust Fund, execute required assurances, and administer funds on behalf of the City of Emeryville.
