DATE: June 21, 2022
TO: Christine Daniel, City Manager
FROM: Charles S. Bryant, Community Development Director SUBJECT: Resolution Of The City Council Of The City Of Emeryville Authorizing A Third Amendment Of The Professional Services Contract With West Coast Code Consultants (WC3) For Fiscal Year 2021-2022 For Building Division Services In An Amount Of $500,000 To Cover Expanded Services For A Total Amount Not To Exceed $3,475,494 And Increasing Revenues And Expenditures In The Building Division Budget For Fiscal Year 2021-2022

RECOMMENDATION
Staff recommends that the City Council approve the above-entitled resolution authorizing a Third Amendment to the fiscal year 2021-2022 West Coast Code Consultants (WC³) contract to increase compensation from $2,975,494 to $3,475,494 for previously unbudgeted plan review services to the Building Division and making corresponding increases in revenues and expenditures in the Community Development Department budget for fiscal year 2021-2022.

DISCUSSION/ANALYSIS
The existing WC³ contract was approved by the City Council on June 15, 2021, by Resolution No. 21-63. A First Amendment was approved by City Council on September 13, 2021, by Resolution No. 21-97, and a Second Amendment was approved on April 19, 2022, by Resolution No. 22-38. Subsequently, the following additional major projects were submitted for plan review services to the Building Division:

Description
Address
Valuation
Total City Plan Check fee Collected
Consultant Plan Review Fee
Totus Lab Tenant Improvements. - Expedited
1480 64th Street, #300
$8,480,779.00
$ 78,871.24
$ 55,209.87
Zymergen HQ Tenant Improvements
5300 Chiron Way
$47,740,974.00
$ 295,994.05
$ 192,396.13
Bridgewater Condos Deck waterproofing repairs
6400 Christie Avenue
$6,500,000.00
$ 40,300.00
$ 28,210.00
Totals
$ 415,165.28
$ 275,816.00
The existing contract executed with WC³ for fiscal year 2021-2022, including the First and Second Amendments, does not include the cost to provide plan check services for these projects or for other unanticipated major development projects or baseline projects that may be submitted before the end of the fiscal year. Therefore, Section 3B of the Professional Services Agreement, “Compensation and Method of Payment”, should be revised from $2,975,494 to $3,475,494 an increase of $500,000.00, which is the estimated cost to provide these services by WC³.

FISCAL IMPACT
Appropriations from the General Fund (Fund 101) of $500,000.00 to the Building Division Professional Services – Plan Check Fees account (1730-80480) are required to cover this contract increase. To offset this additional expense, revenues should likewise be increased, including an increase of $600,000 in the Plan Checking account (1730-58400) and $115,000 in the Title 24 Energy Review Fee account (1730-58380). Revenues exceed expenditures because expenditures include only consultant services, whereas revenues must also cover other City expenses such as overhead and administrative costs.
