Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager Or Designee To Enforce Provisions Of Assembly Bill 1276, Single-Use Foodware Accessories And Standard Condiments (Carrillo) WHEREAS, effective January 1, 2022, Assembly Bill (AB) 1276 amended Chapter 5.2 of Part 3 of Division 30 of the California Public Resources Code to require that all food facilities and third-party food delivery platforms “shall not provide any single-use foodware accessory or standard condiment packaged for single use to a consumer unless…requested by the consumer”; and
WHEREAS, the City desires to reduce the amount of material sent to landfills and discarded in the San Francisco Bay; and
WHEREAS, AB 1276 requires that every city and county in the state authorize an individual or agency to enforce the provisions of the law within that jurisdiction; now, therefore, be it
RESOLVED, by the City Council of the City of Emeryville hereby authorizes the City Manager, or their designee, to enforce provisions of AB 1276 within the City of Emeryville retroactively to June 1, 2022.
