Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A Maintenance Contract With Rubicon Landscape Corporation In An Amount Not To Exceed $219,491.66 For City-Wide Landscape Maintenance For Fiscal Year 2022/23, Increase Appropriations In The Amount Of $32,849 From The General Fund, And Delegate Authority To The City Manager To Renew The Contract For Fiscal Years 2023/24, 2024/25, 2025/26, And 2026/27 But Limit The Contract Amount Increase To The Bay Area Consumer Price Index Or 5%, Whichever Is Lower
WHEREAS, the City of Emeryville contracts for the maintenance and landscaping of City facilities, various parks, median island, and greenways throughout the City; and WHEREAS, many of the City’s landscaped areas are in need of work beyond the routine monthly maintenance including re-planting, re-seeding, heavy pruning, and other improvements; and
WHEREAS, the City periodically releases a Request for Proposals (RFP) for Landscaping Maintenance Services, the last one being May of 2017, which granted the City Manager authority to enter into an annually renewable contract through FY 2021/22; and WHEREAS, a new RFP was issued on May 2, 2022, in which the City received two proposals in response and Rubicon Landscape Corporation was determined to be the most responsive; and
WHEREAS, the proposed total contract amount for fiscal year 2022/23 is $219,491.66 and funding has been included in the proposed FY 2022/23 operating budget as follows:

WHEREAS, since costs were higher than the original budget for FY 22/23 due to inflation, an additional of $32,849 is needed from the general fund in order to fund the contract; and
WHEREAS, staff requests that the City Manager be delegated authority to renew the contract on an annual basis for FY 23/24, 24/25, 25/26, and 26/27 but any contract increase is limited to a cost-of-living adjustment based on the Bay Area Consumer Price Index or up to a maximum of five percent per year whichever is lower; now therefore be it

RESOLVED, by the City Council of the City of Emeryville that the City Manager is authorized to enter into a Maintenance Contract, attached hereto as Exhibit A, with Rubicon Landscaping Corporation in an amount not to exceed $219,491.66 for landscape maintenance of city-owned parks and open space for fiscal year 2022-23; and be it RESOLVED, that the City Council of the City of Emeryville approves an additional appropriation in the amount of $32,849 from the City’s General Fund -Fund Balance (101- 4060-77020) to fully fund this contract; and be it
RESOLVED, that the City Council of the City of Emeryville delegates authority to the City Manager to renew this Maintenance Contract with Rubicon Landscaping Corporation on an annual basis for fiscal years 2023/24, 2024/25, 2025/26, and 2026/27 with any contract amount increase limited to a cost-of-living adjustment based on the Bay Area Consumer Price Index or 5% whichever is lower.
