Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Execute A Second Amendment To The Professional Services Agreement With Wood Rodgers To Amend The Scope Of Work, Increase The Total Compensation By An Additional $417,836, For A Total Amount Not To Exceed $1,075,794, For Engineering Services For The Sanitary Sewer And Storm Drainage On-Call Projects SS-01 (CIP Project No. 15511005) And ST-05 (CIP Project No. 15475013), And Extend The Contract Term To June 30, 2025 WHEREAS, on September 22, 2014, the City of Emeryville (“City”) was included as a defendant in the EPA Consent Decree which regulates maintenance of the sanitary sewer system; and
WHEREAS, the City and Wood Rodgers Inc. (“Contractor”) entered into a Professional Services Contract dated August 20, 2021 (“Contract”) in the amount not to exceed $657,958 for the purpose of retaining the Contractor to provide On-Call Civil/Environmental Engineering Consultant Services; and WHEREAS, the City and Contractor agreed to expand the scope of the Contract to include the Contractor hiring and managing a subcontractor to perform CCTV and cleaning services for the sanitary sewer system (“SS”); and WHEREAS, Amendment 1 to the Contract reallocated $400,701 from the original contract to perform CCTV and Cleaning Services for the SS to fund the expanded scope of the Contract; and
WHEREAS, Amendment 2 to the Contract proposes to increase the contract amount by $400,701 from Fund 475 to replace the funds previously reallocated by Amendment 1 to fund this expanded scope of services; and
WHEREAS, an additional $17,135 from Fund 475 (General Fund) is requested to increase the number of storm drain trouble spots being analyzed by two to a total of five; and
WHEREAS, Amendment 2 to the Contract also extends the Contract term to June 30, 2025 in order to accommodate a more time-consuming rehabilitation process for the Powell Street sanitary sewer than originally anticipated; and WHEREAS, there is sufficient funding to cover the additional costs for Amendment 2; now, therefore, be it
RESOLVED, that the City Council of the City of Emeryville hereby authorizes the City Manager to execute a Second Amendment to the Agreement with Wood Rodgers to amend the scope of work, increase the contract amount by $417,836, for a total contract amount not to exceed $1,075,794, to provide on-call civil/environmental engineering consultant services for Public Works Project Number EPW 21-086 (CIP # 15511005 AND 15475013), and extend the contract term to June 30, 2025.
