Resolution Of The City Council Of The City Of Emeryville To Reject All Bids, Approve Revised Scopes Of Work For The 40th Street Bridge Railing Painting, Lumec Light Pole Painting, And Marina Lighting Replacement Project, Project No. EPW-20103 (CIP No. 15475015, 15475028, And 17495012), And Authorize the City Engineer To Advertise These Projects for Public Bids Recommendation
Staff recommends that the City Council of the City of Emeryville adopt the above-entitled resolution to reject all bids, approve revised scopes of work for the 40th Street Bridge Railing Painting, Lumec Light Pole Painting, and Marina Lighting Replacement Project, and authorize the City Engineer to advertise these projects for public bids.
Background
The Capital Improvement Program (CIP) adopted by the City Council in June 2016 included funding for the Marina Park and Powell Street Lighting Project (“Marina Park Project”), (CIP No. 17495012). The existing lighting system is 45 years old, and the poles and anchor bolts are experiencing rust due to the saltwater bay environment. Several light poles have failed in the past decade and require new foundations for replacement. In addition, many of the pole bases are buried in the topsoil and are not easily accessible.
The Marina Park Project entails upgrading street light poles and lighting throughout the Marina Park and parking lot areas. The upgrades also include replacement of standard streetlights along Powell Street from Frontage Road to the Marina turnaround.
On December 21, 2021, the City Council approved a scope of work and authorized the City Engineer to advertise for public bids for the 40th Street Bridge Railing and Lumec Light Pole Painting Project, EPW-20103 (“EPW-20103 Project”), (CIP No. 15475015 And 15475028). The scope of work for this project generally included, but was not limited to, the preparation and repainting of all designated metal surfaces of Lumec light poles and bridge railings, and repairing light fixtures on the 40th Street Bridge.
In order to expedite delivery, staff proposed combining the Marina Park Project with the EPW-20103 Project’s scope of work. Cost savings were expected to be realized in managing the combined projects, mobilizing the Contractor, and other discounts due to economies of scale related to items on the combined scope of work. On March 1, 2022, the City Council approved a scope of work and authorized the City Engineer to advertise for public bids for the combined projects.
Discussion
Construction Bids:
On June 28, 2022, the following bid proposals for the project were received:
NBC Construction and Engineering, Inc. $ 3,697,792.00 St. Francis Electric, LLC $ 4,105,366.00
Ray’s Electric $ 4,302,293.00
NBC Construction and Engineering, Inc. was determined to be the lowest responsive bid at $3,697,792.00; however, the amount of their bid proposal is 91.6% greater than the engineer’s estimate of $1,930,000.00.
The City of Emeryville reserves the right to reject any or all bids. Staff has determined that modification of certain requirements and items in the contract documents will result in better bid pricing. Additionally, splitting the project back into the original two projects (one with painting/repair items only and the other with electrical items only) will result in less mark-up for subcontracted work. Separating the projects and re-bidding them would be in the best interest of the City’s use of public funds.
Revised Scope of Work
Staff recommends bidding one project, the EPW-20103 Project, as originally approved at the December 21, 2021, City Council meeting. At that time, the City Council approved the scope of work and advertising for public bids which will remain the same, but the re-balanced bid items should result in better bid pricing with less mark-up. The EPW-20103 Project should be put out for bid in July-August 2022.
Staff recommends bidding the Marina Park Project with the same scope and project areas as approved at the March 1, 2022, City Council meeting, and authorize the City Engineer to advertise for public bids. The construction plans released in the June bid package will need modifications to provide better clarity to bidders, and other improvements to the bid package can be made based on feedback from the bidders. Staff anticipates another 3 to 4 more months before it is advertised for public bids.
Fiscal Impact
No fiscal impacts at this time, as no budgeted amounts have changed since the prior Council actions at the December 21, 2021 and March 1, 2022 meetings.
Staff Communication with the Public
Staff communicated with numerous contractors leading up to the June 28, 2022, public bid opening.
Conflict of Interest
None.
Conclusion
Staff recommends that the City Council of the City of Emeryville adopt the above-entitled resolution to reject all bids, approve a revised scopes of work for the 40th Street Bridge Railing Painting, Lumec Light Pole Painting, and Marina Lighting Replacement Project, and authorize the City Engineer to advertise these projects for public bids.
