SUBJECT:

Discussion On Whether To Add A Special Meeting Of The City Council Of The City Of Emeryville To A Date And Time In August As Directed By The Council For The Purpose Of Considering Making Findings To Continue Meeting Remotely Recommendation
Staff recommends that the City Council provide direction to staff on whether to schedule a special Council meeting during the month of August, at a date and time to be determined that is within the necessary timeframe.

Background
The City Council/MESA/Successor Agency have a scheduled summer recess for the month of August, with no meetings planned. The last meeting date before the break is on July 19th and the first meeting following the break is on September 6th, which amounts to a 49-day span and thereby exceeds the AB 361 requirement for findings to be made every 30 days. If there is a desire to consider making findings to continue using the Brown Act exemptions afforded by AB 361 for meetings in September and beyond, special meetings of each entity should be added on a date during the timeframe between August 8th and 18th in order to stay in compliance with the 30-day interval requirement.

Based on direction given at the July 5, 2022, meeting, staff has prepared this opportunity for the Board to add a special meeting on the August date and time that is most convenient, for the sole purpose of making the AB 361 findings.

Discussion
Pursuant to AB 361, the City Council and its entities are required to make findings of necessity to continue holding meetings remotely in order to ensure the health and safety of the public. Accordingly, staff recommends that the Council add a special meeting on a date that falls between August 8th and August 18th, at such time as directed by the Board. The proposed special meetings will take place virtually.

Fiscal Impact
There is no fiscal impact.
