Discussion On Whether To Amend Section 2-2.201 Of Article 2 Of Chapter 2 Of Title 2 Of The Emeryville Municipal Code Regarding An Increase In City Council Member Salaries Recommendation
This report offers the City Council the opportunity to discuss whether to add a future agenda item to consider amending the Emeryville Municipal Code as described in the title above.

Background
At the July 5, 2022, regular City Council meeting, Council Member Martinez requested and received majority support that an item be added to a future City Council meeting agenda for the Council to discuss whether to consider taking action to increase City Council Member salaries by 5%.

Discussion
Council Member salaries are established in Section 2-2.201 Of Article 2 Of Chapter 2 Of Title 2 Of the Emeryville Municipal Code, included as Attachment A to this staff report. Amendment of this Section would require introduction and adoption of an ordinance. The salaries of the Council Members were last increased to $1,157.39 per month, effective January 5, 2017 (Ordinance No. 16-012).

Section 36516 of the California Government Code, also attached, establishes maximum compensation levels of council members based on the population of the city. A City Council may increase the amount provided in subdivision (a)(1) by enacting an ordinance or amending an existing ordinance. Section 36516(c) allows for an increase in the council member’s monthly salary not to exceed five percent (5%) for each calendar year from the operative date of the last salary adjustment. Such increases may only occur when at least one council member commences a new term.

As noted, pursuant to Government Code section 36516.5, the salary adjustment may only become effective upon the beginning of a new term of office of one or more of the members of the council. The new term would commence upon certification of results following the November 8, 2022, election, for which there are two Council seats being contested.

Fiscal Impact
There will not be a fiscal impact to having this discussion.

Staff Communication with the Public
This item was requested by Council Member Martinez at the July 5, 2022, meeting.

Conclusion
Whether to discuss the matter and provide staff direction is at the Council’s discretion.
