SUBJECT:
Resolution Of The City Council Of The City Of Emeryville Appropriating $72,508 From The Economic Development Fund (Fund 202) To The Operating Budget For Fiscal Year 2022-2023 (Account 202-87380) For A Previously Awarded Façade Grant For Daryl M. Rush Builder – Grand Craftsman Supply Recommendation
Staff recommends that the City Council adopt the above-entitled resolution to appropriate funds from the Economic Development Fund (Fund 202) to the Operating Budget for Fiscal Year 2022-2023 for the Façade Grant Program (Account 202-87380) for a Façade Grant previously awarded to Daryl M. Rush Builder – Grand Craftsman Supply.
Background
On May 16, 2017, the City Council adopted Resolution No. 17-73, establishing a revived Façade Improvement Grant Program (“Program”). The primary intent of the program was to encourage business retention and development, and it is included in the City’s Economic Development Strategy as a priority action in the “Marketing and Incentives” area.
On May 1, 2018, the City Council passed Resolution No. 18-44, which authorized the City Manager to execute Façade Improvement Grant Program Contracts (“Contracts”) with five awardees as recommended by the Economic Development Advisory Committee (EDAC) for Round I of the Program.
On July 11, 2019, a Selection Panel met to review the applications received for Round II and scored the applications based on the criteria set forth in the Program Guidelines. The EDAC met on September 18, 2019, and recommended that the City Council award funds to the top three applicants. On November 19, 2019, the City Council adopted Resolution No. 19-155 awarding funds to the top two applications: Campaign Furniture for $71,632, and Daryl M. Rush Builder – Grand Craftsman Supply (“Daryl Rush”) for $72,508. In early 2020, the application from Campaign Furniture was deemed withdrawn; the business later relocated from Emeryville, and a Grant Recipient Agreement was executed between the City and Daryl Rush to complete Round II of the Program.
Additional rounds of the Façade Grant Program were suspended pending program revisions, and funds in Fiscal Years 2021 and 2022 were redirected to other business support activities.
Discussion
Daryl Rush informed staff that, due to various issues related to the COVID-19 pandemic, completion of the façade improvement project has been delayed, and he requested additional time. In May 2022, staff initiated an amendment of the Grant Recipient Contract to extend the time period for project completion to January 2023; however, due to an oversight during the budget development process, staff did not include funds in the Fiscal Year 2022-2023 Operating Budget for the Façade Grant Program.
Staff is requesting that the City Council re-appropriate $72,508 from the Economic Development Fund (Fund 202) to the Fiscal Year 2022-2023 Operating Budget for the Façade Grant Program to allow completion of this final Façade Improvement Grant Program Contract.
FISCAL IMPACT
The recommended action appropriates $72,508 from the Economic Development Fund (Fund 202) to the Fiscal Year 2022-2023 Operating Budget for the Façade Grant Program (Account 202-87380) and has no impact on the General Fund. The funds for this last remaining Façade Improvement Program Grant Contract were originally budgeted in Fiscal Year 2019-2020 and appropriations were included in each subsequent Fiscal Year until Fiscal Year 2021-2022. This action would restore the appropriation in Fiscal Year 2022-2023 allowing for completion of the previously-awarded grant.
ConclusioN
Staff recommends the City Council adopt the attached resolution re-appropriating $72,508 from the Economic Development Fund (Fund 202) to the Operating Budget for Fiscal Year 2022-2023 for the Façade Improvement Grant Program (Account 202-87380) to allow for completion of the Façade Improvement Grant Agreement for Daryl M. Rush – Grand Craftsman Builder Supply.
