Resolution Of The City Council Of The City Of Emeryville Approving The Purchase Of Artworks For The City’s Annual Purchase Award Program Entitled “Ant, Grasshopper, Mosquito, and Stag Beetle” By Emeryville Artist Ken Kalman With Funding Of Up To $26,100 From The Public Art Fund (Fund 243) For The Purchase And Installation Of The Artworks And Acknowledging Cesar Cuerva And Tali Grinshpan As The First And Second Honorable Mentions
WHEREAS, Article 4 of Chapter 2 of Title 3 of the Emeryville Municipal Code establishes the Contributions for the Art in Public Places Program (“Public Art Ordinance”); and WHEREAS, Section 3-2.404 of the Emeryville Municipal Code establishes the Emeryville Public Art Fund to implement the Art in Public Places Program; and WHEREAS, the City has implemented the annual Purchase Award Program since 2006 in connection with the annual Emeryville Celebration of the Arts Exhibition (“Art Exhibit”); and
WHEREAS, a five-person Selection Panel made up of 1) Xan Walker as the Public Art Committee (“PAC”) member; 2) Ronald Davis as a community member; 3) Charmin Roundtree-Baaqee as outside arts professional; 4) Albert Repola as Emeryville Celebration of the Arts Board Representative; and 5) Josie Ahrens as City staff representative. was appointed by the City Manager on September 20, 2022, based on the September 8, 2022 recommendation of the PAC, to review the Art Exhibit art works and make a recommendation on the selection of an art work to the PAC, for consideration by the City Council; and
WHEREAS, the Selection Panel convened on October 6, 2022, to review the art works and has made a recommendation to purchase the artworks “Ant, Grasshopper, Mosquito, and Stag Beetle” by Emeryville artist Ken Kalman, and “Manongs: Straight Outta Delano” and “Pinay Power” by Cesar Cuerva, and to select the art work “Explore” by Tali Grinshpan as the First Honorable Mention; and
WHEREAS, on October 6, 2022, the PAC voted to recommend that the City Council approve only the purchase of Ken Kalman’s work and acknowledge both Cesar Cuerva and Tali Grinshpan as First and Second Honorable Mentions, respectively; and WHEREAS, funding in an amount of $26,100 is necessary to cover the purchase ($14,200), installation ($3,000), and administrative costs (up to $8,900) associated with the artwork selection, and is available in the Public Art Fund (Fund 243) Operating Budget for Fiscal Year 2022-23; now, therefore, be it

RESOLVED, that the City Council of the City of Emeryville hereby approves the purchase of “Ant, Grasshopper, Mosquito, and Stag Beetle” by Ken Kalman, for the sixteenth Annual City of Emeryville Purchase Award Program, and acknowledges the art works “Manongs: Straight Outta Delano” and “Pinay Power”, by Cesar Cuerva as the First Honorable Mention, and the art work “Explore”; by Tali Grinshpan as the Second Honorable Mention.
