Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Approve A First Amendment With The California Department Of Transportation (Caltrans) To The Agreement For Maintenance Of State Highways In The City Of Emeryville As It Relates To The Construction Of The Storm Drain Large Trash Separator Project, Project No. EPW-18107 (CIP No. 18475009) Recommendation
Staff recommends that the City Council adopt the above resolution.
Background
The City of Emeryville is a Permittee of the San Francisco Regional Water Quality Control Board’s Municipal Regional Permit (MRP), which regulates the management of stormwater within the city. Among other requirements, the MRP requires Permittees to capture 100% of trash on land and in the storm drain system by June, 2025. The City’s Long-Term Trash Reduction Plan specifies actions to be implemented to address trash capture; it calls for installation of trash recovery units in the stormwater system. This project will help the City reach its MRP requirements by strategically capturing and cleaning stormwater flowing from areas within the City’s highest trash generation area.
In 2018, the City contracted with Schaaf and Wheeler Consulting Civil Engineers to study potential trash capture sites. The study identified a site near the intersection of Emery Street and West MacArthur Boulevard as a feasible installation location. In 2021, the City received $680,000 in funding from The California Department of Transportation (Caltrans) through a Cooperative Implementation Agreement (CIA), as this project will treat stormwater run-off from Caltrans’ right of way on San Pablo Avenue, a high trash generating area. That agreement requires construction to be complete and Caltrans to be fully invoiced by May 1, 2023.
On July 5, 2022 the City Council authorized the City Engineer to advertise the construction project for public bidding and to purchase equipment necessary for installation. A proposed contract for construction will be considered at this meeting of the City Council.
Since the project will take place on Caltrans right of way (on property adjacent to the north side of MacArthur Boulevard midway between Emery Street and Hollis Avenue), the City has applied for an encroachment permit with Caltrans for the installation of the trash separator unit. As a condition of issuing that permit, Caltrans has proposed the attached amendment to the City’s 1989 Maintenance Agreement with Caltrans for maintenance of their right of way.
Discussion
The 1989 Maintenance Agreement (“Agreement for Maintenance of State Highways in the City of Emeryville”) between Caltrans and the City of Emeryville is attached here, as is the proposed “Amendment Number 1.” The proposed amendment makes just one change: it adds one item to page 6 of the original agreement, as follows:
“City will maintain improvements constructed under and Encroachment Permit including, but not limited to: landscaped areas or other ornamental plantings; sidewalks; curbs and gutter; non-state standard materials; non-state standard equipment; pavement markings or pavement treatments in and near crosswalks; and any items installed in drainage structures (including trash capture device), at no cost to the State.” The requirement to maintain this improvement is already a condition of the funding agreement (CIA), so this change simply codifies that requirement into the overall Maintenance Agreement.
Staff recommends that the City Council authorize the City Manager to approve the proposed amendment to the “Agreement for Maintenance of State Highways in the City of Emeryville.” Fiscal Impact
There are no new or unforeseen costs associated with the execution of this amendment to the Maintenance Agreement.
Maintenance costs for the hydrodynamic separator unit is anticipated to be $1200 per year; which has been discussed and accounted for in the development and City Council approval of this project.
Staff Communication with the Public
None.
Conflict of Interest
Not applicable.
Conclusion
Staff recommends that it is in the public’s interest for City Council to adopt the above-titled resolution.
