ResolutiRe Resolution Of The Board of Directors Of Management of Emeryville Services Authority Approving A Side Letter of Agreement Between the MESA and SEIU Regarding Dispatch Shift Differential Resolution Resolution Of The City Council Of The City Of Emeryville Approving And Consenting To A Side Letter of Agreement Between The Management Of Emeryville Services Authority (MESA) And SEIU Regarding Dispatch Shift Differential Recommendation
Staff recommends that the Board of Directors and City Council adopt the above-entitled resolutions.
Background
The Dispatch Unit within the Police Department has been working a traditional work schedule of eight (8) hours per day five (5) days per week for a number of years. There has been interest by Police Management and Dispatch staff to offer an additional alternative work schedule of 10 hours per day, four (4) days per week.
Discussion
Recently, Police Management and Dispatch staff developed an alternative work schedule to include both the option of eight (8) hours per day, five (5) days per week and 10 hours per day, four (4) days per week. However, adding an alternative 4/10 work schedule will result in a need to adjust the timing of work schedules to start on the hour instead of the previous timing of 50 minutes after the hour impacting the current SEIU, Local 1021 MOU Section 3.10 Shift Differential language.
SEIU, Local 1021 MOU Section 3.10 Shift Differential currently indicates that the payment of a five percent (5%) shift differential shall be based on hours worked between the hours of 5:50 p.m. and 5:50 a.m. Adding a 4/10 work schedule will result in shift differential start and end times being modified from 5:50 p.m. through 5:50 a.m. to 6:00 p.m. through 6:00 a.m.
SEIU has reviewed the side letter of agreement and had no feedback.

Conclusion
Addition of the Dispatch Unit alternative work schedule of 10 hours per day, four (4) days per week will result in the need to adjust the timing of work schedules to start on the hour. This work schedule change will require modification of SEIU, Local 1021 MOU Section 3.10 Shift Differential from 5:50 p.m. through 5:50 a.m. to 6:00 p.m. through 6:00 a.m.
