Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Accept Award Funds From Volkswagen Environmental Mitigation Trust To Purchase One 15 Passenger Max Capacity Wheelchair Accessible Electric Vehicle (EV) Bus, In An Amount Not To Exceed $173,118, From Green Power Motor Company And Transfer $13,368.00 From Fund 660-91200 To Fund 254 And Appropriate VW Funds Of $160,000.00 To Fund 254 When Received Recommendation
Staff recommends that the City Council approve the above-entitled resolution.

Background
The City of Emeryville received notice that all existing vehicles over 14,001 GVWR with a 2007-2009 engine will no longer be compliant with Truck and Bus Regulations and, as a result, DMV registration will be automatically denied for these vehicles effective January 1, 2023. As a result, the City will need to replace its 2008 wheelchair accessible bus for the Senior Center to continue to maintain its comprehensive day-trips program and support other City services and programs.

The California VW Mitigation Trust Fund provides $130 million in funding for public and private agencies to replace older, high-polluting vehicles and buses with new battery-electric or fuel cell vehicles and buses. Eligible applicants must be owners of transit buses, school buses and shuttle buses, and the vehicle being replaced must be removed from service to qualify for the grant. The maximum amount of grant funds that can be awarded for a replacement shuttle bus is $160,000.

Discussion
On June 21, 2022, the City Council authorized the City Manager to submit an application to the Volkswagen Environmental Mitigation Trust Fund. The City applied for funding on July 6, 2022, and was awarded $160,000 on October 28, 2022, for the purchase of a new EV bus.

Staff conducted a formal bid process in August 2022 which resulted in two bids received from A-Z Bus Sales, Incorporated for $311,150.16, and from Green Power Motor Company for $173,118.

Staff recommends purchasing a 15-passenger ADA Electric Vehicle from the lowest bid submitted, Green Power Motor Company, that meets all trust fund requirements, and the needs of Emeryville’s green initiatives for $173,118. The City estimates that an additional amount of $13,118 will need to be appropriated from the Vehicle Replacement Fund to cover the difference.

The City will decommission the existing shuttle bus upon receipt of the new EV bus at a cost of $250.

Fiscal Impact
The grant awarded is $160,000. An additional $13,368 needs to be appropriated from the City’s vehicle replacement fund, 660-91200, to fully fund this purchase for an amount not to exceed $173,118 and transfer $13,368.00 from fund 660-91200 to fund 254 and appropriate VW funds of $160,000.00 to fund 254 when received.

Staff Communication with the Public
There was no communication with the public.

Conclusion
Staff recommends that the City Council approve the above-entitled resolution.
