MEMORANDUM
DATE:

December 12, 2022
TO:

Adam Politzer, Interim City Manager
FROM:

Trish Raver, Director of Human Resources
SUBJECT:

Resolution Of The City Council Of The City Of Emeryville Authorizing An Amendment To The Staffing Summary For The Fiscal Year 2022-2023 Operating Budget For The Addition Of A Community Preservation Officer Position And A Management Analyst Position

RECOMMENDATION
Staff recommends that the City Council adopt the above-referenced resolution.

BACKGROUND
On June 7, 2022, the operating budget for Fiscal Year 2022-2023 which included a staffing summary was adopted by the City Council. However, since that time the need has arisen to adjust staffing in the Community Development and Human Resources Departments.

In 2012, the Community Development Department had a Community Preservation Officer position who was responsible for developing, administering and managing a comprehensive code enforcement program for the rehabilitation and maintenance of private, residential and commercial properties. Due to the economic downturn in 2012, the position was laid off resulting in no specific staff position being responsible for the management of code enforcement activities.

In March 2020, Measure F, the quarter-cent sales tax, was approved by the Emeryville voters with Community Preservation Officer as one of the areas to be funded. This funding has opened up an opportunity to add a Code Enforcement position to the City’s staffing levels.

From the early 2000s to 2010, the Human Resources Department had an additional Human Resources Technician position. As a cost-saving measure, the position was never backfilled once vacated in 2010. Throughout the past 12 years, Human Resources has absorbed many functional areas and administrative duties including risk management and emergency operations services, the payroll function, and City Hall front desk operations with no additional staffing.

DISCUSSION/ANALYSIS
Community Preservation Officer
In 2012, a Community Preservation Officer position was allocated in the budget and housed in the Economic Development Department. During FY2012, the position was laid off due to the economic downturn.

The City Council has identified building a Code Enforcement Program as one of their major Goals and Priorities. In March 2020, Measure F was passed by voters identifying Code Enforcement as one of the areas to be funded to assist with ensuring, among other areas, that local buildings are safe and up to code. Measure F funding has opened up an opportunity for the City Council’s goal of building a Code Enforcement Program to become a reality with the proposed addition of a Community Preservation Officer position.

Currently, there is no specific position within the City to respond to complaints regarding a variety of code violations, ranging from building code to zoning to noise. Having one (1) Community Preservation Officer position to respond to all code related inquiries and complaints is the most streamlined way to ensure that complaints are managed in a consistent, timely and effective manner.

Staff recommends adding a Community Preservation Officer position in the Building Division of the Community Development Department to the FY 2022-2023 staffing summary. Additionally, staff recommends modifying the title associated with classification code 1805 from Community Preservation Officer to Code Enforcement Officer to best capture the duties the position will perform.

Management Analyst
Due to understaffing in the Human Resources Department, the Human Resources Director has been tasked with most of the day-to-day analytical support for the core functional areas of benefits administration, classification and compensation, employee and labor relations and records management.

Modifying the staffing summary in the Human Resources Department to add a Management Analyst position will assist the Human Resources Director in administering benefits plans and updates, conducting and analyzing classification and compensation related studies, participating as a member of the management team for labor negotiations including drafting and costing proposals, assisting and making recommendations regarding employee relations issues, and overseeing the management of records.

Staff recommends adding a Management Analyst position to the FY 2022-2023 staffing summary to fill the staffing gap in the Human Resources Department to ensure that there is adequate day-to-day professional level support for the above indicated human resources functional areas.

Additional Discussion/Analysis
On Wednesday, November 30, 2022, the Budget and Governance Committee met and discussed and reviewed the addition of the Community Preservation Officer and Management Analyst positions. At that meeting, the Committee recommended approval of both positions.

FISCAL IMPACT
The Community Preservation Officer position has as an annual cost of approximately $200,000. The Management Analyst position has an annual cost of approximately $173,100. The approximate annual total for both positions is $373,100. Measure F will fund Community Preservation Officer position at approximately $200,000. The general fund will supply funding to the Management Analyst position, and there is adequate funding in the FY 2022-2023 budget to cover the position.

Staff will reassess staffing costs for the mid-term budget review in January 2023 and determine any necessary budget adjustments for FY 2023-24.

CONCLUSION
I recommend that the City Council adopt the attached resolution approving an amendment to the staffing summary for FY 2022-2023 Operating Budget to add a Community Preservation Officer (Code Enforcement Officer) position and a Management Analyst position.
