Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A Contract With Euro Style Management In An Amount Of $1,658,878.00; Authorizing The City Manager To Approve Payments Of Possible Additional Costs As Contingency Expenditures Up To $165,000, All For The Construction Of The 40th Street Bridge Railing And Lumec Light Pole Painting Project, Project No. EPW-20103 (CIP No. 15475015 And 15475028); Appropriating And Transferring $844,038 From The General Fund 101 Into Fund 475 For CIP No. 15475015
WHEREAS, on December 21, 2021, the City Council approved a scope of work and authorized the City Engineer to advertise for public bids for the 40th Street Bridge Railing and Lumec Light Pole Painting Project, EPW-20103 (“Project”), (CIP No. 15475015 And 15475028); and
WHEREAS, on March 1, 2022, the City Council approved a scope of work and authorized the City Engineer to advertise for public bids for a combined project with Marina Park and Powell Street Lighting Project (CIP No. 17495012); and
WHEREAS, on June 28, 2022, three bids were received for the combined projects with the lowest responsive bid being 91.6% greater than the engineer’s estimate. On July 19, 2022, the City Council rejected all bids and approved the revised scope of work to separate the projects back into their original scope (Resolution No. 22-105); and WHEREAS, the Project was re-advertised on October 26, 2022, in compliance with California Public Contract Code section 20162; and
WHEREAS, on November 17, 2022, the following bid proposals were received:
1. Euro Style Management $ 627,428.00
2. Color New Company $ 913,758.00
3. OnPoint Construction $1,050,335.00; and
WHEREAS, the lowest responsible bid for the Project was submitted by Euro Style Management of Sacramento, CA for $627,428.00 with an additional $1,031,450.00 in add alternative bid items; and
WHEREAS, Staff recommends that it is in the City’s best interest to move forward with this contract including the add alternative bid items; and WHEREAS, in compliance with California Public Contract Code section 20162, the City Council must award a public works contract in excess of $5,000 to the lowest responsible bidder; and
WHEREAS, $844,038 of unallocated funds from the General Fund 101 needs to be appropriated and transferred into Fund 475 for CIP No. 15475015 in order to provide adequate funding for the Project; now, therefore, be it DocuSign Envelope ID: 325644D0-BC8F-4C70-87B1-3525E480D133 Resolution No. _____

RESOLVED, by the City Council of the City of Emeryville that Euro Style Management is the lowest responsive bidder, and the City Manager is hereby authorized to enter into the attached contract with Euro Style Management in an amount of $1,658,878.00 for the 40th Street Bridge Railing and Lumec Light Pole Painting Project, EPW-20103 (“Project”), (CIP No. 15475015 And 15475028); and, be it, further
RESOLVED, by the City Council of the City of Emeryville that the City Manager is authorized to augment the contract amount by a contingency amount not to exceed $165,000 as warranted from new and/or unforeseen matters related to Project completion; and, be it, further
RESOLVED, by the City Council of the City of Emeryville that $844,038 of unallocated funds from the General Fund 101 are appropriated and transferred into Fund 475 for CIP No. 15475015.
