Resolution Of The City Council Of The City Of Emeryville Appointing _________ To The Office Of City Council Member With A Term Expiring December 2024 WHEREAS, on January 15, 2023, a City Council Member seat became vacant due to the resignation of a City Council Member; and
WHEREAS, Government Code section 36512 governs Emeryville City Council vacancies and requires that, upon the occurrence of a vacancy, the Council must, within 60 days, do one of the following: call a special election to be held at the next regular election 114 days or more from the call for the special election, or appoint someone to fill the vacancy; and
WHEREAS, on January 17, 2023, the City Council chose to appoint someone to fill the vacancy and directed staff to open an application period for 15 days, from January 27- February 10, 2023; and
WHEREAS, the City Clerk caused notice of these facts to be published pursuant to Section 6061 of the California Government Code; and
WHEREAS, after the close of the application period, the City Council interviewed all applicants that completed the application questions, and selected an applicant to appoint to the vacant City Council Member seat; now, therefore, be it RESOLVED, by the City Council of the City of Emeryville that the recitals set forth above are true and correct; and be it further
RESOLVED, that the City Council of the City of Emeryville hereby appoints ___________ to the office of City Council Member with a term expiring December 2024; and be it further RESOLVED, that the person herein appointed shall qualify, take office, and serve exactly as if elected at a municipal election for the office.
