Resolution Of The City Council Of The City of Emeryville Authorizing The City Manager To Enter Into A First Amendment To The Contract With Cal Engineering & Geology, Inc. To Increase The Total Compensation Amount By $14,958.21 For A Total Not To Exceed Amount Of $166,863.21 For The Point Emery Shoreline Protection Project, Project No. EPW-18101 (CIP No. 16475021) Recommendation
Staff recommends that the City Council adopt the above resolution.
Background
The Point Emery Shoreline Protection Project is a Capital Improvement Program project, EPW 101-18 (CIP #16475021), designed to maintain and preserve existing park land in danger of erosion from tidal and wave action. The project has installed erosion control measures that includes the installation of boulders along the shoreline. Project construction is substantially complete with the only items remaining being the installation of bollards and a bike parking pad.
In order to manage the construction work, a construction management firm was used to provide on-site management of the construction process, manage the project schedule and budget, ensure that the project meets quality standards, ensure compliance with safety regulations during construction, and comply with the plans and specifications of the project contract.
On February 11, 2022, an agreement was executed with Cal Engineering and Geology to carry out the above-mentioned construction management services.
In order to work along the bay shoreline, local jurisdictions are required to obtain a permit from the Bay Conservation and Development Commission or BCDC. The City of Emeryville is authorized to perform project work under BCDC permit number 2019.002.00 and permit number 2019.002.01, Amendment 1. BCDC also acts as an intermediary for other government agencies that have jurisdiction over the shoreline. National Marine Fisheries Service is one such agency, which as a requirement of the overall BCDC permit, requires an eel grass survey upon completion of the project. .
Discussion
Due to material scarcity the project duration extended further in time than was originally factored into the construction management contract amount. The project duration additionally pushed beyond the allowable post-construction eel grass survey which expired on November 15, 2022. An increase in the contract amount of $14,958.21 is required for Cal Engineering and Geology to cover costs incurred by the longer project duration and to complete the post construction eelgrass survey in April 2023 as required by National Marine Fisheries Service. Upon completion and analysis of the eelgrass survey, staff will submit the project to City Council for acceptance in June 2023.
Fiscal Impact
Funding for the proposed amendment is available under project 16475021 Fund 475.
