Staff recommend that the City Council approve the above Resolution.

Background
On May 11, 2022, under Order No. R2-2022-0018, the California Regional Water Quality Control Board, San Francisco Region (Regional Water Board), issued Municipal Regional Stormwater NPDES Permit (MRP) number CAS612008, regulating stormwater management in all Bay Area jurisdictions with separate stormwater management systems, including Emeryville. Among the requirements set forth in the MRP, some require staffing and/or expertise beyond the capacity of City staff. This contract is for services related to MRP Sections C.3.h (New Development and Redevelopment Operation and Maintenance Inspections), C.4 (Industrial/Commercial Site Controls), and C.10 (Trash Load Reduction Assessment and Reporting).

Staff issued a Request for Proposals to four qualified firms in March 2023; EOA Inc. was the only firm that submitted a bid proposal. The EOA, Inc. proposal met requirements and the company has satisfactorily provided these services to the City under previous contracts.

Discussion
C.3.h New Development and Redevelopment Operation and Maintenance Inspections.

The requirements of Section C.3.h include on-site inspections of stormwater treatment measures installed on private property at least once every five years, and more frequently for some designs. As the number of stormwater treatment measures grows with each new development or major renovation, the number of inspections also increases, along with time requirements for follow-up and technical assistance as needed.

C.4 Industrial/Commercial Site Controls
The City is required to inspect all businesses that have a reasonable likelihood to be sources of pollutants to stormwater at intervals of one to five years, depending on the level of risk. Emeryville has close to 200 businesses that meet this requirement, and roughly 50 are inspected each year.

C.10 Trash Load Reduction Assessment and Reporting
Each Permittee, including the City of Emeryville, is required to reduce trash discharges into the storm drain system from litter and other sources. The previous MRP required Permittees to reduce their trash discharges by at least 70% by July 2017 and 80% by July 2019; Emeryville met both of these requirements. This MRP requires 90% reduction in trash discharges by July 2023 and 100% by July 2025. In order to achieve this 100% goal, techniques including street sweeping, trash pickups, the installation and maintenance of trash capture devices in storm drain inlets, and large-scale in-line trash capture devices are used. To document the efficacy of these trash capture strategies, and to plan future interventions, the Regional Water Board has instituted methods of visual trash assessment and quantification. EOA, Inc. staff work with the Regional Water Board to develop and streamline these processes and have the expertise necessary to pinpoint areas where additional visual assessments and/or interventions are necessary to meet these targets and goals.

Fiscal Impact
The contract amount is $274,200 to be allocated over three years and three months, with a term expiration date of September 30, 2026. This end date is designed to allow for EOA, Inc.’s input on the City’s required Annual Report to the San Francisco Regional Water Quality Control Board, due each year in September. These tasks are budgeted at $90,000 each year in Account Number 4050-77060, Non-Point Discharge Expenses, and $1,400 each year in Professional Services, Account Number 4050-80050.

At the City’s option, based on contractor performance, this contract may be extended for up to two one-year periods in the amount of $90,000 per year. The City Manager is authorized to approve these contract extension(s) and associated allocation(s) of funds, for a total cost not to exceed $454,200 over five years.

Staff Communication with the Public
The requirements of the MRP are discussed at public meetings at the Regional Water Board during the development of each Permit cycle. In addition, each city’s Annual Report on Permit compliance is available to the public through the Regional Water Board’s Website.

Conclusion
Maintaining compliance with the increasingly stringent requirements of the MRP requires increasing effort and expertise. EOA, Inc. has been a responsive and capable provider of this effort and expertise and was the only bidder for this contract.
