Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Execute A First Amendment To The Maintenance Services Agreement With Precision Concrete Inc. To Increase The Total Compensation By $208,000 For A Total Amount Not To Exceed $253,000 For On-Call Sidewalk Survey And Repairs As Part Of The Sustainable Streetscapes Project (SUT-01) And To Extend The Contract Term To December 31, 2026 Recommendation
Staff recommends adopting the above titled resolution.

Background
In Fiscal Year 2021/22, the City contracted with Precision Concrete Cutting to perform a project to saw-cut trip-and-fall hazards and to identify concrete sidewalks needing removal and replacement. This initial work was completed in Fiscal Year 2021/22 City-Wide. The saw-cut scope was limited to sidewalks west of Interstate-80 and for spot locations throughout the City. The scope did not include funding for saw-cut repairs City-wide. However, the scope included the task of identifying sidewalks requiring saw-cut “make-safe” rehabilitation and sidewalks requiring removal and replacement City-wide. This City-wide survey and conditional assessment has been completed. The City has generally maintained sidewalks on the frontages of low-density residential properties.

The Capital Improvement Program adopted by the City Council in June 2023 includes funding for Sustainable Streetscapes (SUT-01) including rehabilitation and maintenance of City streets and to ensure that City sidewalks meet ADA obligations.

Discussion
This contract amendment will approve funding for two key scope items: saw-cutting the sidewalks in front of low-density residential properties identified as part of the City-wide survey, and on-call sidewalk trip-and-fall rehabilitation services. The amendment will extend the term of the agreement for on-call services through December 31, 2026.

The purpose of the saw-cutting is to improve the safety of the sidewalks by eliminating defects that make the facilities non-compliant with ADA standards of construction. Furthermore, mitigating the defects minimizes or eliminates trip-and-fall hazards on the sidewalks that commonly lead to claims against the City. In addition, having the contractor on an on-call basis will allow the City to respond to public complaints in an expeditious manner by surveying the general location provided in the complaint and potentially remedying the hazard if any are identified. The contractor’s proprietary saw-cutting technology will also minimize sidewalk closure time during rehabilitation as compared to traditional saw-cutting methods.

Fiscal Impact
The itemized costs for the First Amendment contract are as follows:

Saw-Cutting Rehabilitation Identified by Survey……………………… $108,000.00 On-Call Sidewalk Survey and Saw-Cutting…………………………… $100,000.00 Original Agreement Funding …………………………………………… $ 45,000.00 ________________________________________________________________ Total ……………………………………………………………………… $253,000.00
Staff is proposing to increase the contract amount by $208,000.00. Funding for this contract amendment is available in CIP # SUT-01 Sustainable Streetscapes.

Staff Communication with the Public
The staff has had no communication with the Public.
