Resolution Of The City Council Of The City of Emeryville Approving An Update To The City Of Emeryville’s Title VI Program And Assurances WHEREAS, the City of Emeryville is a subrecipient of Federal Transit Administration (FTA) financial assistance from the Alameda-Contra Costa Transit District (AC Transit); and
WHEREAS, all FTA recipients and subrecipients must ensure that their programs, policies, and activities comply with Title VI regulations, as described in FTA Circular 4702.1B; and
WHEREAS, Section 601 of Title VI of the Civil Rights Act of 1964 states: “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance”; and WHEREAS, the City of Emeryville is neither a transit operator nor a direct recipient of FTA funds; and
WHEREAS, on June 2, 2015, the City Council of the City of Emeryville adopted Resolution No. 15-051 approving the City Of Emeryville’s Title VI Program and Assurances; and
WHEREAS, AC Transit has, on behalf of FTA, requested the City of Emeryville as subrecipient to update the Title VI Program and Assurances on a triennial basis for the life of the project for which the grant funding is used; now therefore, be it RESOLVED, that the City Council of the City of Emeryville hereby approves the revised Title VI Program and Assurances attached hereto as Exhibit A; and be it further RESOLVED, that the City Council of the City of Emeryville hereby authorizes the City Manager to make amendments and updates to the Title VI Program and Assurances as required to effectuate compliance with FTA and AC Transit requirements; and be it further RESOLVED, that City of Emeryville and its agents shall comply with the Title VI requirements.
