Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Execute A Professional Services Contract With ABG Art Group For Rotten City Emeryville Cultural Arts District Programs In An Amount Not To Exceed $615,000, To Be Funded By California Arts Council Cultural District Program Funding
WHEREAS, on March 21, 2017, the City Council adopted Resolution No. 17-38 authorizing an application to the California Arts Council’s (CAC) California Cultural Districts Pilot Program; and
WHEREAS, following a robust and inclusive application process, on July 10, 2017, the CAC awarded the Rotten City-Emeryville Cultural Arts District (the “District”) an official State designation; and
WHEREAS, on March 15, 2023, the CAC announced grants of $671,429 for the period July 1, 2022 to June 31, 2025 for each of the 14 existing officially recognized Cultural Districts; and
WHEREAS, on May 2, 2023, the City Council adopted Resolution No. 23-51, authorizing the execution of a Standard Agreement with the CAC for $671,429 in grant funds for the District; and
WHEREAS, the grant funds provided by the CAC are to support the promotion, marketing, activities and administrative costs associated with the District to the benefit of the City’s creative economy; and
WHEREAS, consulting services are needed to complete the activities funded by the CAC grant funds; and
WHEREAS, on July 6, 2023, staff distributed a request for letters of interest from individuals and firms to provide the required consultant services, with responses due July 18, 2023; and
WHEREAS, on August 24, 2023, staff distributed a request for cost proposals to respondents to the request for letters of interest, with responses due September 19, 2023; and
WHEREAS, on October 13, 2023, a panel of three District Advisory Group members and staff interviewed a short list of two respondents and recommended the City engage ABG Art Group for their proposed scope of work, except for tasks associated with support of the Art Center project, for which the panel recommended engaging Art is Luv/J.

Cultural District Program Contract

RESOLVED, that the City Council of the City of Emeryville hereby authorizes the City Manager to execute the Professional Services Contract with ABG Group to provide Rotten City Emeryville Cultural District Programs in substantially the form attached hereto as Exhibit A; and be it further
RESOLVED, that the City Council of the City of Emeryville hereby authorizes the City Manager to execute amendments to the Contract as needed to effectuate its purposes, provided such amendments do not materially increase the City’s obligations thereunder.
