Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A Professional Services Agreement With MNS Engineers, Inc. In An Amount Not To Exceed $1,050,000 For On Call Construction Management, Engineering Design, And City Engineer Support Services Until June 30, 2027, Extend The Contract To No Later Than December 18, 2028, And Increase The Contract Amount By No More Than An Additional $950,000 By Additional Contract Amendments For A Total Not To Exceed Amount Of $2,000,000 WHEREAS, the City is in need of Construction Management, Engineering Design, and City Engineer Support Services; and
WHEREAS, these Services are critical for the delivery of the 2023-28 Capital Improvement Program; and
WHEREAS, these Services are especially critical for the delivery of the Sustainable Streetscapes Project #SUT-01; and
WHEREAS, the Sustainable Streetscapes Project is a critical mechanism for implementation of the City’s Active Transportation Plan (ATP); and WHEREAS, the City finds that specialized knowledge, skills, and training are necessary to render the services necessary to do the work contemplated under this Agreement; and
WHEREAS, on November 2, 2023, the City advertised an RFQ for Construction Management, Engineering Design, and City Engineer Support Services and MNS Engineers Inc. (Consultant) was selected as the most qualified firm to carry out the required work; and
WHEREAS, the City has determined that the Consultant is qualified by training and experience to render such services; and
WHEREAS, the Consultant desires to provide such services; and, WHEREAS, the public interest will be served by this Agreement; and WHEREAS, the proposed Professional Services Agreement with the Consultant is in an amount not to exceed $1,050,000 and the City Manager would be authorized to increase the contract amount by no more than an additional $950,000 for a total not to exceed amount of $2,000,000; and
WHEREAS, the contract term for the proposed Professional Services Agreement with the Consultant is until June 30, 2027 which the City Manager would be authorized to extend until December 18, 2028; and

WHEREAS, there is sufficient funding appropriated as part of the FY 2023-28 Capital Improvement Program to cover the cost of the Professional Services Agreement; now, therefore, be it
RESOLVED, that the City Council of the City of Emeryville authorizes the City Manager to enter into a Professional Services Agreement with MNS Engineers, Inc. in an amount not to exceed $1,050,000 for on call construction management, engineering design, nd City Engineer support services until June 30, 2027, extend the contract to no later than December 18, 2028, and increase the contract amount by no more than an additional $950,000 by additional contract amendments for a total not to exceed amount of $2,000,000.
