In An Amount Not To Exceed $1,050,000 For On Call Construction Management, Engineering Design, And City Engineer Support Services Until June 30, 2027, Extend The Contract To No Later Than December 18, 2028, And Increase The Contract Amount By No More Than An Additional $950,000 By Additional Contract Amendments For A Total Not To Exceed Amount Of $2,000,000 Recommendation
Staff recommends that the City Council adopt the above referenced resolution authorizing the City Manager to enter into a Professional Services Agreement with MNS Engineers, Inc. in an amount not to exceed $1,050,000 for On Call Construction Management, Engineering Design, And City Engineer Support Services until June 30, 2027, extend the contract to no later than December 18, 2028, and increase the contract amount by no more than an additional $950,000 by additional contract amendments for a total not to exceed amount of $2,000,000.

Background
Delivery of the Active Transportation Plan and other Capital projects listed in the Capital Improvement Plan is a critical priority for the Public Works Department, especially the Sustainable Streetscapes Program #SUT-01. To accomplish this, the department is proposing to engage MNS Engineers Inc.

An on-call contract is particularly useful since the Sustainable Streetscapes budget is annually replenished as part of our CIP, and is the primary mechanism for paving, bike, pedestrian, and transit improvements citywide. This contract may also be used to serve other CIP projects depending on funding availability and staff bandwidth as appropriate.

With an on-going 3-year On-Call contract, both design and construction managements services can be engaged as the annual project cycle delivers new infrastructure every year.

Our existing contract with Coastland Engineering for $1,159,627 has undergone six amendments and expires on June 30, 2024, and is fast running out of contract funds. As such, it was necessary to advertise a new RFQ for these services given that the contract term was in excess of five years.

Accordingly, on November 2, 2023, the City advertised an RFQ for Construction Management, Engineering Design, and City Engineer Support Services. The City received six proposals by the due date of December 1, 2023. The proposals were scored, and the two top firms were selected for additional interviews. As a result of these interviews, MNS Engineers Inc. was selected as the most qualified firm to carry out the required work.

Discussion
Under this agreement, MNS Engineers Inc. will provide construction management including environmental safety, safety oversight, document management, cost control, progress reporting, inspection, and project closeout. In addition, the consultant will provide engineering design services that include preparation of plan specifications, estimates, assessing utility coordination, and developing innovative design for active transportation projects. The scope also includes managing federal and state grants. Finally, the contract will allow for City Engineer Support Services which includes plan development and review, City staff augmentation, technical support, and engineering QA/QC.

Fiscal Impact
The proposed MNS Engineers Inc. agreement provides a not to exceed amount of $1,050,000. However, the resolution seeks City Council approval that would authorize the City Manager to extend the contract to no later than December 18, 2028, and increase the contract amount by no more than $950,000 through additional contract amendments for a total not to exceed amount of $2,000,000. This work is proposed to be funded from the design/professional services component of the capital improvement plan project budget.

Staff communication with the public
None.

Conflict of Interest

Conclusion
Staff recommends that the City Council adopt the above referenced resolution authorizing the City Manager to enter into a Professional Services Agreement with MNS Engineers, Inc. in an amount not to exceed $1,050,000 for On Call Construction Management, Engineering Design, and City Engineer Support Services until June 30, 2027, extend the contract to no later than December 18, 2028, and increase the contract amount by no more than an additional $950,000 by additional contract amendments for a total not to exceed amount of $2,000,000.
