Resolution Of The City Council Of The City Of Emeryville Authorizing The City Manager To Enter Into A First Amendment To The Construction Contract With Bay Construction, Inc. To Increase The Contract Amount By $12,168 To An Amount Not To Exceed $313,303 For The Construction Of The Davenport Mini-Park Renovation Project, CIP No. 16475017, And Transfer $12,168 From The Marina Navigation Channel Maintenance Dredging Program Funds, CIP No. 19495003, To The Davenport Mini Park Rehabilitation, CIP No. 16475017, Both In Fund 495 Recommendation
Staff recommends that the City Council adopt the above-entitled resolution.

Background
The Davenport Mini-Park Renovation Project is a Capital Improvement Program project, CIP #16475017, with the purpose of renovating and improving an existing mini-park and upgrading an existing play structure (“Project”).

The site is located along the north side of Powell Street between the Emery Cove Yacht Harbor and the Watergate Commons residential complex. The work area is located between the Bay Trail and the curb and gutter along Powell Street. The park consists of open space, native grasses and other landscaping, picnic table, benches, and low chain link fencing.

Community meetings were held in 2018 to discuss the ideas and needs of parents and children in the area. That same year the City’s Parks and Recreation (P&R) Committee recommended increasing funding to improve the site playground. On October 16, 2018, the City Council considered the P&R Committee recommendation and directed staff to continue development of the project and bring back additional details for funding and improvement of the site.

On July 21, 2021, the City Council unanimously adopted Resolution No. 21-87 to authorize the City Engineer to advertise for public bids, and transfer funds to cover anticipated costs to expand the scope of work to include a new play structure and improved fall-zone safety provisions.

The City experienced COVID challenges and staffing changes that significantly delayed developing bid specifications and issuing an RFP for the Project. In early 2022, Public Works staff authorized Coastland Civil Engineering, LLP to finalize the project specifications and prepare the project documents for bidding under their existing professional services contract.

Staff was able to obtain BCDC approval for the Project on February 28, 2022, under BCDC permit number M2021.020.00.

On April 15, 2022, the City Council authorized the execution of a contract with Bay Construction, Inc. for the construction and renovation of the Davenport Mini Park.

Discussion
The Project was substantially completed in February 2023 and a dedication ceremony was held on March 3, 2023, to officially open Davenport Park. Unfortunately, there were some cost overages associated with the work at Davenport Park that were not included in the contract’s initial scope of work. These include:

Additional work to remove damaged fencing and footing resulting from a car accident.

An additional safety fall zone was needed which required additional excavation and off haul.

Only one gate was listed in bid documents and 3 gates were required.

Additional change orders including the embedment of picnic tables, changed fence material to plastic coated fencing, and additional resin for safety surfacing.

Fiscal Impact
The First Amendment to the contract will increase the contract amount by $12,168 from $301,135 to $313,303 and transfer $12,168 from the Marina Navigation Channel Maintenance Dredging Program Funds, CIP No. 19495003, to the Davenport Mini Park Rehabilitation, CIP No. 16475017, both In Fund 495.

There are no other additional fiscal impacts anticipated. Future maintenance costs of the project area are included in the operating budget.

Staff Communication with the Public
There was no significant, non-routine staff communication with the public.

Conflict of Interest
Not applicable.

Conclusion
Staff recommends that it is in the public interest for the City Council to adopt the above-titled resolution.
