Resolution Of The City Council Of The City Of Emeryville Rescinding The Prior Second Amendment Dated July 1, 2023 For The ‘8 To Go’ Paratransit Shuttle Service Agreement With The Emeryville Transportation Management Association And Authorizing The City Manager To Execute A New Second Amendment, Retroactive To July 1, 2023, In The Amount Of $149,800 For FY23/24 For A Total Not To Exceed Amount Of $418,300 And Appropriate Said Funds When Received To Account 263-88400 Recommendation
Staff recommends that the City Council of the City of Emeryville rescind the prior Second Amendment, dated July 1, 2023, for the ‘8 To Go’ Paratransit Shuttle Service Agreement with the Emeryville Transportation Management Association (ETMA) and authorize the City Manager to execute a new Second Amendment to the contract, retroactive to July 1, 2023, in the amount of $149,800 for fiscal year 2023-2024 for a total not to exceed amount of $418,300 for continued service through June 30, 2024.
Background
The ‘8 To Go’ Paratransit Shuttle has been in service since 2008. The service was initially funded by a grant from the Alameda County Transportation Commission (ACTC) and provides accessible paratransit services for Emeryville and Oakland residents living in the 94608-zip code (hence the ‘8’ in 8 To Go). Eligible participants must either be age 70 or older, or 18 or older and eligible to use East Bay Paratransit. The shuttle service boundaries are 28th Street to the south, Dwight Way to the north, and Broadway/Telegraph to the east. Because of the targeted geographic service area, the program can deliver a higher frequency of rides, faster rides, and is more financially efficient than East Bay Paratransit.
Discussion
The current agreement went into effect on September 13, 2021. A First Amendment to the original contract was approved on July 18, 2022. The City Council approved a Second Amendment on June 20, 2023, which was effective July 1, 2023, to continue the contract through June 30, 2024. While there is no additional fiscal impact, the amounts listed in the Second Amendment were incorrect and reflected only an additional increase of $7,800 for this fiscal year and a not to exceed total contract amount of $149,800 which was incorrect. The correct increase should have been for $149,800 with a not to exceed total amount of $418,300. As a result of these errors, ETMA and staff have agreed that the prior Second Amendment should be rescinded by the City Council and a new Second Amendment to the contract, retroactive to July 1, 2023, be entered into in the amount of $149,800 for fiscal year 2023-2024 with a total not to exceed amount of $418,300 for continued service through June 30, 2024. ETMA approved the Second Amendment on April 9, 2024.
Fiscal Impact
The proposed Second Amendment with ETMA to provide shuttle services for July 1, 2023 through June 30, 2024 is an additional increase of $149,800.
Currently, the program is paid for by a combination of a Measure BB Grant from ACTC as well as Measure B/BB Direct Local Distribution (DLD) funding from ACTC. Since 8 To Go serves Oakland residents in addition to Emeryville residents, the City of Oakland contributes $50,000 of their annual DLD funds to the program.
The remainder of the program costs after Oakland’s contribution will continue to be covered by Emeryville’s DLD funds. No general funds dollars will be needed to support the program.

CONCLUSION
Staff recommends that the City Council of the City of Emeryville rescind the prior Second Amendment, dated July 1, 2023, for the ‘8 To Go’ Paratransit Shuttle Service Agreement with the Emeryville Transportation Management Association (ETMA) and authorize the City Manager to execute a new Second Amendment to the contract, retroactive to July 1, 2023, in the amount of $149,800 for fiscal year 2023-2024 for a total not to exceed amount of $418,300 for continued service through June 30, 2024, and appropriate said funds when received to Account 263-88400.
