Resolution Of The City Council Of The City Of Emeryville Accepting The Sanitary Sewer Spot Repairs FY22/23 Project, EPW 23-005 (CIP #15511005) As Complete And Authorizing The City Engineer To File A Notice Of Completion With The Alameda County Clerk Recommendation
Staff recommends that the City Council accept the Sanitary Sewer Spot Repair Project as complete and authorize the City Engineer to file a Notice of Completion with the Alameda County Clerk.

Background
The City of Emeryville, along with other East Bay jurisdictions, is under a Consent Decree with the Federal EPA to improve the City’s sanitary sewer collection system to reduce infiltration and inflow during wet weather. Accordingly, the City is rehabilitating existing sanitary sewer mains throughout Emeryville. For Fiscal Year 2022-2023, the rehabilitation includes spot repairs at various locations throughout the City.

Public Works Staff developed the plans and specifications for the Sanitary Sewer Spot Repairs Project, EPW 23-005 (CIP #15511005) and on July 18, 2023, the City Council approved the scope of work and authorized the City Engineer to advertise the project for public bidding. The scope of the project included performing sanitary spot repairs at the following locations:
53rd Street and Emery Bay Dr, 53rd Street and Hollis St, Shellmound St, Ohlone Way, and West MacArthur Blvd On November 7, 2023 the City Council authorized the City Manager to enter into a contract with Corcus Construction Inc. of San Francisco, CA in an amount not to exceed $460,685 to perform the work of the project.

Discussion
Overall the project was successful in the execution of its scope. However, there were complications with existing concrete-encased utility lines at 53rd St and Hollis St that made rehabilitation impossible. That segment of sanitary sewer pipe will be monitored and hydro-cleaned on an annual basis to mitigate problems that could arise from the defect being left in situ. Staff will reach out to the utility providers to request a utility relocation, and the sewer defect will be repaired as part of a Sewer Rehabilitation Project. As a result, staff deleted that repair work from Corcus’ scope of work.

Additional complications arose during the initial inspection of the sewer main on West MacArthur. Two isolated segments of pipe were in such poor condition they prevented the effective implementation of the cured-in-place-pipe (CIPP) liner repair specified in the scope. The City authorized the contractor to perform open-trench spot-repair of the two segments, thereby allowing the CIPP repair to be completed successfully.

The project is now complete and ready for acceptance by the City Council. A Notice of Completion must now be filed with the Alameda County Clerk.

Fiscal Impact
Corcus Construction completed the work of the project, minus the deleted work, for a total cost of $450,185 which is less than the contract amount of $460,685. The Public Works Department required staff augmentation to oversee and inspect the project. Public Works used its existing On-Call Civil Engineering Contract with MNS Engineers to perform this work. The cost was $118,163.25 which was funded through the existing CIP Budget in CIP#15511005 and CIP#ESI-01. Environmental testing services were needed to evaluate the potential hazardous materials on the project sites. Public Works used its existing On-Call Environmental Analysis Contract with P&D Environmental, Inc. to perform this work. The cost was $31,303.53 which was funded through the existing CIP Budget in CIP#15511005. Lastly, Public Works used its existing On-Call Materials Testing and Inspection contract with Applied Materials and Engineering, Inc. (AME) to verify soil and pavement compaction at project requiring soil and pavement restoration. The scope of work cost $3,462.50 and was funded through the existing CIP Budget in CIP#15511005.

There is sufficient funding in all funds and contracts. The breakdown is as follows:

Fund 511
Construction $ 357,453.63
Staff Aug $ 108,790.25
Environmental $ 31,303.53
