Resolution Of The City Council Of The City Of Emeryville To Execute Side Letters Of Agreement With The Service Employees International Union Local (SEIU) 1021 And The Confidential, Administrative, Managerial And Professional (CAMP) Bargaining Groups And Authorize A One-Time Lump Sum Payment To Regular Full-Time MESA Employees
WHEREAS, the current Memorandum of Understanding between the City of Emeryville (the “City”) and Service Employees International Union Local (“SEIU”) is in effect through June 30, 2026; and
WHEREAS, the current Memorandum of Understanding between the City of Emeryville (the “City”) and Confidential Administrative Managerial Professional (“CAMP”) is in effect through June 30, 2026; and
WHEREAS, the City of Emeryville City Council has previously adopted and periodically amended the Compensation and Benefit Plan for Unrepresented Employees (the “Plan”); and
WHEREAS, the Internal Revenue Service (IRS) conducted an audit of the Management of Emeryville Services Authority (MESA), concluded that the City is the common law employer of MESA employees, and determined that MESA employees are subject to paying social security taxes; and
WHEREAS, the City met with SEIU and CAMP bargaining units over the impacts of implementing social security taxes and reached agreement as reflected in the side letters of agreement;
NOW, THEREFORE, BE IT RESOLVED that the City of Emeryville City Council approves executing the side letters of agreement attached hereto and authorizes the one-time lump sum payment of $2,500 to impacted regular full-time MESA employees.
