Resolution Of The City Council Of The City Of Emeryville Authorizing An Amendment To The Classification And Compensation Plan To Add A Retired Annuitant Classification With An Hourly Salary Range of $19.36 - $175.27 And Approving An Amendment To The City’s Compensation Plan In Conformance With California Code of Regulations Title 2, Section 570.5
RECOMMENDATION
Staff recommends that the City Council approve the attached resolution amending the Classification and Compensation Plan.
DISCUSSION
The City’s Personnel Rules and Regulations state that Human Resources shall recommend a Compensation Plan and that the City Council shall approve amendments to the Classification Plan by resolution.
Human Resources has identified a need to create a separate and unique classification, Retired Annuitant, in order to properly classify retired individuals who may be hired by the City to perform a set of specialized work for a limited duration.
A retired annuitant is a CalPERS retiree who returns to work with a CalPERS employer in a designated position. Per the California Public Employees’ Retirement Law (PERL), the position must be designated as a retired annuitant position (not any other full-time or part-time position).
A retired annuitant is an at-will employee and can work up to 960 hours per fiscal year without losing their CalPERS retirement benefits. They do not accrue service credit or otherwise acquire any additional retirement benefits from employment.
There are two types of retired annuitant employment: “extra help” and interim (or acting) “vacant position” employment.
The hourly pay rate for a retired annuitant cannot be less than the minimum or exceed the maximum paid to other employees performing comparable duties. As such, the pay rate range has been set and will continue to be tied to the minimum wage and the highest hourly rate in the Classification and Compensation Plan. Furthermore, employees in the Retired Annuitant classification will not receive any benefits, incentives, or other form of compensation in addition to the hourly pay rate.
FISCAL IMPACT
The recommended classification does not affect the City’s FY 2023-2025 budget. No new FTEs will result from this classification.
CONCLUSION
Staff recommends that the City Council adopt the attached resolution approving an amendment to the Classification and Compensation to add a Retired Annuitant position.
